The legal regulation of academic freedom ::the case of biomedicine /
No full text"This book compares and examines the ways in which law addresses and resolves conflicts between academic freedom and responsibility. Academic freedom is an important value in the modern scientific and technologically driven world. Societies depend heavily on the commodities of scientific progress, especially in essential sectors such as health care and, as a result, research is now carried out in an increasingly globalized context protected by national and international law. This freedom can, however, be problematic if it is decoupled from a commitment to academic responsibility, scientific rigor, and good professional conduct. Focusing on the example of biomedical research, this book examines how various legal systems address the interplay between academic rights and duties. More specifically, it considers the tension between national constitutions and legal doctrine, which tend to focus on concepts such as science-inherent laws or professional standards, and international law, which establishes a right for everyone to enjoy the benefits of scientific progress, thereby implying a duty on the part of the academic community to conduct science in a way that maximizes its benefits to society at large. The book concludes by proposing policy reforms that aim to balance these demands, and thus reduce tensions within the academic system. Making vital connections between U.S. colonialism, structured and deputized violence, history of policing, and armed resistance by grassroots movements, the authors expand readers' understanding of the purpose of U.S. policing.Responding to data that showed that in 2016 and 2017, more than 135 children and teens lost their lives to police violence, the author team traveled to multiple locations across the United States to sit with, learn from, and capture survivors' stories and experiences. No full textThe End of Roe assesses abortion and the American legal and political system in the aftermath of the United States Supreme Court's June 2022 decision in Dobbs v. Jackson Women's Health Organization.In Dobbs, the US Supreme Court held that a woman did not have a constitutional right to terminate her pregnancy. This decision further polarized an already divided nation by overturning nearly fifty years of precedent under Roe v. Wade, following on from two highly contentious presidential elections. Now, as Christian conservative legal organizations seek to tighten access to abortion through attempts to limit chemical abortion, the most widely used method to terminate pregnancies in the United States, as well as cut off other avenues to the procedure, access to abortion seems uncertain and increasingly complicated across the United States. This book discusses how widely differing abortion laws have evolved across the United States, as well as how religious groups and conservatives have turned to the legal process in their fight to restrict abortion further and how more progressive states have countered with the passage and implementation of safe harbor laws shielding physicians who perform abortions and the women who wish to procure them, mainly when their home state is hostile to their medical situation or choice. No full textFor many, human rights have become a panacea for the injustices of society: globalisation, poverty, discrimination, climate change etc. But has this rights 'inflation' been a prima facie good? Has the rise in human rights merely propounded a self-centred individualism, exacerbating the marginalisation of large swathes of society who are already socially excluded? Rightly, human rights have been the subject of a multitude of criticisms, from a range of critical perspectives: Marxism, critical legal studies, communitarianism, feminism, critical race theory, etc. However, this unique study pushes back against this tide of 'anti-rights,' providing an original defence of human rights from the perspective of a progressive political community of rights-holders and duty-bearers. Possessing rights might place a rights-holder at the centre of their moral universe, to the exclusion of all others, but that holder of rights cannot expect others to bear the duty of their rights without exercising the same obligation to the rights of others in return. So, far from emphasising isolation and self-interest, responsibilities arising from the exercise of rights engender a keen sense of solidarity, a principle integral to critical legal theory.
