Haksız rekabet ve rekabet hukuku arasındaki ilişki ve sorumluluk sebeplerinin yarışması
No full textSağlıklı bir rekabet ortamı, Türkiye’nin de dâhil olduğu piyasa ekonomilerinin temel taşıdır. Piyasa ekonomisi, ekonominin merkezi bir karar biriminin talimatları olmaksızın piyasa dinamiklerine dayalı olarak şekillendiği düzeni ifade eder: Ekonomik birimlerin koordinasyonu, arz ve talep miktarının belirlenmesi, mal ve hizmetlerin fiyatlarının oluşumu, esas olarak piyasa tarafından gerçekleştirilir .Piyasa ekonomisinin gerektirdiği rekabet koşulları, her zaman piyasa dinamikleri neticesinde kendiliğinden oluşmayabilir. Bu durumda etkin bir rekabet ortamının sağlanması amacıyla piyasaya müdahalede bulunulması meşru ve tercih edilir hâle gelir . Rekabet hukukunun temelinde de bu gerekçe yatmaktadır. Geniş anlamda rekabet hukuku, bu amaçla yapılan tüm düzenlemeleri kapsamına alır . Bunların başında, çalışmamızın konusunu teşkil eden 4054 sayılı Rekabetin Korunması Hakkında Kanun (RKHK) ve 6102 sayılı Türk Ticaret Kanunu (TTK) m. 54 ve devamında yer alan haksız rekabet düzenlemeleri gelmektedir . Rekabet hukuku ve haksız rekabet iki farklı müessese olarak farklı kanunlarda düzenlenmektedir; ancak ne TTK ne de RKHK, birbirleri arasındaki ilişkiye dair bir hüküm içerir. Bu çalışmanın amacı, öncelikle her birinin amaç ve uygulama alanları ekseninde bu iki alan arasındaki ilişkiyi ortaya koymak; ikinci olarak da bundan hareketle haksız rekabet ve rekabet hukuku düzenlemelerinin aynı anda ihlali hâlinde sorumluluk sebebinin yarışmasını ve bunun yaptırımlara etkisini incelemektir

Near-Fault Earthquake Ground Motion and Seismic Isolation Design
No full textSeismic isolation is one of the most reliable passive structural control techniques with adequately established standards for the earthquake protection of structures from earthquakes. However, it has been shown that the seismic isolation systems may not function the best for the near-fault ground motions, since in the proximity of a capable fault, the ground motions are significantly affected by the rupture mechanism and may generate high demands on the isolation system and the structure. In fact, several earthquake resistant design codes state that the seismically isolated structures located at near-fault sites should be designed by considering larger seismic demands than the demand on structures at far-field sites. When the fault ruptures in forward direction to the site most of the seismic energy arrives in coherent long-period ground velocity pulses. The ground-motion prediction equations (GMPEs) typically cannot account for such effects with limited distance metrics and lack adequate data at large magnitudes and near distances. For the reliable earthquake design of the isolated structure in near fault conditions that meets the performance objectives, the 3D design basis ground motion(s) need to be appropriately assessed. Measures in the design of the isolation system, such as modifications in the stiffness and damping characteristics, as well as in the limitation of vertical effects are needed. The behavior of the base-isolated buildings under near-fault (NF) ground motions with fling-step and forward-directivity characteristics are investigated with a rational assessment of design-basis near-fault ground motion, are investigated in a parametric format. The parametric study includes several variables, including the structural system flexibility; number of stories; isolation system characteristic (yield) strength, and the isolation periods related to the post-elastic stiffness. Furthermore, the effect of additional damping by viscous dampers were tested for some selected cases. Important findings observed from the parametric performance results and the overall conclusions of the study are provided.Politecnico Torin
Joint Multi-Nanopore Sequencing for Reliable Data Retrieval in Nucleic Acid Storage

The nucleic acid strand (110) including the oligonucleotides is threaded through each of the plurality of nanopores (104) within the membrane (102). A separate base signal (118) is generated from the nucleic acid strand (110) being threaded through each of the plurality of nanopores (104), and Recursive Neural Networks can be used to estimate a signal shape for each oligonucleotide. Recurrent Convolutional Neural Networks and noise predictive data detection algorithms can be used based on the estimated signal shapes to sequence the oligonucleotides
Noise Effect on Forecasting
No full textThe lack of regulation and liquidity in crypto money markets causes higher volatility compared to other financial markets. This situation increases the noise in price change. The high noise and random walk create a problem that cannot be explained by traditional stochastic financial methods. For this reason, a multi-layered deep learning model with an additive attention layer, which uses a single observation in 10-day sequences, was used in this study. Different transformations are used to reduce the noise of the closing values. As a result of the comparisons made between different approaches, it has been revealed that exponential moving averages, to be used as the value to predict, give better results than other conversions and estimation of the original price, since they explain the price better than simple moving averages and reduce the noise of the original price.IEEE,TUBITAK BILGEM,Turkcel

No full textWith the Criminal Procedure Law No. 5271, an exception has been made to the principle of compulsory public prosecution, which the public prosecutor has, and disc-retionary power has been granted in filing a public lawsuit. Along with the 1st parag-raph of Article 171 of our Criminal Procedure Law No. 5271, which requires the app-lication of effective regret provisions that eliminate the personal impunity or punish-ment. While the public prosecutor is provided with the discretionary power to open a public case in such cases, the institution of postponing the opening of a public case is regulated in the 2nd paragraph of Article 171 of the Criminal Procedure Law. The rele-vant regulation introduced to the Public Prosecutor grants the Public Prosecutor the authority not to file a public lawsuit, even if there is sufficient suspicion in the investi-gation phase, one of the phases of the criminal trial, during the evaluation of evidence and drawing conclusions. In the first part of our thesis, the concept of public litigation and the principles that govern public litigation, especially the principle of obligation and the principle of expediency, or discretion, which is the subject of our thesis, is examined. In the second part, the concept, organization, legal nature and duties of the public prosecutor are examined, and in the last part, we examine the provisions of personal impunity and effective repentance that eliminate the punishment in the Turkish Penal Code, which are the subject of our article, and the provisions of effective regret that eliminate the perso-nal impunity and punishment in the Turkish Penal Code. The crimes to which it can be applied have been examined in detail. The judicial decisions related to our subject and the problems in practice have been examined and opinions about these decisions have been included. Finally, the legal nature, conditions and consequences of the decision to postpone the opening of a public case, which is one of the alternative institutions to a public case and can be given by the public prosecutor, and the decision. The way to go against the decision and the control of the decision were examined.5271 Sayılı Ceza Yargılama Yasası ile Cumhuriyet savcısının yerine getirmekle mükellef olduğu kamu davasının mecburiliği ilkesine bir istisna getirilerek kamu davası açmada takdir yetkisi tanınmıştır. 5271 Sayılı Ceza Yargılama Yasası'nın 171. Madde-sinin 1.fıkrası ile birlikte şahsi cezasızlık sebebi veya cezayı ortadan kaldıran etkin piş-manlık hükümlerinin uygulanmasını gerektiren durumlarda Cumhuriyet savcısına kamu davasını açmada takdir yetkisi sağlanırken, Ceza Yargılama Yasası'nın 171.Maddesinin 2. fıkrasında ise yasada yer alan objektif ve sübjektif şartlar olarak adlandırılan şartların gerçekleşmesi ile birlikte kamu davasının açılmasının ertelenmesi-ne kararı verilmesine olanak sağlayan kurum düzenlenmiştir. Cumhuriyet savcısına getirilen ilgili düzenlemeyle, ceza yargılamasının evrelerinden biri olan soruşturma ev-resinde, delillerin değerlendirilmesi ve sonuç çıkartılması aşamasında yeterli şüphe ol-masına karşın Cumhuriyet savcısına kamu davası açmama yetkisi tanımaktadır. Böyle-likle Cumhuriyet savcısı, yeterli şüphe olması halinde iddianame düzenleyerek kamu davası açmak mecburiyetindeyken ilgili düzenleme söz konusu mecburiyeti ortadan kaldırarak Cumhuriyet savcısına kamu davası açma konusunda serbestlik tanımıştır. Tezimizin ilk bölümünde öncelikli olarak kamu davası kavramı ve kamu dava-sına hâkim olan ilkeler kapsamında özellikle mecburilik ilkesi ile tezimizin konusunu oluşturan takdir yetkisini kullanmaya imkan veren maslahata uygunluk veya bir diğer adıyla takdirilik ilkesi incelenmiştir. İkinci bölümünde ise Cumhuriyet savcısı kavramı, teşkilatı, hukuki niteliği ve görevleri incelendikten sonra tezimizin üçüncü ve son bö-lümünde ise tezimizin esas konusunu oluşturan 5237 Sayılı Türk Ceza Yasası'nda yer alan şahsi cezasızlık ve cezayı ortadan kaldıran etkin pişmanlık hükümleri ile Türk Ceza Yasası'nda şahsi cezasızlık ve cezayı ortadan kaldıran etkin pişmanlık hükümlerinin uygulanabileceği suçlar detaylıca incelenmiştir. Özellikle söz konusu suçlar ile ilgili etkin pişmanlık ve şahsi cezasızlık sebeplerine ilişkin hükümlerin ortaya çıkardığı uyuşmazlıklar yargı kararları ile incelenmiş ve söz konusu kararlar hakkında tarafımızın sahip olduğu görüşlere yer verilmiştir. Son olarak ise Cumhuriyet savcısının Ceza Yargılama Yasası 171. Maddesinin 2. Fıkrasında yer alan düzenleme ile sahip olduğu ve kamu davasına seçenek kurumlardan biri olarak karşımıza çıkan Cumhuriyet savcısı tarafından verilebilen kamu davasının açılmasının ertelenmesi kararının hukuki niteliği, şartları ile sonuçları ve karara karşı gidilebilecek yol ile kararın denetimi incelenmiştir
Turkish Data-To Generation Using Sequence-To Neural Networks
No full textTUBITAK-ARDEB [117E977]This work is supported by TUBITAK-ARDEB under the grant number 117E977.End-to-end data-driven approaches lead to rapid development of language generation and dialogue systems. Despite the need for large amounts of well-organized data, these approaches jointly learn multiple components of the traditional generation pipeline without requiring costly human intervention. End-to-end approaches also enable the use of loosely aligned parallel datasets in system development by relaxing the degree of semantic correspondences between training data representations and text spans. However, their potential in Turkish language generation has not yet been fully exploited. In this work, we apply sequenceto-sequence (Seq2Seq) neural models to Turkish data-to-text generation where the input data given in the form of a meaning representation is verbalized. We explore encoder-decoder architectures with attention mechanism in unidirectional, bidirectional, and stacked recurrent neural network (RNN) models. Our models generate one-sentence biographies and dining venue descriptions using a crowdsourced dataset where all field value pairs that appear in meaning representations are fully captured in reference sentences. To support this work, we also explore the performances of our models on a more challenging dataset, where the content of a meaning representation is too large to fit into a single sentence, and hence content selection and surface realization need to be learned jointly. This dataset is retrieved by coupling introductory sentences of person-related Turkish Wikipedia articles with their contained infobox tables. Our empirical experiments on both datasets demonstrate that Seq2Seq models are capable of generating coherent and fluent biographies and venue descriptions from field value pairs. We argue that the wealth of knowledge residing in our datasets and the insights obtained fromthis study hold the potential to give rise to the development of new end-to-end generation approaches for Turkish and other morphologically rich languages
What Do Pre-Service English Language Teachers Have To Say for Their Future?
No full textThe dignified socio-cultural value attached to the teaching profession is in decline not only in Turkey, but also in many other parts of the world. Previous studies (Aksu et al., 2010; Fray ; Gore, 2018; Heinz, 2015) have shown that pre-service teachers might have altruistic, intrinsic and extrinsic motivations at diverse levels when they embark on their teacher education programmes (TEP). It has also been widely studied that pre-service teachers’ initial motivations and conceptualizations of the teaching profession are subject to change over time due to the gap they observe and experience between the theory and practice, precarious employment, lack of financial resources and benefits, low salary, limited opportunities for promotion and professional development, unstable work-life balance, ideological pressures, and demanding parents and educational stakeholders. This study will present the preliminary findings of an on-going research exploring pedagogical beliefs, professional conceptualisations and motives of 20 pre service English language teachers studying their second and third years of a TEP in Istanbul, Turkey. Guided by reflective practice theory (East, 2022; Farrell, 2021), the first data set was obtained from web based logs where participants were guided with questions to reflect on to what extent the training they receive in TEP corresponds to the practice they observe in their internship schools and how this experience reformulates their pedagogical beliefs. The second data set was collected using focus-group interviews where the participants were asked to comment on their motives to choose and continue to practice the teaching profession. The results indicate that pre-service English language teachers have ambivalent beliefs and attitudes toward their future practices, mainly pertaining to the socio-political and economic turmoil in the country, accelerating inflation and challenging living conditions, prevalent notion of native-speakerism in private schools, and technological innovations gradually replacing the role of teachers
Ön Eğitimli Dil Modelleriyle Duygu Analizi
No full textDuygu analizi, çeşitli platformlarda bir konu hakkında düşünce, duygu ya da tutumu irdelemek, analiz etmek ve yorumlamak amacıyla kullanılan yöntemlerden biridir. Farklı konulardaki metinlerin öznel içeriklerine göre sınıflandırılabildiği duygu analizinde makine öğrenmesi ve derin öğrenme modellerinden sıklıkla faydalanılmaktadır.Bu çalışmada, önceden eğitilmiş dil modellerinden yararlanılarak Covid-19 tweet metinleri üzerinde duygu analizi yapılmıştır. Naive Bayes sınıflandırıcıya ek olarak BERT, RoBERTa ve BERTweet dil modelleri kullanılarak farklı sınıflandırıcılar eğitilmiş ve tweet veri kümesi üzerinde elde edilen sonuçlar kıyaslanmıştır. Bildiride aktarılan çalışmanın ileride bu alanda yürütülecek araştırmalara bir zemin oluşturacağı öngörülmektedir
