Testimony before the Kansas Legislature, Senate Utilities Committee, by Justin Grady, Chief of Revenue Requirements, Cost of Service and Finance, Kansas Corporation Commission.Neutral testimony concerning SB 68. "Senate Bill 68 would establish a Right of First Refusal (ROFR) for incumbent electric utilities in Kansas to build transmission facilities that would otherwise be subjected to competitive bidding before the Southwest Power Pool (SPP). The current Transmission Owner Selection Process (competitive bidding process) in the SPP was approved by the Federal Energy Regulatory Commission in 2011. ... There are both pros and cons to the continuation of competitive bidding for certain subsets of regional transmission development in Kansas. ... Competition for the right to own transmission in Kansas has thus far had a mixed track record. As noted above, there have only been two Kansas projects that have been awarded through a competitive bidding process. One project in Southwest Kansas was cancelled,...but not until considerable time and money was spent by Kansas utilities and non-incumbents to participate in the process. The other project, described above, has been more of a success story, with significant cost savings. ... But, those cost savings have come at the cost of lengthier, more costly, and more controversial regulatory proceedings, and a general distrust by Kansans of out of state entities coming to the State to build transmission. Ultimately...the decision for whether Kansas utilities should have to compete for the right to build regionally funded transmission is a policy decision that is fully within the purview of the Legislature to decide

Testimony before the Kansas Legislature, House Commerce Committee, by Paul Hughes, Deputy Secretary of Commerce, Kansas Department of Commerce.Testimony in support of HB 2334, "changes to the economic development tool APEX, Attracting Powerful Economic Expansion, to permit the state to continue to compete for an additional megaproject and other supplier companies. Through bipartisan collaboration not only was the APEX tool created, two APEX agreements have been signed (Panasonic and Integra). These historic economic development projects will diversify the state’s economy, invest billions of dollars in Kansas and provide thousands of high-quality jobs for Kansans. ... The extension of the sunset to December 31, 2024 and the ability for the state to compete for one additional APEX agreement with a qualified firm is the first change proposed created by this bill. ... the third APEX agreement would not trigger a reduction of 0.5 percent to the corporate income tax. This is the second change proposed identified in the bill. Additionally, this bill allows a qualified firm who has signed an APEX agreement to be eligible for traditional incentives for a new and different project.
