"HB 2160 proposes to amend K.S.A. 8-1906. As drafted it would exempt the farmer/producer, regulated private and public (for-hire) motor carriers from the current load securement requirements outlined in the statute. ... Expanding an exemption for the regulated private and public motor carriers will have a negative impact and cause a noncompliance issue with the FMCSA [federal motor carrier safety administration] which could jeopardize both the motor carrier safety assistance program (MCSAP) grant funding and the states federal-aid highway Funds. ... As written we do not support this bill because it would put us into non-compliance with federal requirements.

This same testimony, with minor changes, was presented before the Kansas Legislature, House Committee on Energy, Utilities, and Telecommunications, by Leo Haynos, Chief Engineer, Utilities Division, Kansas Department of Commerce, on February 9, 2023.Testimony in support of HB 2226. "The Kansas Underground Utility Damage Prevention Act, (KUUDPA), establishes the rules for communication between the excavators and utilities in order to prevent damage to buried infrastructure and to prevent accidents. It requires the excavator to notify the utility of his intent to dig, and it requires the utility to provide a visual indication of the where the utility is located in the easement. HB 2226 proposes the following KUUDPA updates: 1. K.S.A. 66-1802: Change the definition of "whitelining" to allow the excavator to provide a virtual excavation path when applying for the ticket and other minor definition updates; 2. K.S.A. 66-1804: Lengthen the life of a locate ticket from 15 days to 20 days, and provide flexibility to the statute by allowing the Corporation Commission to adjust the mandated time intervals regarding locates through a rules and regulation process; 3. K.S.A. 66-1806: Provide flexibility to the Commission to modify the amount of time allowed to utilities to complete locates after receiving the excavator's request; 4. Require excavators to notify operators of possible damage by notifying the notification center using a "dig-up" ticket; and 5. Provide some miscellaneous cleanup of the law.

"SB 88 would require statewide elections of Kansas Corporation Commission (KCC) Commissioners and establish a utilities regulatory division within the office of the Attorney General (AG). The newly created AG’s utility regulatory division would represent and protect the collective interests of all utility customers in any rate-related proceedings of the KCC and in any other state or federal judicial or administrative proceedings and would be staffed by transferring all current KCC utilities staff to the AG’s office. SB 88 would also exempt the KCC from the open meetings act (K.S.A. 75-4318).

"SB 6 amends statutes addressing infectious and contagious diseases, specifically the authority of the Secretary of KDHE and county local health officers. ... Overall, SB 6 would remove or drastically limit the authority of the secretary of health and environment, as well as drastically limit the authority of local health officers. SB 6 would remove the secretary of health and environment's authority to designate which diseases are reportable to public health in Kansas. Instead, the secretary would submit a report to the legislature. Moreover, the secretary's authority to adopt rules and regulations to prevent transmission would be removed. Instead, the secretary would only be able to make recommendations to the public and provide education on ways to prevent disease spread. Under SB 6, teachers and school administrators would no longer be required to report infectious diseases; identifying cases or outbreaks of infectious diseases in schools and preventing transmission would become increasingly challenging. Public gatherings would no longer be allowed to be prohibited for the purpose of disease control. Isolation and quarantine would become recommendations only rather than legal orders, and thus, unable to be legally enforced.
