"This bill makes changes to the current statute including re-instating the Kansas Department for Aging and Disability Services to provide assessment and referral services, through a designated care coordination agency, to individuals that are in the custody of the Kansas Department of Corrections and who qualify for the program. This is extremely important to reinstate as a public safety issue and subsequent policy. The care coordination program is a critical service for these offenders to assist them in understanding addiction and making the life changes needed to recover from addictive disease and end driving while under the influence."

Testimony before the Kansas Legislature, House Committee on Energy, Utilities, and Telecommunications, presented by Justin Grady, Chief of Revenue Requirements, Cost of Service and Finance, Kansas Corporation Commission.Testimony in opposition to HB 2527. "The Staff of the KCC is opposed to HB 2527 in its current form. This bill contains four separate sections that each could have been a separate bill. Accordingly, this testimony will address each section of the bill separately. Staff contends that Sections 1, 3, and 4 are largely a policy decision for the Kansas Legislature, and we stand ready to work through our concerns with these sections as part of a broader stakeholder process, should the Committee choose to further consider these sections of the bill. However, Section 2 of this bill should not receive any further consideration beyond this hearing, and should be struck from the bill in its entirety. Should Section 2 of this bill become law, it would dramatically and negatively alter the landscape of utility regulation in this State to the direct benefit of utility shareholders and to the direct detriment of utility ratepayers. Section 2 of this bill would strip the Commission of the authority to determine a reasonable capital structure and Return on Equity (ROE), two of the most material rate issues decided in every utility rate proceeding. The result could very well be hundreds of millions of dollars in unjust wealth transfer every year, from utility ratepayers in Kansas to utility shareholders.

"SB 455 was amended by the Senate Committee on Utilities to include the language from SB 456. In the senate, Staff testified that we were neutral on both SB 455 and SB 456 and we viewed both bills as a policy decision for the legislature. While Staff had no concerns regarding the original language in SB 455, we did have concerns regarding some of the language in SB 456 and we indicated that we would welcome the opportunity to work with stakeholders on revising the language. ... Staff continues to view SB 455 as amended by the Senate Committee as a policy decision for the legislature. Staff's original concerns with SB 455...were addressed in stakeholder meetings and are addressed by the proposed balloon amendment.
