    ‘Between the Devil and Deep-Blue Sea’: Comparing the Extraterritorial Application of the ECHR and the ICCPR in the Protection of Migrants at Sea

    The concept of jurisdiction is often said to encapsulate the very essence of human rights “qua normative relationship between rights holders and institutions as dutybearers” (Besson, 2012; 860). Twenty-first century human rights jurisprudence has highlighted one of the most contentious issues in relation to jurisdiction: the limits that human rights place on State behaviour outside national territory. In the context of migration, the extraterritorial application of human rights is a particularly critical concern. Loss of life on the high seas, refoulement at sea, and the striking systematic ineptitude of search and rescue operations by European countries have placed the debate on extraterritoriality at the heart of the human rights discourse on migrants and refugees. This Paper will compare and contrast extraterritoriality at the European Court of Human Rights and the Human Rights Committee (HRCttee), in order to put their jurisprudence into perspective and assess the current state of the law. A functional account of jurisdiction will be supported, whereby the State should protect human rights wherever in the world it operates, and whenever it can reasonably do so. Through a comparative analysis, I will argue that the principles of universality and effectiveness render extraterritorial applicability a necessary doctrine in human rights law. By juxtaposing the ECtHR with the HRCttee, I will illustrate the wide acceptance of extraterritoriality in the migration context, highlight the needs for improvement in future jurisprudence, and justify the functional approach to human rights protection that this Paper advocates

    When great places to work aren\u27t for everyone: How top employer awards can backfire for narcissistic applicants

    Drawing on signaling theory, the current experimental study (N = 593) investigated the influence of top employer awards on the connections between the full spectrum of narcissistic personality features (i.e., agentic, antagonistic, neurotic, and communal) and perceived company prestige. The results of our experiment show that employer awards enhance prestige perceptions and that all narcissism facets are positively related to perceptions of prestige. However, the positive associations between narcissistic personality features and company prestige were less pronounced in the award condition than in the no-award condition. Our study contributes to the recruitment and employer branding literature by demonstrating that, while employer awards generally enhance an organization’s prestige, they may not do so for individuals with particular personality features

    President Poetin rechtvaardigt de Russische oorlog tegen Oekraïne met een beroep op de geschiedenis. Hij deed dit bijvoorbeeld in een toespraak bij de formele annexatie van de Krim in 2014. In de aanloop naar de grootschalige militaire invasie in 2022, publiceerde Poetin in de zomer van 2021 al het artikel “Aangaande de historische eenheid van Russen en Oekraïners”. Hierin zette de Russische president een zeer paranoïde geschiedbeeld over Oekraïne uiteen.     This article offers an overview of the construction of Cleopatra and Mark Antony in Octavian’s propaganda. It shows how Octavian employed Othering by using Octavia and Cleopatra as foils for West and East, respectively, and justified his military intervention against Antony by insinuating that Cleopatra’s depraved Easternness irrevocably corrupted the once proud Roman.     Wat de dichter witte moat. Filosofyske fasetten fan Obe Postma syn dichterskip

    In this article several philosophical aspects of the poetry of the Frisian poet Obe Postma 1927 are considered. Earlier critics held out that Postma’s treatment of the sublime was essentially kantian. However, a closer look proves that Postma was a romantic rather than a kantian. Postma’s treatment of the sublime is not characterized by rationality and by transcendental distance, but by feeling and transcendent proximity. Postma’s recurring theme of poetry as the mediating and connecting force of the world may also have been inspired by the romantics. And around 1922 he probably found the validity of this theme confirmed and reinforced when he read Lebensanschauung by the vitalistic philosopher Georg Simmel. In one of his notebooks he made an extract of this book in which he records the idea that people have the power to transcend their lives in their awareness of the possibilities and boundaries of their own knowledge. In the brilliant poem ‘Wat de dichter witte moat’ (‘What the poet must know’) we see the outcome of his philosophical-poetical quest, when we notice how he compares his own knowledge of the world to that of the great German poet Rilke and full of confidence states that he may have grown up ‘in the surveyable/ Community of the village’, but has known miracles that Rilke never knew.
