Anthroponymy in the municipality of Dande, Bengo province in Angola: tendency to value local languages in the naming process
No full textO nascimento de um(a) filho(a) traz desafios como a escolha do nome: fundamental, indispensável e marca do evento ‘nascimento’. É objetivo geral discutir a valorização das Línguas Bantu no processo de nomeação no Dande. Específicos: compreender a composição dos nomes próprios de pessoas, em Angola, à luz da constituição local; descrever a composição dos nomes coletados, com recurso a tabelas e gráficos; analisar esses nomes, considerando a constituição e línguas angolanas. Utilizamos metodologias quantitativa, documental e bibliográfica. Analisamos 1.011 nomes de estudantes matriculados no Instituto Médio Politécnico do Bengo, Dande, ano letivo 2024. Os nomes são apresentados em seis grupos: nomes completos com a totalidade de nomes em Língua Portuguesa; nomes completos com a totalidade de nomes em Línguas Bantu; nomes completos com prenome em Língua Portuguesa e sobrenome em Línguas Bantu; nomes completos com prenome em Línguas Bantu e sobrenome em Língua Portuguesa; nomes completos com prenome em Língua Estrangeira e sobrenome em Língua Bantu; e nome completo com prenome em Língua Bantu e sobrenome em Língua Estrangeira. Esta organização permitiu a projeção das estatísticas e frequências desses nomes, visando a sua análise. Da pesquisa se conclui que o nome é um produto sócio-histórico, cultural, político, associado a uma determinada língua, transportando uma carga cultural de um povo. O nome é uma marca identitária no grupo étnico estudado. Alguns sofrem aportuguesamento gráfico e fonológico resultante dos contatos linguísticos.The birth of a child brings challenges such as choosing a name, indispensable mark of the ‘birth’ event. The general objective: to characterize the proper names seeking to understand the valorization the Bantu and Khoisan languages in the naming process in Dande. Specific objectives: to investigate the composition of people’s names in Angola, in light of the Constitution; to describe the composition of the names collected, using tables and graphs; to analyze these names, considering the Law nº10/77 and Angolan languages. We used, documentary and bibliographic methodologies. We analyzed 1,011 names of students enrolled at the Instituto Médio Politécnico do Bengo, in the 2024 year. The names are presented in groups: full names with all names in Portuguese; full names with all names in Bantu languages; full names with first name in Portuguese and last name in Bantu languages; full names with first name in Bantu languages and last name in Portuguese; full names with first name in a foreign language and last name in a Bantu language; and full name with first name in a Bantu language and last name in a foreign language. This organization allowed the projection of statistics and frequencies of these names, aiming at their analysis. Concludes that the name is a socio-historical, cultural, political product, associated with a certain language, carrying a cultural load of a people
O PAPEL DOS SUJEITOS NA JUSTIÇA RESTAURATIVA APLICADA A CASOS CÍVEIS JUDICIALIZADOS: PROTAGONISMO OU SUBSTITUIÇÃO?
No full textO presente trabalho objetiva analisar o papel dos sujeitos em círculos restaurativos aplicados a casos cíveis judicializados, contrapondo-se a substituição, característica da jurisdição, ao protagonismo, fundamento das práticas restaurativas. Para tanto, adotou-se o método de abordagem hipotético-dedutivo e, como método de procedimento, o bibliográfico. Verificou-se que, durante o círculo de construção de paz aplicado a casos judiciais cíveis, o papel do advogado obscurece-se, pois não há um terceiro a ser convencido, nem a necessidade de um relato técnico-jurídico sobre os fatos. Todavia, não deriva dessa constatação a total exclusão do advogado, que pode auxiliar e fiscalizar a confecção do acordo, em termos jurídicos, para que ele seja homologado pelo juiz. Portanto, embora os círculos restaurativos exijam o protagonismo dos sujeitos envolvidos no conflito e os advogados atuem em um regime de representação judicial ou “incapacitação” relacional e postulatória perante o juiz, sua participação na Justiça Restaurativa, a posteriori, é importante para a validade do acordo e não deve ser excluída
ABOUT THE LEGAL STANDING OF ANIMALS
No full textThe present article examines whether animals have legal standing to appear as plaintiffs or defendants in judicial proceedings. According to the current legal system, animals are not considered legal subjects, but rather movable chattels. Therefore, theu don’t have the capacity to be parties and, consequently, don’t have legal standing. Brazilian Bill No. 6,054/2019 and Bill No. 145/2021 propose amendments to the Brazilian Civil Code and the Brazilian Code of Civil Procedure to grant animals the capacity to be parties and procedural capacity, but these bills need to bem adjusted to ensure that these legislative changes achieve their intended purpose. Thus, collective protection of animal rights will occur through procedural substitution by the Public Prosecutor's Office, Public Defender's Office, or civil associations, and individual protection of animal rights will occur through procedural representation by their caretakers or guardians.O presente artigo analisa se animais têm capacidade processual para figurar como autores ou réus em processos judiciais. De acordo com o sistema jurídico vigente, animais não são considerados sujeitos de direito, mas bens móveis semoventes. Portanto, não têm capacidade de ser parte e, consequentemente, não têm capacidade processual. O Projeto de Lei nº 6.054/2019 e o Projeto de Lei nº 145/2021 propõem alterações no Código Civil e no Código de Processo Civil para atribuir capacidade de ser parte e capacidade processual aos animais, mas devem ser ajustados para que essas mudanças legislativas atinjam a finalidade pretendida. Assim, a tutela coletiva dos direitos dos animais ocorrerá por substituição processual do Ministério Público, Defensoria Pública ou associações civis e a tutela individual dos direitos dos animais ocorrerá por representação processual dos seus tutores ou guardiões
Fact and evidence in appeals in second instance – Cognitive Biases and Urgent Reflections
No full textThe purpose of this article is to identify the problems and to present proposals for the solution of the issues of fact and to carry out the production of evidence in second instance, taking into account the reasonable duration of the processes and the efficiency. Through the deductive method, we found that, in the appeal, there is an appreciation of the analysis of questions of law and a reduction or absence of effective concern with the issues of fact; that is why we must study them, also in the scope of appeals, including demonstrating the importance of treating factus superveniens, jus superveniens, new evidence and duties of process, cognitive biases, they need to be stimulated by other means to act in matters of fact, also arriving at the analysis of the conduct of instruction in second instance when necessary, under penalty of violation of the federal law and special appeal, concluding that there is a legislative option that changed the paradigm and, therefore, if there is a need to produce new evidence, the valuation will occur exclusively in the second instance.O presente artigo tem por objetivos a identificação dos problemas e a apresentação de propostas para a solução das questões de fato e a realização da produção de provas em segunda instância, atendendo à razoável duração dos processos e à eficiência. Por meio do método dedutivo constatamos que em sede recursal há uma valorização da análise das questões de direito e uma redução ou ausência de preocupação, efetiva, com as questões de fato; por isso devemos estudá-las, também, no âmbito recursal, inclusive demonstrando a importância do tratamento dos factus superveniens, jus superveniens, provas novas e deveres poderes instrutórios dos desembargadores e vieses cognitivos, avaliando os impactos da constatação de que estes ao não terem contato prévio com o processo, precisam ser estimulados por outros meios para que atuem nas questões de fato, chegando também na análise da realização de instrução em segunda instância quando necessário, sob pena de violação da lei federal e cabimento de recurso especial, concluindo ainda que há uma opção legislativa que mudou o paradigma e, portanto, havendo necessidade de produção de novas provas, a valoração ocorrerá exclusivamente na segunda instância, o que ainda hoje não é tão amplamente observado nos tribunais
VULNERACIÓN DE PRINCIPIOS PROCESALES POR EL TRÁMITE DE LAS EXCEPCIONES RECONVENCIONALES EN EL PROCESO DECLARATIVO
No full textSe realiza una reflexión respecto a la situación actual de las excepciones reconvencionales de compensación y nulidad absoluta en la estructura procesal colombiana dado que, en su configuración actual, existe una vulneración de los principios procesales de seguridad jurídica e igualdad procesal. Las excepciones reconvencionales en comento se encuentran contenidas en el ordenamiento jurídico patrio, e igualmente han sido desarrolladas por la doctrina y la jurisprudencia; empero, sus particulares efectos y su trámite no son considerados por el Código General del Proceso mediante la regulación del proceso declarativo en el cual se equipara a tales medios de defensa con las excepciones comunes, circunstancia que significa una lesión a la seguridad jurídica e igualdad procesal que le asiste al demandante a quien le corresponde resistir la pretensión implícita que conllevan las excepciones reconvencionales.
A reflection is made regarding the current situation of the counterclaim exceptions of compensation and absolute nullity in the Colombian procedural structure given that, in its current configuration, there is a violation of the procedural principles of legal certainty, economy and procedural equality. It is known that the counterclaim exceptions in question are contained in the national legal system, and have also been developed by doctrine and jurisprudence; however, their particular effects and their procedure are not considered by the General Code of Procedure through the regulation of the declaratory process in which such means of defense are equated with common exceptions, a circumstance that means an injury to the legal certainty, economy and procedural equality that assists the plaintiff who is responsible for resisting the implicit claim that the counterclaim exceptions entail.É feita uma reflexão sobre a situação atual das exceções reconvencionais de indenização e de nulidade absoluta na estrutura processual colombiana dado que, em sua configuração atual, há violação dos princípios processuais de segurança jurídica e igualdade processual. As exceções de pedido reconvencional em questão estão contidas no ordenamento jurídico nacional, e também foram desenvolvidas pela doutrina e pela jurisprudência; Contudo, seus efeitos particulares e seu procedimento não são considerados pelo Código Geral de Processo através da regulamentação do processo declaratório em que tais meios de defesa são equiparados a exceções comuns, circunstância que significa uma lesão à segurança jurídica e à igualdade processual que assiste o autor que deve resistir à pretensão implícita que as reconvenções acarretam
Participatory Design in combating the Commercial Sexual Exploitation of Children and Adolescents: Innovation Laboratory at Unicap
Get PDFO estudo aborda a exploração sexual de crianças e adolescentes (ESCCA) no Nordeste do Brasil, destacando a atuação do Laboratório de Inovação da Unicap. O objetivo foi desenvolver um aplicativo de combate à ESCCA, utilizando o Design participativo. Fundamentado em autores como Amaral, Maynart e Mazarotto (2022), Paes e Anastassakis (2016) e Manzini (2015), o trabalho envolveu dinâmicas de co-criação com adolescentes vítimas. A metodologia incluiu etapas de idealização, prototipação e testes. A pesquisa contribui para o design ao demonstrar como a participação ativa das vítimas pode gerar soluções tecnológicas eficazes e promover inclusão digital. This study deals with the sexual exploitation of children and adolescents (ESCCA) in the north-east of Brazil, highlighting the work of Unicap's Innovation Laboratory. The aim was to develop an application to combat CSECA, using participatory design. Based on authors such as Amaral, Maynart and Mazarotto (2022), Paes and Anastassakis (2016) and Manzini (2015), the work involved co- creation dynamics with adolescent victims. The methodology included idealization, prototyping and testing stages. The research contributes to design by demonstrating how the active participation of victims can generate effective technological solutions and promote digital inclusion. 
Mujeres en Foco: Un Análisis Crítico de los Anales del P&D Design en Relación con el Género y la Mujeridad
No full textEste artigo investiga, de uma perspectiva feminista, como a produção acadêmica em design no Brasil aborda as questões de gênero e mulheridade. A pesquisa concentra-se nos anais do P&D Design — principal congresso científico da área no país — cobrindo as edições de 2016, 2018, 2022 e 2024. A partir de uma revisão de escopo, analisamos 158 artigos (7,23% do total de 2184), verificando o crescimento e retraimento dos temas ao longo dos anos. Embora as mulheres representem mais da metade da população, os resultados apontam uma preocupação proporcionalmente insignificante com questões de gênero e mulheridade em relação ao total de artigos publicados, evidenciando a continuidade de um padrão “universal” que marginaliza as experiências femininas. Conclui-se que, apesar de alguns avanços pontuais, ainda persistem barreiras culturais e institucionais que dificultam a consolidação de um design representativo, capaz de abarcar a pluralidade das vivências femininas.This article investigates, from a feminist perspective, how academic production in design in Brazil addresses issues of gender and womanhood. The research focuses on the proceedings of P&D Design—the leading scientific conference in the field in the country—covering the 2016, 2018, 2022, and 2024 editions. Through a scoping review, we analyzed 158 articles (7.23% of the total 2,184), examining the growth and decline of these themes over the years. Although women represent more than half of the population, the results indicate a proportionally insignificant concern with gender and womanhood issues relative to the total number of published articles, highlighting the persistence of a "universal" pattern that marginalizes women's experiences. The study concludes that, despite some isolated advances, cultural and institutional barriers still hinder the consolidation of a representative design that encompasses the plurality of women's experiences
DEVORAR E SE VESTIR DE CONSTELAÇÃO: AS TRILHAS DE SUMÉ E A TESSITURA ESPIRITUAL ENTRE FLORESTA E PERIFERIA
No full textThis article follows the paths indicated by the Tupinambá cosmogony to take the narratives as a wandering exercise, inspired by the jaguars that roam the forest and the stars to devour and lift worlds. Thus, taking the periphery as a place of enunciation, territory of the city of Duque de Caxias, we problematize colonial productions that establish dimensions of being/knowledge via violence and the production of stereotypes. Sumé, the mythical jaguar of the Tupinambás, guides us to devour worlds and interpret other paths of meaning of existence in the heavens. It is in this sense, in dialogue with the Tupinambá cosmogony and the concepts of countercolonization (BISPO DOS SANTOS, 2015) and recovery (BABABU, 2023), that we establish a weave between the spirit of the forest and the spirit of the periphery. We also take the dialogue with the experience of the Museu Vivo do São Bento, as an exercise in memory and ancestral politics based on the principles discussed here. We are interested in weaving ethical, aesthetic, political and epistemological dialogues between the spirit of the forest and the spirit of the peripheries that allow us to connect the stories, memories and narratives of the Tupinambá peoples to suggest a critique of the dominant model of being/knowledge, especially in the so-called periphery.Esse artigo caminha nas trilhas indicadas pela cosmogonia tupinambá para tomar as narrativas como um exercício andarilho, inspirado nas onças que percorrem a floresta e as estrelas para devorar e erguer mundos. Assim, tomando a periferia como lugar de enunciação, território da cidade de Duque de Caxias, problematizamos as produções coloniais que fixam via a violência e a produção de estereótipo dimensões do ser/saber. Sumé, a onça mítica dos tupinambás, nos orienta a devorar mundos e interpretar nos céus outros caminhos de significação da existência. É nesse sentido, em diálogo com a cosmogonia tupinambá e os conceitos de contracolonização (BISPO DOS SANTOS, 2015) e retomada (BABAU, 2023), que estabelecemos uma tessitura entre o espírito da floresta e o espírito da periferia. Tomamos ainda o diálogo com a experiência do Museu Vivo do São Bento, como exercício de memória e política ancestral baseada nos princípios aqui abordados. Nos interessa tecer diálogos éticos, estéticos, políticos e epistemológicos entre o espírito da floresta e o espírito das periferias que permitam conectar as histórias, memórias e narrativas dos povos tupinambás para sugerir uma crítica ao modelo dominante de ser/saber, principalmente na chamada periferia
ANÁLISE DAS DESCRIÇÕES DE IMAGENS GERADAS POR INTELIGÊNCIA ARTIFICIAL APLICADAS EM REDES SOCIAIS
No full textA Inteligência Artificial (IA) está cada vez mais presente no nosso cotidiano. Com o uso frequente das redes sociais por pessoas com deficiência visual, plataformas como o Facebook e o Instagram começaram a utilizar a IA para gerar descrições automáticas de imagens para esse público. Entretanto, será que a IA consegue fornecer descrições satisfatórias que transmitam todas as informações contidas nas imagens publicadas nas redes sociais? Este trabalho tem como objetivo analisar as descrições de imagens geradas pela IA e as descrições humanas nas redes sociais Facebook e Instagram, a partir da perspectiva dos usuários com cegueira. Para avaliar a eficácia desse recurso, foi realizado um teste de amostragem com sete partícipes legalmente cegos ou com baixa visão, utilizando entrevistas e testes nas duas redes sociais. Os resultados da pesquisa indicaram que as descrições geradas pela IA foram sucintas e não alcançaram todos os detalhes das imagens testadas se comparadas às descrições realizadas por humanos. Os dados obtidos mostraram que, embora as descrições sucintas fornecidas pela IA sejam mais úteis do que a ausência de qualquer descrição, a Inteligência Artificial desempenhou um papel significativo na conexão de mais usuários cegos nas redes sociais. No entanto, é necessário um aprimoramento contínuo para promover uma inclusão mais eficaz para todos os usuários.Artificial Intelligence (AI) is increasingly present in our daily lives. With the frequent use of social media by people with visual impairments, platforms such as Facebook and Instagram have begun to use AI to generate automatic descriptions of images for this audience. However, can AI provide satisfactory descriptions that convey all the information contained in the images published on social media? This study aims to analyze the descriptions of images generated by AI and human descriptions on the social media platforms Facebook and Instagram, from the perspective of blind users. To evaluate the effectiveness of this resource, a sample test was conducted with seven legally blind or visually impaired participants, using interviews and tests on both social networks. The results of the research indicated that the descriptions generated by AI were succinct and did not cover all the details of the images tested when compared to the descriptions provided by humans. The data obtained showed that, although succinct descriptions provided by AI are more useful than the absence of any description, Artificial Intelligence played a significant role in connecting more blind users on social media. However, continuous improvement is needed to promote more effective inclusion for all users
