Testimony before the Kansas Legislature, House Committee on Commerce, Labor, and Economics, presented by Derik Flerlage, Director, Bureau of Family Health, Kansas Department of Health and Environment.Testimony in opposition to House Substitute for SB 96. "There has been intense focus on KDHE's CCL program. With a major departmental restructuring that took place and a comprehensive review of child care regulations, I am excited to report that our program has made historically significant improvements since the 2023 legislative session. ... Our team recognized the opportunity to accelerate what needed to be done and completed a swift and comprehensive regulatory review and rewrite, all centered around a strategic plan to address four different categories for review: Federal compliance, home providers, center and preschool providers, and our existing school-age and drop-in programs. Our approach was to directly involve providers in the drafting of the regulations, as it most closely affected them. ... For us to continue modernizing and reacting to needs as they emerge in Kansas communities with minimal disruption, KDHE continues to support that regulations should not be moved to statute and that ratios and professional qualifications should be aligned with providers' feedback and expertise. The provisions currently included in SB 96 jeopardize safety and are out of alignment with the preferences providers expressed to our agency during our regulatory review engagement sessions. ... Rigid state statutes would not allow for...flexibility, while adding to the ambiguity of who has ultimate authority in enforcing those who may violate it. ... Lastly, it would not be to the advantage of KDHE, the legislature, our providers or Kansas families to wait for the legislative session for potential changes to state statute. KDHE can engage in regulatory review as needed to enact changes and provide exceptions to current regulations that may inhibit individual providers' operations.

This same testimony was presented before the Kansas Legislature, Senate Committee on Transportation, by Kent Selk, Driver Services Manager, Kansas Department of Revenue on March 6th, 2024.Testimony in support of HB 2682. "This bill ensures Kansas is compliant with Federal Motor Carrier Associations rule on Drug and Alcohol Clearing House; 49 CFR 382. Failure to comply with Federal Motor Carrier regulations would result in a reduction in state highway funding. This legislation would authorize the Director of Vehicles to implement the necessary rules and regulations for participation in the Federal Motor Carrier Associations Drug and Alcohol Clearinghouse program (DACH). The DACH is an online database that gives employers, State Driver Licensing Agencies, and State law enforcement personnel real time information about CDL holders' drug and alcohol program violations. The DACH program is intended to promote safer highways and ensure that only qualified drivers are eligible to obtain and retain a CDL.

    "February 15, 2024." Testimony before the Kansas Legislature, House Committee on Transportation, presented by David Harper, Director, Division of Vehicles, Kansas Department of Revenue.Testimony in support of HB 2762. "This bill would provide statutory authorization for the Division of Vehicles to begin the process of implementing mobile driver's license and identification cards in Kansas. The 2023 Appropriations Senate Bill 25 provided expenditures shall be made by the Department of Revenue to modernize driver's licenses to allow electronic use as a digital driver's license that can be stored on mobile device applications: provided that such digital driver's license shall be compatible with federal transportation security administration checkpoints. HB 2762 is step one in the process for the agency to begin to develop the road map towards the potential future implementation of digital credentials. A mobile driver's license is a secure, digitized version of a physical driver's license or other state issued ID that is carried in an app on a smartphone. Mobile driver's licenses and IDs are intended to be a companion to a physical driver's license and not a replacement. The two primary reasons for implementing a mobile DL/ID program are security and convenience.
