    The form of interval ownership in real property subject to timeshare plans has historically presented unique circumstances and challenges to Maui County\u27s Real Property Assessment Division in the appraisal, assessment, and administration of property tax appeals. This presentation will examine Maui County\u27s assessments of three condominium timeshare resorts, the tax appeals filed by the timeshare associations, and the ten (10) year history of litigation in Hawai´i’s Circuit Court and Tax Appeal Court, that culminated this year in a final decision from the Supreme Court of Hawai´i in Maui County’s favor. The topics covered will include: 1) The condominiumization of land and buildings subject to a statutory timeshare plan, 2) Maui County\u27s Real Property Assessment Division\u27s mass appraisal and assessment of the multi-story buildings and multi-unit condominium parcels, 3) The timeshare associations\u27 tax appeals filed with Maui County\u27s Board of Review, 4) Maui County\u27s procedure for retroactive assessments of omitted property, 5) The exclusive subject matter jurisdiction of Hawai´i’s Tax Appeal Court, 6) The constitutional authority of Hawai´i’s several municipalities over the real property tax function, and 7) The timeshare associations’ challenges to the constitutionality and legality of Maui County’s classification and assignment of real property for purposes of assessment and taxation

    Have you ever watched an appraiser struggle to prove that his report meets published professional standards? Ever had trouble pinning down the opposing expert’s report deficiencies? Every case needs a USPAP expert. If you are the de facto appraisal reviewer for your litigation team, the best candidate for the post might be you. This presentation will demystify USPAP and give you solid tools for communicating with your expert. You will learn the thirteen most important pages in USPAP, and the two essential words that apply to every written appraisal report. USPAP contemplates input from the client, so I’ll suggest some important jurisdictional and legal questions that your expert should discuss with you before they start work. We’ll also cover USPAP scope of work and record-keeping rules, so that you can convey your assignment expectations with greater clarity. To wrap up, I will point you to a USPAP review checklist to help you and your expert make sure that the bases have been covered. If you teach your expert these litigation-specific USPAP concepts, you will be more likely to get a USPAP-compliant appraisal report, and experience better outcomes during discovery, deposition, and cross examination

    Andrew McRoberts will share the stories of one of his earlier tax assessment cases, involving parcels of land in a Class A business park in the western Richmond, Virginia metro area. As the story unfolds, Andrew will share some of the legal, appraisal, assessment, and strategic issues that arose and were addressed, the highs and lows, and twists and turns of the case, which went through two trials and two visits to the Virginia Supreme Court, over nearly 8 years. These issues included the difference between subdivision and legal division, the effect of zoning and potential zoning on value, what is a sale of the “subject”, what is a truly comparable sale, the comparison between bulk sale and individual sale, selection and use of outside counsel, the fights lawyers pick over terminology, and the legal choices and rulings that occurred along the way. Andrew’s style is conversational, engaging and filled with good humor, while sharing helpful and interesting content for all involved in the appraisal, assessment, and legal defense thereof
