    "March 7, 2024." Testimony before the Kansas Legislature, House Transportation Committee, presented by Joel Skelley, Director of Policy, Kansas Department of Transportation. This same testimony, with minor changes, was presented before the Kansas Legislature, Senate Transportation Committee, by Joel Skelley, Director of Policy, Kansas Department of Transportation on January 23, 2024.Testimony in support of SB 142. "KDOT supports this bill as it relates to safety on our roadways. If a vehicle is in a crash or disabled on the side of the road, the people in or around this vehicle are vulnerable road users or pedestrians that could be killed or injured if struck by another vehicle. A stationary vehicle on the side of the road is also an object that could be struck by another vehicle and therefore, puts that driver and passengers at a higher risk of death or injury. ... This proposed legislation enhances the current move over statutes to now include every passenger vehicle that is stopped or disabled on the side of the road displaying hazard warning signal lamps, road flares or caution signals. This enhancement makes it easier to educate the driving public as now drivers will be required to move over or slow down if there is a vehicle on the side of the road with flashing lights. This bill supports the agency's Drive to Zero mission of reducing death and injury on Kansas roads by providing another tool to protect those people and vehicles either stranded or disabled on the side of the road, making us all safer on Kansas Roads.

Testimony before the Kansas Legislature, Senate Transportation Committee, presented by Joel Skelley, Director of Policy, Kansas Department of Transportation.Testimony in support of HB 2682. "KDOT supports this legislation to authorize the Director of Vehicles (Director), Kansas Department of Revenue (KDOR), to participate in and implement the Federal Motor Carrier Safety Administration's Drug and Alcohol Clearinghouse Program (Clearinghouse). Without this legislation the state of Kansas would become noncompliant with federal law. According to the Code of Federal Regulations, failure to comply will result in a penalty of withholding of up to 4 percent of the State's apportionments for the National Highway Performance Program (NHPP) and Surface Transportation Block Grant Program (STBG) for the first noncompliance and up to 8 percent thereafter. This would be a loss of funding, not a transfer, meaning funds will lapse immediately. Federal aid highway funds that are withheld are not available in the future, meaning they will not be refunded to the state. The loss of these federal funds will impact the agency's ability to meet its commitments under IKE program.
