    La presunzione nella vigente normativa canonica: osservazioni critiche

     In CIC, besides some general norms on the presumptions and a certain number of real presumptions iuris, there are not a few norms improperly formulated as presumptions. The juridical presumptions are characterized as judgments of qualified probability on an uncertain thing relevant in the juridical world. The differences between the structural elements and the effects of the presumption iuris and the presumption hominis are analyzed. Giving that the juridical presumption possesses both a procedural dimension and a substantial dimension it is good to consider it as an institute of general theory. The relationship and the differences between the presumptions iuris and the favor iuris in the canonical law are analyzed, putting also in evidence the imperfect formulation of the c. 1060, of which a new, de lege ferenda, is proposed.Nel CIC, oltre ad alcune poche norme generali sulle presunzioni e ad un certo numero di vere presunzioni iuris, si contengono anche non poche norme impropriamente formulate come presunzioni. Le presunzioni giuridiche si caratterizzano per essere giudizi di probabilità qualificata su una cosa incerta con rilevanza nel mondo del diritto. Vengono analizzate le differenze tra gli elementi strutturali e gli effetti della presunzione iuris e della presunzione hominis. Dato che la presunzione giuridica possiede sia un dimensione processuale sia una dimensione sostanziale è bene considerarla come uno istituto di teoria generale. Si analizzano infine il rapporto e le differenze tra le presunzioni iuris e il favor iuris nel diritto canonico, mettendo anche in evidenza l’imperfetta formulazione del c. 1060, di cui se ne propone, de lege ferenda, una nuova

    The essay shows the progressive emergence of a concept of actio conceived according to the right. This procedural instrument is examined during the evolution characterized by the first codification of canon law and influenced by the debates of the civil trial doctrine. In this perspective, the action responds to a demand for Justice in harmony with the goal of the souls salvation typical of the canonical order (c. 1752). Nel solco dell’evoluzione segnata dalla prima codificazione canonica e condizionata, per certi aspetti, dagli apporti e dalle tensioni della processualistica civile, emerge il progressivo configurarsi di un’ idea di actio, non più identificata, ma pensata in funzione del diritto, quale domanda processuale rispondente a un’esigenza di giustizia metagiuridica, in ragione del fine salvifico proprio dell’ordinamento canonico (can. 1752)

    La canonizzazione dei santi combattenti nella storia della Chiesa: linee ricostruttive di una ricerca

    The expression “military saints”, or “warrior saints”, seems undermined by an aporia: can we attain holiness making use of weapons and through a “job” involving the killing of human beings? Can we still share the positions of the Catholic doctrine on just war? In this article this very relevant issue in today’s Church is addressed with an historical outlook and analyzed through the study of the cult of warrior saints with a juridical approach. Objects of this study, in historical order, are the military Passions of the martyred soldiers in the Roman Empire, the warrior saints in late Antiquity and early Middle Ages, the king saints killed in feuds and venerated as passio actors, the bishop saints defensores civitatis, the holy wars and the crusaders in the Holy Land and in the Reconquista, the spiritual assistance to the soldiers and the heroic witness of chaplains in the two world wars. In the light of this historical journey, some fundamental achievements of Vatican II, such as the dignity of the christifidelis and of the lay people, and the universal call to holiness, gain full clarity and deep meaning.L’espressione ‘santi combattenti’ pare infirmata da un’aporia: si può raggiungere la santità imbracciando le armi e svolgendo un ‘mestiere’ comportante l’uccisione di esseri umani? Sono ancora condivisibili le posizioni della dottrina cattolica sulla guerra giusta? Si affronta tale problematica assai attuale nella Chiesa alla luce della storia, analizzata attraverso l’esame del culto dei santi combattenti e con attenzione ai profili giuridici. La disamina si estende dalle Passioni militari dei martiri dell’Impero romano ai santi combattenti tra tardo antico ed alto medioevo, ai santi re trucidati in faide e venerati come attori di una passio, ai santi vescovi defensores civitatis, alle guerre sante ed ai crociati in Terrasanta e nella Reconquista, all’assistenza spirituale ai militari ed alla testimonianza eroica dei cappellani nelle due guerre mondiali. Dinanzi a tale parabola evolutiva acquistano limpidezza di confini e pregnanza di significati certe fondamentali acquisizioni del Vaticano II circa la dignità del christifidelis e del laico e la chiamata universale alla santità
