Testimony before the Kansas Legislature, Senate Transportation Committee, by Cory Davis, Director of Multimodal Transportation and Innovation, Kansas Department of Transportation.Neutral testimony concerning SB 271. "Senate Bill 271 authorizes both law enforcement and the Secretary of Transportation or their designee to enter railroad property and inspect railroad equipment, facilities, rolling stock, operations, and relevant records at reasonable times and in a reasonable way. However, it only authorizes a law enforcement officer to prepare and deliver a notice of a violation. Given this, it is unclear what KDOT's role in this part of the process would be. KDOT is supportive of rail crossing safety and those aspects of this bill. ... KDOT does not currently have staff with the expertise or skillset to perform the inspections listed in the bill. To properly inspect railroad operations, KDOT would have to hire, educate, and train new employees statewide to properly provide oversight and perform inspections. To address any uncertainty, KDOT respectfully suggests removing the language listing the Secretary of Transportation or their designee to address any uncertainty and allowing law enforcement to be the sole entity with authority to enforce the contents of the bill.

"KDOT is neutral regarding this bill. However, the agency does have a concern with KDOT being named as the agency to receive notice of the progress of the installation of the lighting system and if necessary, a delay notice and update for extensions past the initial 24-month timeframe. We would suggest KDOT is not the appropriate agency to engage in this repository role for Senate Bill 49. ... KDOT does not have authority in this space. Instead, the Federal Aviation Administration is the agency with exclusive authority to regulate aviation safety, the efficiency of the navigable airspace, and air traffic control over airspace and is listed appropriately in the bill to manage system reviews. ... KDOT is not currently staffed or equipped to perform the functions of the bill.

"HB 2198 seeks to affiliate Kansas Department of Wildlife and Parks (KDWP) law enforcement personnel with the Kansas Police and Fireman's Retirement System (KPF). KDWP supports the provisions of the bill. ... HB 2198 would allow full-time law enforcement certified employees within KDWP's Law Enforcement, Parks, and Public Lands divisions to transition into KPF from the Kanas Public Employees Retirement System (KPERS). ... This change is necessary for the long-term health of the agency and will aid in recruitment and retention of these valuable public safety positions. ... KPF has slightly different retirement benefits that encourage transition out of law enforcement at an earlier age, protecting individual officers from being involved in physical confrontations at a later age, and we feel it is appropriate to add our officers into this system.
