Implementacja do polskiego porządku prawnego Dyrektywy platformowej 2024/2831 – obszary istotne dla całego prawa pracy
No full textThe subject of this article is the problem of implementation of Directive of the European Parliament and of the Council (EU) 2024/2831 of 23 October 2024 on improving working conditions in platform work1 (hereinafter: Platform Directive 2024/2831) into the Polish legal order in the context of the adoption of two regulatory areas that will be relevant not only to the platform sector, but also to the labour law as such and to all employment relations that are the subject of its regulation. The former is the introduction of measures to facilitate the determination of the correct employment status of those performing platform work (presumption of employment relationship), the latter being the promotion of transparency, fairness, human oversight, safety and accountability in algorithmic management with regard to platform work. The relevance and universal nature of the two objectives adopted in Platform Directive 2024/2831 determines that the Polish legislator, when implementing these provisions into the national legal order, will have to consider regulating them with respect to all employment relations operating in our labour market. In the beginning, the author summarises the 6th national scientific conference in the series “Atypical Employment Relations”, organised on 7 December 2023 by the Centre for Atypical Employment Relations at the Faculty of Law and Administration of the University of Lodz ([email protected]) on the subject of The development of modern technologies on labour and social security law – challenges for the future, which is the culmination of this volume of the journal “Z Problematyki Prawa Pracy i Polityki Socjalnej”.Przedmiotem niniejszego opracowania jest problem implementacji do polskiego porządku prawnego Dyrektywy Parlamentu Europejskiego i Rady (UE) 2024/2831 z dnia 23 października 2024 r. w sprawie poprawy warunków pracy za pośrednictwem platform internetowych28 (dalej: Dyrektywa platformowa 2024/2831) w kontekście przyjęcia dwóch obszarów regulacyjnych, które będą istotne nie tylko dla sektora platformowego, ale także dla całego prawa pracy i dla wszystkich stosunków zatrudnienia stanowiących przedmiot jego regulacji. Pierwszym z nich jest wprowadzenie środków ułatwiających określanie prawidłowego statusu zatrudnienia osób wykonujących pracę za pośrednictwem platform (domniemanie stosunku pracy), drugim zaś promowanie przejrzystości, sprawiedliwości, nadzoru ludzkiego, bezpieczeństwa i rozliczalności w zarządzaniu algorytmicznym w odniesieniu do pracy za pośrednictwem platform. Doniosłość oraz uniwersalny charakter obu celów przyjętych w Dyrektywie platformowej 2024/2831 przesądza o tym, że polski ustawodawca, implementując te przepisy do krajowego porządku prawnego, będzie musiał zastanowić się nad ich unormowaniem w odniesieniu do wszystkich stosunków zatrudnienia funkcjonujących na naszym rynku pracy. The author analyses the literariness of the texts in the context of the notion of the bodily sublime and examines how Długosz sought to convey the specificity of the mountaineering experience to readers without expert knowledge of climbing. Długosz’s writing is interpreted as a crucial link in the development of Polish mountaineering literature, with its distinguishing feature identified as a “mediating” literariness.L’articolo è dedicato alla prosa alpinistica di Jan Długosz. L’autore del saggio analizza la natura letteraria dei testi nel contesto di questioni di sublimità corporea e considera il modo in cui lo scrittore ha cercato di trasmettere la specificità dell’esperienza in montagna a un lettore che non aveva conoscenze specialistiche in materia di arrampicata. La scrittura di Długosz viene interpretata come un importante anello di congiunzione nello sviluppo della letteratura alpina polacca e la sua caratteristica distintiva è la natura letteraria “di mediazione”.This article explores the mountaineering writing of Jan Długosz. Notatki o "La virtù sconosciuta" Vittorio Alfieriego
No full textAlfieri’s La virtù sconosciuta is one of the author’s most personal texts. The work, a dialogue with his deceased friend Francesco Gori Gandellini, recalls an essential fragment of the author’s life and work from 1786. The text contains many stories about the his-tory of literature, Alfier’s past and future, and specific fragments of his autobiography, which the author published shortly thereafter. However, the article attempts to emphasise the political significance of this work. As Giuseppe Ricuperati claims, in fact, this dialogue, along with other treatises, refers to the European Enlightenment tradition and is close to authors such as Montesquieu, Voltaire, Rousseau, Helvétius, Boulanger, Mirabeau, Diderot. The study, therefore, attempts to highlight the political level of the work by examining its various aspects, from the choice of the interlocutor, a Republican from Siena, to the points of contact of this dialogue with other political works of the Asti area. Historical and archival aspects are then examined: the work was developed at the Kehl printing house, where Alfieri published his other political texts to escape the restrictions of French censorship. Finally, the first draft of La virtù sconosciuta appears in the same formula in which the above-mentioned political works are created.All’interno dell’opera alfieriana, La Virtù Sconosciuta è uno dei testi più intimi dell’autore: l’opera, un dialogo tra Alfieri e l’amico defunto Francesco Gori Gandellini, restituisce un importante frammento della vita e della poetica dell’autore all’altezza del 1786. È infatti possibile rintracciare nel testo molti segni della vicenda letteraria alfieriana, passata e futura, e in primis alcune suggestioni riguardanti l’autobiografia, che l’autore inizierà a stendere di lì a poco, a partire dal 1789. Nel corso del presente contributo, però, si cercherà di mettere in luce la rilevanza politica dell’opera. Come sostenuto da Giuseppe Ricuperati, infatti, il dialogo, assieme ai trattati Della tirannide e Del Principe e delle Lettere e al Panegirico di Plinio a Trajano, è debitore nei confronti della tradizione illuministica europea, e vicino ad autori come Montesquieu, Voltaire, Rousseau, Helvétius, Boulanger, Mirabeau, Diderot. Lo studio cercherà quindi di mettere in rilievo il tasso di politicità dell’opera vagliando diversi fronti: dalla scelta dell’interlocutore, un senese repubblicano, ai punti di contatto del dialogo con le opere politiche dell’astigiano. Saranno quindi scandagliati gli aspetti ecdotici e archivistici: l’opera viene infatti data alle stampe presso la tipografia di Kehl, dove Alfieri fa stampare altre sue opere di carattere più marcatamente politico, al fine di sottrarsi alle limitazioni della censura francese. La prima redazione della Virtù Sconosciuta, infine, compare nello stesso manoscritto che ospita le opere politiche già menzionate.La virtù sconosciuta Alfieriego jest jednym z najbardziej osobistych tekstów tego autora. Dzieło będące dialogiem z jego zmarłym przyjacielem Francesco Gori Gandellinim, przywołuje ważny fragment życia i twórczości autora z 1786 roku. W tekście można prześledzić wiele opowieści z zakresu historii literatury, przeszłości i przyszłości Alfiera, a przede wszystkim pewne fragmenty autobiografii, którą autor wkrótce potem upublicznił. W artykule postarano się jednak podkreślić polityczne znaczenie tego dzieła. Jak twierdzi Giuseppe Ricuperati, w istocie dialog ten, wraz z innymi traktatami, nawiązuje do europejskiej tradycji oświeceniowej i jest bliski autorom takim jak Montesquieu, Voltaire, Rousseau, Helvétius, Boulanger, Mirabeau, Diderot. W opracowaniu podjęta zostaje zatem próba uwypuklenia poziomu polityczności dzieła poprzez zbadanie różnych jej aspektów: od wyboru rozmówcy, republikanina ze Sieny, po punkty styczne tego dialogu z innymi dziełami politycznymi obszaru Asti. Następnie poddane badaniu są aspekty historyczne i archiwalne: dzieło zostało faktycznie opracowywane w drukarni Kehla, gdzie Alfieri publikował inne swoje teksty o wyraźnie politycznym charakterze, aby uciec przed ograniczeniami francuskiej cenzury. No full textIn the article, the author compares Hans Bellmer’s concept of the physical unconscious with Sigmund Freud’s concept of the unconscious, pointing out the similarities and differences between the two. The starting point is the former’s theoretical treatise titled Little Anatomy of the Physical Unconscious, or Anatomy of the Image (translated by J.M. Kłoczowski), in which he presented the assumptions of his approach. The author points out that we are dealing here with an interesting modification and a supplement to the theory presented in The Interpretation of Dreams. It is also noted that in both cases the source of inspiration was the phenomenon of female hysteria, albeit interpreted in different ways. In Bellmer’s case, this phenomenon is key to understanding the actual significance of the way in which he creates the female bodies of his dolls, ignoring all principles of anatomical structure.In questo articolo, l’autore confronta il concetto di “inconscio fisico” di Hans Bellmer con quello di Sigmund Freud, evidenziandone somiglianze e differenze. Il punto di partenza è il trattato teorico di Bellmer, Piccola anatomia dell’inconscio fisico, ovvero l’anatomia dell’immagine (trad. in polacco di J.M. Kłoczowski), in cui presenta i presupposti del suo approccio. Lo scrittore dell’articolo sottolinea che si tratta di un’interessante modifica e integrazione della teoria dell’autore de L’interpretazione dei sogni. Osserva inoltre come, in entrambi i casi, la fonte di ispirazione sia stata il fenomeno della storia delle donne, sebbene interpretato in modo diverso. Nel caso di Bellmer, questo fenomenoè la chiave per comprendere il vero significato del modo in cui crea i corpi femminili delle sue bambole, ignorando tutte le regole della struttura anatomica.W artykule autor porównuje koncepcję fizycznego nieświadomego Hansa Bellmera z pojęciem nieświadomości Sigmunda Freuda, wskazując na podobieństwa i różnice między nimi. Punktem wyjścia jest traktat teoretyczny pierwszego z nich pt. Mała anatomia nieświadomości fizycznej albo anatomia obrazu (w tłumaczeniu J.M. Kłoczowskiego), w którym przedstawił on założenia swojego podejścia. Autor wskazuje, że mamy tu do czynienia z interesującą modyfikacją i uzupełnieniem teorii przedstawionej w Objaśnienia marzeń sennych. Zauważa również, że w obu przypadkach źródłem inspiracji był fenomen kobiecej historii interpretowany jednak w odmienny sposób. W przypadku Bellmera fenomen ten stanowi klucz do zrozumienia faktycznej wymowy sposobu w jaki kreuje kobiece ciała swoich lalek ignorując wszelkie zasady anatomicznej budowy.

No full textThe article has been raised on the issue of special recidivism included in art. 38 § 1 and 2 of the Petty Offenses Code (P.O.C.). The narrative goes through the issues: the evolution of the art. 38 p.o.c., the question of punishment and the possibility of applying extraordinary aggravation of the penalty. The substantive analysis is carried out in the context of the views expressed in the doctrine and jurisprudence. Extraordinary aggravation of the penalty included in this regulation enables a more complementary reflection in the convicting judgment the perpetrator’s guilt. Potencjał komunikacyjny polszczyzny – code mixing w perspektywie postaw odbiorców. Badania wstępne na nienormatywnym materiale językowym
Get PDFThe article presents a procedure for conducting an innovative analysis of utterance functioning featuring code mixing, from the perspective of assessing the impact of deviations from linguistic norms on the attitudes of recipients of communication involving closely related languages. It thus falls within the scope of contact linguistics, primarily its experimental branch. Particular focus is placed on the communicative potential of Polish and the phenomenon of West Slavic intercomprehension, illustrated by a linguistic stimulus (which also serves as the basis for the discussed communication experiment). The ultimate goal of the presented research is to verify the attitudes of recipients and to examine the degree of potential correlation between the assessment of communication difficulties and the actual decoding capabilities regarding the informational value of communication with ambiguous linguistic affiliations within closely related West Slavic ethnolects, from a symmetrical perspective, i.e., from the perspective of recipients who are native users of both languages in the pair. Statistical tools were employed during the research, enabling precise illustration of the observed processes. The analysis confirmed a clear tendency among representatives of the research group to focus attention on native (“familiar”) features of the linguistic stimulus. However, no correlation was found between the subjective perception of cognitive difficulty and the objective ability to access key informational content.Artykuł przedstawia procedurę przeprowadzania nowatorskiej analizy funkcjonowania wypowiedzi z cechami code mixingu w perspektywie oceny wpływu zakłóceń normy językowej na postawy odbiorców komunikatu obejmującego kontakt blisko spokrewnionych języków. Analiza wpisuje się tym samym w zakres lingwistyki kontaktowej – przede wszystkim jej eksperymentalnego wariantu. Przedmiotem szczególnego zainteresowania uczyniono zarówno potencjał komunikacyjny polszczyzny, jak i sam fenomen zachodniosłowiańskiej interkomprehensji, który zilustrowano bodźcem językowym (stanowiącym jednocześnie podstawę omawianego eksperymentu komunikacyjnego). Celem finalnym prezentowanych badań jest zweryfikowanie postaw odbiorców oraz stopnia ewentualnej korelacji pomiędzy oceną trudności komunikacyjnych a realnymi możliwościami dekodowania wartości informacyjnej komunikatu o niejednoznacznej przynależności językowej w obrębie najbliżej spokrewnionych etnolektów zachodniosłowiańskich w ujęciu symetrycznym, tj. z perspektywy odbiorców będących rodzimymi użytkownikami obu języków w parze. W trakcie badań wykorzystano narzędzia statystyczne, dzięki którym możliwe stało się precyzyjne zilustrowanie obserwowanych procesów. W toku analizy potwierdzono wyraźną tendencję przedstawicieli grupy badawczej do koncentrowania uwagi na rodzimych („swojskich”) cechach bodźca językowego. Nie wykazano przy tym korelacji między subiektywnym poczuciem trudności poznawczej a obiektywną możliwością uzyskania dostępu do kluczowych wartości informacyjnych
Aspekty separacyjne w procesie osiągania dojrzałości traktowanej jako wartość i zadanie
Get PDFThe article addresses the important issue of young people separating in early adulthood from the values, norms and behavioral styles of the older generation. Separation processes can be treated as young people’s rebellion or contestation against socially accepted rules of conduct, as well as the Christian system of values. At the background of the young people’s separation are processes related to achieving maturity and independence. This maturity is currently perceived differently, and thus the ability to create lasting and stable bonds, such as marriage and family ties, is often an impossible task. The consequences of lack of personal maturity are assumed to be the breakdown of close relationships and a growing sense of loneliness among young people. As a result, we observe an increasing number of relationships such as cohabitation, but also decisions to live alone (being single). In the longer term, such choices can have serious implications for the dynamics of social life.
Artykuł porusza istotne zagadnienie separowania się młodzieży w okresie wczesnej dorosłości od wartości i norm oraz stylów zachowania starszego pokolenia. Procesy separacyjne mogą być traktowane jako bunt czy kontestacja młodzieży wobec społecznie akceptowanych zasad postępowania, a także chrześcijańskiego systemu wartości. Separowanie się młodych przebiega na tle procesów związanych z osiąganiem dojrzałości i niezależności. Dojrzałość ta jest obecnie inaczej postrzegana, a tym samym zdolność do tworzenia trwałych i stabilnych więzi, jakimi są więzi małżeńskie i rodzinne, staje często zadaniem nie do wykonania. Jako konsekwencje braku dojrzałości osobowej przyjęto rozpad bliskich relacji oraz rosnące poczucie osamotnienia wśród osób młodych. W efekcie obserwujemy rosnącą liczbę związków takich jak konkubinaty, ale także decyzje, aby żyć w pojedynkę (bycie singlem). W dalszej perspektywie czasowej wybory takie mogą mieć poważne implikacje dla dynamiki życia społecznego

Instead of following the typical futurological question of what will the future look like, the author asks: What is worth preserving? She presents selected examples of such places in Poland, analysing their current condition, forms of protection, threats and possibilities for further existence. The article emphasises the importance of both legal and landscape conditions for the survival of these structures. The text shows how megaliths can become not only a testimony to the past but also an important element of the landscape of the future, provided that they are cared for responsibly and that a modern approach to their preservation and accessibility is adopted.Artykuł stanowi refleksję nad przyszłością dziedzictwa kulturowego w kontekście zachowanych budowli megalitycznych – jednych z najstarszych przejawów ludzkiej działalności architektonicznej.
