Pelunasan Piutang Kreditur Oleh Ahli Waris
Penelitian ini bertujuan untuk (1) menganalisa kedudukan kreditur atas pemenuhanprestasi berdasarkan Kitab Undang-Undang Hukum Perdata. (2) memberikan solusiterhadap permasalahan mengenai kewajiban ahli waris dalam pemenuhan prestasipewaris. Pendekatan penelitian yang digunakan dalam penelitian ini adalahpendekatan undang-undang dan pendekatan kasus dengan jenis yuridis normatif.Dalam melakukan perjanjian, para pihak seringkali terlibat dalam permasalahanterkait pemenuhan prestasi pihak lainnya, hal tersebut dinamakan wanprestasi.Seseorang dinyatakan wanprestasi karena beberapa hal salah satunya pemenuhanprestasi tidak sempurna. Dan pada kenyataannya selalu ada sebagian debitur yangkarena suatu sebab tidak dapat melakukan pemenuhan prestasi. Simpulan yangdiperoleh, yaitu : (1) Penelitian menunjukan hasil bahwa kedudukan kreditur dalamhukum perdata menentukan prioritas kreditur terhadap pelunasan utang. (2)Kewajiban pelunasan utang pewaris akan dialihkan kepada ahli waris yangmenerima warisannya. Kesadaran akan pemenuhan hak kreditur oleh seorangdebitur masih mengalami keterbatasan yang menunjukan permasalahan terkaitpemahaman akan asas yang ada dalam hukum perjanjian
Analisis Yuridis Pertimbangan Hakim terhadap Putusan Nomor 27/Pid.Sus/2020/Pn Sag Terkait TPPO dengan Motif Mail Bride Order
Tindak Pidana Perdagangan Orang (TPPO) dengan modus mail bride order merupakan bentuk eksploitasi modern yang berkedok pernikahan, umumnya menyasar perempuan yang berada dalam kondisi rentan secara sosial maupun ekonomi. Fenomena ini mencerminkan berkembangnya modus operandi TPPO yang semakin rumit dan tersembunyi, sehingga perlu dikaji secara lebih mendalam, terutama dalam konteks penegakan hukum. Penelitian ini bertujuan untuk mengkaji pertimbangan hukum dalam Putusan Nomor 27/Pid.Sus/2020/PN Sanggau, guna melihat bagaimana hukum pidana di Indonesia merespons kasus TPPO dengan latar belakang mail bride order. Penelitian ini menggunakan pendekatan yuridis normatif yang didukung dengan studi putusan, di mana analisis difokuskan pada ketentuan perundang-undangan, khususnya Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan TPPO. Dalam putusan tersebut, hakim menunjukkan pendekatan progresif dengan mengklasifikasikan praktik mail bride order sebagai bagian dari tindak pidana perdagangan orang. Analisis ini menunjukkan bahwa dalam kasus ini, prinsip kepastian hukum telah dijalankan dengan memperhatikan struktur internal norma hukum serta penerapannya secara konkret dalam proses peradilan. Dengan demikian, penelitian ini juga menunjukkan bahwa hukum pidana tidak hanya memberikan sanksi, tetapi juga menjamin perlindungan hak korban melalui putusan yang adil, tegas, dan dapat dilaksanakan
Proyeksi Konstitusional Electronic Voting Dalam Pemilu Berbasis Decision Support System Dalam Perspektif Good Election
Penelitian ini dilatarbelakangi oleh adanya kebutuhan mendesak terkait dengan modernisasi sistem pemilihan umum, dalam hal ini penggunaan kertas berlebih menyebabkan harus diadakannya efisiensi dan efektivitas melalui minimalisasi penggunaan kertas serta memperkuat transparansi. Hal tersebut dikarenakan Indonesia masih mengandalkan surat suara berbasis kertas yang menimbulkan permasalahan lingkungan dan keunagan di tengah kemajuan teknologi yang pesat. Permasalahan utama yang dikaji dalam penelitian ini yakni untuk mengkaji pengintegrasian e-voting dengan DSS secara konstitusional untuk memenuhi prinsip-prinsip pemilu demokratis sebagaimana telah diamanatkan Pasal 22E UUD 1945 yaitu langsung, umum, bebas, rahasia, jujur, dan adil (LUBER JURDIL) dalam kerangka pemilu yang baik (good election). Penelitian ini dilakukan menggunakan metode yuridis normatif dengan pendekatan kualitatif. Melalui kombinasi antara analisis hukum dan studi literatur, serta mencakup ketentuan konstitusional, perundang-undangan, putusan pengadilan, serta kesiapan infrastruktur. Penelitian ini juga melakukan perbandingan dengan negara lain terkait dengan penerapan e-voting. Hasil penelitian menunjukan bahwa e-voting yang terintegrasi dengan DSS memungkinkan memberikan keuntungan secara signifikan dalam pemilu, transparansi data, efisiensi biaya, dan pemeliharaan lingkungan. Hal ini perlu dilakukan reformasi hukum secara komprehensif
Penyelesaian Sengketa Pengadaan Tanah Untuk Kawasan Cagar Budaya
Kawasan cagar budaya merupakan kawasan ruang geografis didalamnya terdapat dua situs cagar budaya dengan tata letak berdekatan antara situs cagar budaya lainnya dan/atau cagar budaya tersebut memiliki ciri tata ruang yang khas. Demi perkembangan dan pemanfaatan kawasan cagar budaya pemerintah melakukan perluasan dengan cara pengadaan tanah, akan tetapi pengadaan tanah yang dilakukan rawan menimbulkan konflik dan terjadi sengketa pengadaan tanah. Bumi, air bahkan kekayaan yang terdapat didalamnya merupakan kekayaan milik negara sehingga menimbulkan kewajiban negara untuk mengelola serta mengatur penggunaan serta kepemilikan tanah sehingga penggunaan tanah dapat merata secara adil. Dengan perencanaan pengadaan tanah yang sitematis dan terbuka, serta penyelesaian konflik yang dilakukan diharapkan bahwa masyarakat mampu meraih keadilan
Criminal Law Enforcement on Digital Identity Misuse in AI Era for Commercial Interests in Indonesia
The rapid development of Artificial Intelligence (AI) technology particularly in the forms of deepfakes and voice cloning has significantly impacted the lives of Indonesians. While AI offers various conveniences and innovations, it also poses serious threats, especially the misuse of digital identities for commercial purposes. This study aims to analyze the adequacy and effectiveness of Indonesia\u27s criminal law, particularly the Indonesian Criminal Code and Law No. 11 of 2008 on Electronic Information and Transactions (ITE Law), in addressing AI-based digital identity crimes. Using a normative juridical approach, this research finds that current legal frameworks do not specifically regulate AI-related offenses. As a result, perpetrators often exploit legal and technological loopholes to avoid prosecution. The consequences of these crimes are far-reaching, including financial losses, reputational damage, and psychological trauma for victims. The study recommends revising the ITE Law, strengthening personal data protection, forming an AI-based digital forensics task force, and fostering cross-sectoral collaboration to combat digital identity crimes without stifling technological innovation
From Peer Education to Legal Empowerment: Youth-Led Strategies for Preventing Sexual Violence in Indonesia
Sexual violence against minors in Indonesia remains a critical issue that reflects deep structural inequalities and limited protective mechanisms. This study applies a normative juridical approach, drawing on statutory law, ministerial regulations, case reports, and scholarly commentary to examine how legal and community-based strategies intersect in addressing the problem. The method relies on secondary data rather than field research, with analysis focused on interpreting how legal frameworks connect with peer education and adolescent mentoring initiatives. The results point to three central gaps: the lack of a comprehensive sexuality curriculum in schools, limited recognition of bodily autonomy, and weak integration of prevention programs into existing legal structures. These shortcomings create vulnerabilities that leave young people without adequate tools to protect themselves or seek help. The discussion highlights four interrelated strategies to strengthen adolescent resilience: preparing trained peer educators, establishing structured mentoring and counseling systems, involving families and community organizations, and implementing targeted public-awareness campaigns. Each element contributes to both community-level support and the realisation of statutory obligations to protect children from sexual violence. Although this research does not provide empirical measurements, its interpretive analysis outlines a framework that may guide future studies and inform policymakers. By connecting legal obligations with practical community efforts, the study underscores that peer education and mentoring are not peripheral solutions but integral components of a rights-based approach to safeguarding adolescents
Interpretation, Inclusiveness, and Ambiguity: A Critique of Rule Design in Modern Legal System
This paper analyzes three critical concerns in the formulation of contemporary legal regulations: the propensity for over- or under-inclusiveness, ambiguity in application, and interpretive difficulties. This study utilizes a normative-doctrinal legal methodology within an interdisciplinary framework, incorporating jurisprudence, legal linguistics, and regulatory theory, to argue that rules function not solely as normative instruments but as socio-linguistic constructs shaped by power dynamics and interpretive communities. The intrinsic abstraction and prescriptive characteristics of legal language led to ambiguity and practical uncertainty. This paper challenges the formalistic assumptions inherent in traditional rule-making through a conceptual examination of the difference between rules and standards and a multidimensional exploration of rule typologies, including legal status, language structure, and normative power. The research moreover suggests strategic methods to enhance regulatory efficacy and flexibility, including the formation of interpretative communities and the implementation of goal-oriented regulatory frameworks. The findings seek to enhance the development of regulatory systems that are contextually adaptive and normatively consistent, providing insights for improved legal rule formulation in evolving social contexts
Judicial Discretion and Statutory Sentencing Limits in Juvenile Premeditated Murder Cases
Legal protection for children in conflict with the law is normatively regulated within the Indonesian legal system, particularly through Law Number 11 of 2012 on the Juvenile Criminal Justice System. Nevertheless, existing scholarship largely addresses juvenile protection in general terms and has not sufficiently examined the doctrinal tension between judicial discretion and statutory sentencing limits in cases involving serious crimes committed by juveniles. This study analyzes the scope of legal protection afforded to juvenile offenders involved in premeditated murder and critically examines judicial reasoning in imposing prison sentences that exceed the maximum limits prescribed by law. Employing a normative juridical research method with statute, case, and conceptual approaches, this study finds that although formal and material safeguards for juvenile offenders are clearly established in legislation, their application in judicial practice remains inconsistent. Courts frequently invoke substantive justice considerations and the combined theory of sentencing objectives to justify sentences exceeding statutory limits, primarily on grounds of social protection and deterrence. This article argues that such practices reflect a doctrinal inconsistency within Indonesia’s juvenile justice system, as they contravene the principle of legality and undermine the child-protection orientation mandated by Article 81 paragraph (6) of Law Number 11 of 2012. This study contributes to juvenile justice discourse by proposing the necessity of clearer sentencing guidelines and strengthened judicial oversight to prevent excessive judicial discretion and to ensure the consistent implementation of child protection principles
Analisis Historis Kebijakan Ekonomi Orde Baru dan Dampaknya terhadap Transformasi Struktur Perekonomian Indonesia (1966-1998)
This study aims to analyze the economic policies of the New Order in a historical context and assess their impact on Indonesia\u27s economic transformation during the period 1966–1998. Starting from the acute economic crisis at the end of the Old Order, marked by extreme inflation, fiscal deficits, and the decline of the agricultural and industrial sectors, the New Order government implemented a series of stabilization and development policies coordinated by technocratic economists. This study employs a descriptive qualitative method, incorporating a literature review approach, and follows Kuntowijoyo\u27s historical research stages, which include heuristics, source criticism, interpretation, and historiography. The contribution of this research lies in its holistic mapping of the dynamics of New Order economic policy, from the stabilization phase through oil-boom-based development expansion, export-oriented industrialization, to the 1997 Asian financial crisis, which marked the collapse of this development model. The results of the study show that Indonesia\u27s economic transformation from agriculture to industry and services has successfully driven high growth, macroeconomic stability, and increased food production. However, this success was built on a fragile foundation, including dependence on oil, foreign capital, foreign debt, and weak economic institutions. This study emphasizes that sustainable development requires institutional reform and economic strategies that are not only growth-oriented but also environmentally and socially responsible.
Rethinking Justice: The Urgent Need to Simplify Legal Appeals and Cassation for Faster Administrative Court Decisions
The efficiency of procedural examinations in Indonesia’s state administrative courts is essential for ensuring timely justice, especially in cases requiring urgent resolution. However, the current appeals and cassation processes often extend the overall timeline, undermining the court\u27s ability to address urgent matters swiftly. While the initial procedural examination may be expedited, the subsequent appeal and cassation stages follow the same cumbersome steps as ordinary procedures, leading to significant delays—sometimes spanning several months. This prolonged timeline is particularly concerning when quick resolution is critical, as it can hinder the effective administration of justice. This study examines the necessity of simplifying the legal appeals and cassation processes to ensure faster and more efficient case resolutions in state administrative courts. Using a normative juridical research method, the paper assesses the inefficiencies of the current system, highlighting the urgent need for reform. It draws on Lawrence M. Friedman’s legal system theory to identify gaps within the existing framework that contribute to delays and proposes strategic interventions to streamline these processes. The findings suggest that, in addition to simplifying procedural measures, the integration of technology—such as an e-court system—could significantly expedite the appeal and cassation processes. By embracing digital solutions, administrative courts can reduce case backlogs and enhance efficiency, thus improving the overall responsiveness of the judicial system. This research contributes novel insights into how legal procedures can be reformed to better meet the demands of urgent cases. The study emphasizes the critical importance of judicial efficiency and technological innovation, offering actionable recommendations for policymakers to improve administrative justice in Indonesia
