NOVELS OF LEGISLATION ON CIVIL-LEGAL LIABILITY
The research objective is to analyze the changes in the Russian civil legislation regulating civil-legal liabilities. The research methods include comparative method, analysis and synthesis, induction and deduction, and formal-logic method. The authors make a deep analysis of the norms regulating the forms of civil-legal liability under fundamental reforming of the Russian civil legislation since adoption of the Conception of the Civil Legislation Development in 2009 till present. The novels related to the forms and grounds for civil-legal liability are paid special attention to. The previous and current legislation norms are compared, related to loss recovery, payment of penalty, interests for the use of monetary asserts and compensation for the moral damage. The study of the reforms’ preliminary results enables to assess the efficiency of the Russian civil legislation. In particular, such complicated issues have been solved as the possibility to reduce the penalty if it is disproportionate to the consequences of a breach of law and the possibility to compensate the moral damage to juridical persons. The legal analysis of the novels of civil-legal liability forms enabled the authors to show the logic of legislation and the prospects of practical development of these norms
Felicitary meta-plot in the XIX century Russian literature
The article deals with felicitary issues of the XIX century Russian literature reflected in the works of A.S. Pushkin, I.A. Goncharov, N.A. Nekrasov, A.P. Chekhov; it contextually touches the ways of embodying the theme of happiness in the works of a wider range of authors (L.N. Tolstoy, N.G. Chernyshevsky etc.). The system study of a felicitary paradigm of the Russian literature has long remained outside the view of researchers, which defines the relevance of this work. The goals and tasks of the study imply describing and analyzing figurativesemantic invariants, which are the most essential for a felicitary paradigm denoted in the artistic worlds of the above-mentioned writers. The study has enabled the authors to identify some key invariant oppositions and identities: rationality – irrationality of happiness; attainability – unattainability of happiness; happiness – rest; happiness – righteousness; happiness – conciliarism. The study leads to a conclusion that dialogic interreflections of these invariants defining various ways of interpreting a felicitary theme in the works of the XIX century Russian writers enable to consider the logic of its development as one of the meta-plots of the literature of that period. General logic of development of the very felicitary meta-plot in the contexts of the XIX century Russian literature defines its main vector as a movement between the poles of moral-psychological and existential-metaphysical explications
Australia in the second half of the ХХ century: in search of national and political identity
The processes of national and political identity are of extreme importance in the modern world. Their underestimation leads to numerous conflicts and to a loss of civilized guidelines (Libya, Syria, Ukraine, the migration crisis in Europe). Study of the experience of the Commonwealth of Australia in pursuing the multiculturalism policy in the 1980s – 1990s is of interest to the wide range of researchers and readers. Australia was one of the first countries trying to determine its place during the world globalization processes. The paper “Australia in the second half of the XX century: in search of national and political identity” is aimed at comprehensive study of the Australian authorities’ activities in the tough transition period from the “white Australia” policy to the “multiculturalism” policy in the context of determining the national and political identity. This research results are instructive for the Australians themselves as well as for many other countries that are determining the national identity and searching for the political guidelines. The paper used the traditional methods of the historical science: comparative-historical, problematic-chronological methods and a system analysis. They made it possible to find out the peculiarities of Australia’s internal policy during the globalization, to determine the common goals, methods and modes of this policy. The research found out that Australia has never been an “Asian country” and will not be such a country, its cultural and political ideals are connected with the Western civilization, its Anglo-Saxon guidelines in determining the national identity and the preservation of the AmericanBritish area in the political identification
STRATEGIC DEVELOPMENT MANAGEMENT OF AN AGRICULTURE-ORIENTED REGION BY THE CLUSTER APPROACH: CASE OF REGIONS IN THE SOUTH OF RUSSIA
: The relevance of this study comes from the fact that the spatial organization of economy in Russia’s regions is going through the definite crisis in the established patterns of territorial localization and operation of the leading branches of economy and their anchor loci. The absence of any efficient response to this crisis results in increased disruption, excessive polarization, and socioeconomic asymmetry of economic space. Regions with agriculture-oriented economy are more sensitive to the uneven development of economic space because they are more dependent on natural and geographical determinants, whereas the focused development of particular zones leads to synchronously formed depressive localities with low basic socioeconomic parameters, despite available resource potential. From this perspective, this article aims to form new approaches to organizing economic space of agriculture-oriented regions, which must be dovetailed with revealing all propulsive economy sectors, zonal and polar forms of economic growth, followed by introduction of various kinds of cluster innovations based on encouraging respective initiatives. The potential of cluster forms of economic space organization is the one that can be spread to vast neighboring territories to form network structures characterized by active socioeconomic development. The modern theoretical methodological basis for managing agriculture-oriented regions by the cluster approach is characterized by deficiency and non-contiguous elaboration of questions related to identifying clusters and their formative prerequisites, making use of particularities and effects of various phases of their lifecycle to improve parameters of socioeconomic territorial development. In addition, there are no advanced developments in polybranch clusterization of economy with the formation of clusterized network economic space. The methodological tools for monitoring and diagnosing cluster formation processes are insufficient. The most efficient method of solving the above specified problem is to form a specialized methodological approach to revealing cluster formation prospects in propulsive sectors of economy. The approach must rely on forming an author system of indices and the expert survey technique. The initiating factor of this study was the theoretical, methodological, and practical pendency of these and many other questions related to the diffusion of cluster innovations in agriculture-oriented regions. The article discloses the essence of the methodological approach to revealing cluster formation prospects in propulsive economic sectors of an agriculture-oriented region. The described method involves calculating nine indices that provide the complete characteristic of the cluster formation capacity on the basis of a particular branch; in the end, this helps formulate the immanent characteristics of the economic sectors of the Stavropol’ kray in the context of cluster formation prospects
INVESTIGATING THE EDUCATIONAL POEM-EPOPEI GENRE DEVELOPMENT IN THE NORTH CAUCASIAN LITERATURE
At the turn of the XIXth and XXth centuries the form and content of the majority of North Caucasian literatures are developed, which rely mainly on the folklore and religious consciousness of the people, the traditions of the East and Russian Soviet classics, which determined the line of creative individuality evolution and the genre development of literature from the folklore-epic poem to the lyroepic one (with historic and ontological issues). The creativity by Ali Shogentsukov largely outstripped the understanding of national history and culture development by contemporaries. The origins of the driving force of his poetry are the social activity of the people necessary in a certain political situation after the nationwide catastrophe as the result of the Russo-Caucasian war. The ethnocentric tendencies of recent decades make realize indirectly the need for a weighty word of literary classics. And in this sense, the creative works by Ali Shogentsukov are not only the history of national literature development, but also a lively participation in the contemporary literary process and in the development of the genre system. That is why the purpose of this work is reasoning (comprehension and rethinking) about the nature and the specificity of the epic poem genre, with the example of the reference work by Ali Shogentsukov "Kambot and Lyatsa"
Advanced Areas of Intellectual Information Capital Development in Educational Organization
The study sets forth informational intellectual capital as a part of the information-based education system in an educational organization that reflects transformation from mechanical to computerized labor. Russian Technological University (RTU) MIREA – Stavropol Branch exploits the following key components of intellectual information capital: electronic document management, electronic classes’ schedule, internal electronic library system. All of that make possible the integration of human and information factors at a new advanced level. Intellectual information capital operates on the following principles: information inclusion in the database, set up of centralized pattern for all formal documents, minimizing documents workflow by means of fixed database decision-making, errors and correction time decrease. Intellectual information capital in an educational organization performs the function of information security for intellectual activities, reflecting the quality of information educational systems. Based on general scientific and special methods, such as: inductive, deductive, analysis, synthesis, observation, system thinking, abstract and logical, monographic, comparative and extrapolation intellectual information capital of an educational organization is formed and developed
Investigating the insight and method of historiography of Sadid al-Saltaneh Kababi Bandar Abbasi (1870-1941)
: The purpose of the present research is to identify the potential and develop proposals for the popularization of photo tourism in Russian national parks. The relevance of the research topic is explained by the fact that the flow of tourists who want to get familiar with various attractions and discover new horizons is growing from year to year. For photo tourism, the main objects of interest for taking a picture are natural, historical, cultural, and socio-economic tourist and recreational resources. Therefore, places with high concentration of such objects and especially areas where they are collocated together, are of particular importance. Specially protected natural areas are one of these types of places. The contemporary consumer of a tourist product becomes more aware of aesthetic and cognitive needs, demands new nonstandard offers from the tourism industry, and seeks new impressions. And everyone, who has visited such places, wants to share this experience with others. Based on this emerging need, tourism has developed a direction such as photo tourism which is a combination of two scopes of activity, namely, tourism and photography that opens up huge opportunities for amateur travelers. The present research is aimed at ordering data on the study of photo tourism in the Russian Federation and making proposals for the development of tourist products. National parks were chosen as the object of the photo tour organization due to special characteristics (the integrity of recreational resources, uniqueness of resources, availability of infrastructure, and high aesthetic component). Creating a photo tour, as well as any other tour, undergoes certain stages. However, when developing a photo tour, in addition to standard indicators, such as the age of consumers, the purpose of travel, and others, it is also necessary to take into account the level of training of participants, their goals, subject matters, technical component, etc. Currently, photo tourism is developing rapidly, offering consumers many different options for photo tours. However, in Russia, photo tourism is still not represented enough and mainly developing as a kind of amateur tourism. In this regard, a problem arises to study photo tourism and to identify its evolution factors
EMOTIONAL INTELLIGENCE AND STYLES OF AFFRONT TO STRESS IN UNIVERSITY STUDENTS OF EDUCATION
The investigation aimed to determine the relationship between emotional intelligence and coping styles in a sample of 198 students. The research was embodied under the quantitative approach of the basic type. The non-experimental cross-sectional design was selected. In the first place, the instruments were validated; secondly, the reliability of the instruments; thirdly, the survey was applied to the analysis units in 30- minute sessions in person; fourth, the data was tabulated and descriptive and inferetial statistics were carried out. It was concluded that there is a positive, significant and very high relationship between both variables given that the degree of relationship of the variable emotional intelligence and coping styles to stress was rs = 0.912, in addition, it was found that its significance was less than 5% (p = 0.00)
THOUGHT AS THE FOUNDATION OF PEDAGOGICAL PRACTICE IN UNIVERSITY TEACHERS
The purpose of the research is to analyze the incidence of types of thinking in pedagogical praxis in teachers. The study was conducted using qualitative research, based on multicast studies. The participants are made up of science teachers and the techniques used were observation and interview. As an instrument to collect information, the questionnaire with open questions and field notebook. After collecting information by observing and interviewing teachers and experts, the results show difficulties in fostering and developing critical, analytical, reflective thinking and even more creative thinking, according to the characteristics proposed by theorists for each skill, which is evident. In its different categories established for this study, in this sense it is recommended that teachers update themselves to improve their pedagogical practices
Territorial Identity of the Population as an aspect of Public Administration of Tourism Territories Development
The article is devoted to the development of the methodology for studying the territorial identity of the population of regions and post-Soviet countries as an object of public administration in the sphere of tourism. The population and its features are an important resource, particularly for tourism. However, one can observe that even the most successful destinations experience difficulties in developing tourism due to emerging hotbeds of tension and armed clashes related to conflicts between certain population groups. The analysis of territorial identity allows one to reveal the existence and strength of mental links of a person with the territory of their living, priorities in choosing the place of study, work, living, recreation, etc., i.e. answers the question of the attractiveness of a region for its inhabitants, as well as the causes and factors of migration processes (labour, educational, recreational). It allows one to determine the trends of centripetal forces in society (formation of the so-called "centrisms"), to analyze the relationship between territorial identity and the statehood, and to identify mental images of different territories. It has great importance for sociological research, branding, and marketing of territories, for the improvement of the image of individual districts, etc. The article proposes a complex methodology for studying the territorial identity of the population for the sphere of public administration of regional tourism development, which can be verified in the conditions of different territories and regions. The author considers its provisions and mechanisms, in particular, the analysis of the experience of territorial identity research, including for frontier and border regions, concepts and approaches to comprehension and research of territorial identity components, subjective atlases as a form of information presentation and the study of the features of compilation and analysis of mental maps
