The Department's adjusted budget for FY 2025 and requested budget for FY 2026 closely align with the previously approved FY 2025 budget. This consistency ensures the continuation of our programs, provides stability for staff and users, and allows us to effectively conserve and enhance Kansas' natural resources for current and future generations. ... HB 2007 deleted the reappropriation of $1.9 million of State General Funds for FY 2025 which we planned to use for dam repairs. In HB Sub 2007, the House Committee on Appropriations reappropriated these funds as the reduction would have significantly disrupted these dam maintenance projects which are already in process. ... Wildlife and Parks’ FY 2026 budget request relies on more than 90.0% funding from fee funds and federal aid and comparatively smaller portion of funding from the state’s Economic Development Initiatives Fund (EDIF) to continue offering vital outdoor recreation for all Kansans. The EDIF is an essential funding source for KDWP, and its removal would place an undue burden on the Wildlife Fee Fund and Park Fee Fund, both of which are already stretched thin due to rising costs for materials, operations, and salaries. ... I urge you not to cut our agency’s funding from the Economic Development Initiatives Fund. ... I look forward to continuing to work together to conserve Kansas’s wildlife and its habitats and our treasured state parks.

This bill represents a crucial step towards addressing the pressing needs of individuals experiencing mental health crises in Kansas. HB 2146, for State Fiscal Year 2026, adds 12M for crisis services and 8M to $16M. HB 2146 offers a practical and sustainable solution by tapping into existing revenue streams generated by Lottery Vending Machines to fund essential services for those in crisis and individuals that are seeking to live independently in our communities.

"It could restrict the ability to execute the agency's mission to provide safety net services. The requirement to seek legislative approval prior to amending and submitting state plans, and prior to implementing new federally funded programs could result in delays in funding or an inability to accept new funding. KDADS has successfully brought in millions of dollars in federal funds to the state to enhance or expand services, particularly in the behavioral health area. State plans, and their corresponding amendments, new federal regulations which may require a waiver, and new program opportunities typically do not correspond to Kansas legislative calendar. There is already legislative oversight of Home and Community Based Services Waivers that KDADS administers as those require legislative appropriation."

Includes an attachment of K.A.R. 5-16-1, 5-16-3, 5-16-4, and 5-16-6, which is marked "draft" in the January 30, 2025 testimony.Testimony in support of Senate Bill 58 "which requests modifications to the state's multi-year flex account (MYFA) term permit statute. ... The most significant changes proposed by this bill would modify the calculations that determine a MYFA's multi-year quantity allocation in two important ways. First, allocation calculations would no longer rely on past average water use. Relying on past average use to assign future allocations has created a culture of "use it or lose it," wherein irrigators are incentivized to divert more water than necessary to successfully grow a crop in order to keep their average use high and which does not promote conservation. Second, the proposed changes will eliminate the possibility for the same acres to essentially be counted twice in determining the quantity allocation, which has the potential to increase net consumptive water use and again does not promote conservation. ... KDA feels these changes are very positive modifications to the MYFA statute. KDA is also committed to amending our MYFA regulations to conform them to these statutory amendments and to further improve the function of MYFAs. Working drafts of those regulation amendments are attached for your convenience."

"HB 2111 proposes updates to current statutes regarding the CREP acreage cap in order to lower the water use eligibility threshold, expand the types of land use allowed on acreage enrolled in CREP, increase the total acreage allowed under the program, and provide for the ability to approve the last remaining contract in the event a state or local cap is reached."

The agency takes no position on Section 1 and the components regarding irrigation district voting procedures on pages 1-5 of the bill. We are in support of the exemption for dry detention road fill dams in Section 2 on page 7, subsection (e), as it mirrors language that the agency is seeking in House Bill 2114, and we believe this is an appropriate regulatory framework for structures of that nature. We also appreciate the language that allows for civil penalties as reflected in Section 3, subsection (c), on page 8. ... We are, however, concerned with the definition of a dam as outlined in Section 2 of this bill, and the negative impacts that would have in Kansas, including concerns about safety risk as well as negative fiscal impacts both for the state and for dam owners."
