Small state constitutionalism /
No full textThis volume addresses the important, but under-noticed, question of the impact of state size and scale for constitutional law and governance, and brings together leading global scholars to focus on the lessons from a range of small states and jurisdictions in this context. Often, the best way to understand the effect of scale is to examine states where scale is demonstrably lacking. Doing so allows a form of "reflective" comparison that provides greater insight and clarity into the significance of state size, and constitutional scale, as a factor affecting a range of democratic constitutional outcomes. The volume also explicitly invites critical reflection on, and problematisation of, the issues of line-drawing and boundary definition around notions of state and jurisdictional size. The collection features contributions by scholars from a wide range of jurisdictions, living and working across the Global South and North, and includes attention to the constitutional experiences of small states and jurisdictions in Europe, Africa, Asia, South America, the Caribbean and Oceania that have not received much coverage in the literature. As such, it makes a meaningful contribution to regionally-focused constitutional debates. This is especially significant in the Caribbean and Oceania, where a large percentage of states are small states, and there is only a limited body of constitutional scholarship focusing on the constitutional experiences of such jurisdictions. More generally, this volume will be of interest to audiences working in and interested in small states generally, as well as a broader comparative audience interested in issues of scale in constitutional design and implementation

No full textL'ancienneté des deux colloques de Fanjeaux consacrés à l'histoire du clergé canonial dans les diocèses du Midi - le 24e sur « le monde des chanoines », le 30e sur « la cathédrale » - et la dynamique de la recherche récente sur les chapitres de cathédrales et de collégiales justifiaient qu'une nouvelle session s'intéresse aux chanoines méridionaux dans toutes leurs composantes, autour des interrogations qui se posent à leur sujet. Quel chemin particulier les chapitres ont-ils suivi depuis les fondements carolingiens jusqu'au renouveau du modèle canonial à la fin du Moyen Âge ? Quelles évolutions, concordantes ou divergentes, quant à leur mode de vie les chapitres cathédraux et canoniaux ont-ils connues ? Les choix retenus se reflètent-ils dans l'architecture adoptée pour leurs bâtiments ? À l'heure des transformations religieuses et politiques majeures liées à la crise albigeoise, comment ces chapitres se sont-ils positionnés par rapport à leurs évêques et aux habitants des cités ? Comme institutions religieuses dominantes, mais concurrencées par l'émergence d'autres formes de vie religieuse, notamment mendiante, les chapitres ont-ils été en butte à des oppositions dans le courant du xiiie siècle ? La question court du reste au-delà de ce siècle puisque plusieurs collégiales endossent dans le Midi le rôle d'églises civiques et que certains chapitres sont encore fondés à la demande des habitants. L'avènement de la papauté d'Avignon invite enfin à s'interroger sur les rapports privilégiés du clergé canonial des Églises du Midi avec l'administration pontificale qui juge possible de remanier, quelquefois profondément, le paysage religieux en érigeant des collégiales en cathédrales, ou en utilisant les premières comme contrepoids des secondes. La composante canoniale du clergé semble donc avoir encore, à la fin du Moyen Âge, un rôle à jouer, dans un rapport propre à la régularité

Final injunctions in tort law /
No full textThis book is the first considered study of final injunctions in tort law. It devises a novel taxonomy of such injunctions and explores the implications of the law on injunctions for the way in which scholars think about tort law more generally. The book begins by analysing how the injunction in aid of legal rights came to be developed as a remedy in the Court of Chancery. It then provides definitive guidance as to the range of final injunctions that may be available to restrain or remedy torts. A clear, structured framework to guide legal reasoning in injunction cases is constructed. The book concludes by making several claims about tort law in the light of the availability of injunctive relief. In addition to the taxonomy that is developed, the overarching message of the book is that injunctive relief is a central component of the law of tort. The way in which tort law is expounded in textbooks and monographs, and taught in universities, needs revising. Specifically, we must not overemphasise the award of damages and neglect to highlight the importance of the injunction. The true position is that injunctive relief is as crucial as damages are to enforcing the rights that are generated by tort law

By reviewing the labor classification rule in China, the book builds its discussion on the traditional "employee versus self-employed" dichotomy and subordination.
