[Exercise of the right of self-determination. Analysis of comparative law: the case of Quebec and the case of Cataluña
Get PDFEl independentismo catalán ha actuado con mayor contundencia en España estos últimos años, llegando a desarrollar actuaciones desde el
Parlamento de Cataluña, así como desde diferentes partidos políticos,
que han rozado la ilegalidad y la inconstitucionalidad. De ello nace el
interés de realizar este trabajo desde un punto de vista constitucional
y, en ocasiones, político. Para entender ciertas reivindicaciones de los
independentistas catalanes y su posterior análisis, se ha elegido el proceso referendario que tuvo lugar en Quebec (Canadá) durante la década de los 90, con motivo de las inquietudes independentistas de un
gran porcentaje de la población quebequense; ya que, además, ha sido
alegado por parte de algunos independentistas catalanes para defender su posición. Este proceso quebequense finalizó jurídicamente con
un pronunciamiento dictado por el Tribunal Supremo de Canadá, que
podría asimilarse a las funciones que desarrolla en España el Tribunal
Constitucional; de ahí el interés, tanto jurídico como político, de la realización de este trabajo de derecho comparado.The Catalan independence movement has acted with greater force in
Spain in recent years, coming to develop performances from the Parliament of Cataluña, as well as from different political parties, which have
grazed the illegality and unconstitutionality. From this arises the interest to carry out this work from a constitutional and, sometimes, political
point of view. To understand certain demands of the Catalan separatists
and their subsequent analysis, the referendum process that took place
in Quebec (Canada) during the 1990s has been chosen, due to the independence concerns of a large percentage of the Québec population;
since, in addition, it has been alleged by some Catalan separatists to
defend their position. This process in Quebec ended legally with a pronouncement issued by the Supreme Court of Canada, which could be
assimilated to the functions carried out in Spain by the Constitutional
Court; hence the interest, both legal and political, of the realization of this

Motivación en el aprendizaje servicio: Una mejora respecto a los métodos tradicionales
Get PDFThis paper aims at exploring the motivation of university students who participated in servicelearning
projects as part of their coursework, and to determine whether their level of motivation is higher for
the service-learning project as compared to performing more traditional academic tasks and assignments. The
Service-Learning project carried out during the ICT in Education course intended to support the development
of digital literacy in a Maasai school in Kenya. The instrument used to evaluate motivation of the university
students is the motivation scale called Motivated Strategies for Learning Questionnaire (MSLQ) proposed
by Pintrich and his collaborators (1991) adapted to the Spanish population by Roces Montero (1996). The
results of the research indicate that there are significant differences in favor of service-learning in relation
to motivation in general for the completion of the activities and specifically in relation to the utility of the
activity as seen at the present moment and in the future, as well as promoting creativity, the interest in the task
which includes the perception of the importance of the project, the need to work hard and thoroughly and
willingness to face challenges and difficulties in order to achieve the set objective. No significant differences
have been observed in relation to the desire to obtain a better grade for completing the activity or need to
prove personal value to others, as well as to broaden the information to complete the activity.Este artículo plantea un estudio relacionado con el aprendizaje servicio en el ámbito
universitario en relación a la motivación de los estudiantes que lo llevaron a cabo. Se pretende contrastar
las diferencias motivacionales que sugieren a los estudiantes los métodos tradicionales en contraste
con el método aprendizaje servicio. Por medio de la asignatura de TIC en la Educación se ha llevado
a cabo un proyecto de aprendizaje servicio para favorecer la alfabetización digital en una escuela
Masái en Kenia. El instrumento utilizado para evaluar la motivación de los sujetos universitarios es
la escala de motivación del Motivated Strategies for Learning Questionnaire (MSLQ) de Pintrich
y sus colaboradores (1991) adaptado a población española por Roces Montero (1996). Los análisis
revelan que existen diferencias a favor del aprendizaje servicio en relación a la motivación general en el
desarrollo de la actividad por parte de los alumnos, y en concreto en relación a la utilidad de la actividad
en la actualidad y para su uso futuro; el fomento de la curiosidad, el interés por el trabajo: la importancia
del proyecto y la necesidad de trabajar a fondo para conseguir el objetivo propuesto y el desafío frente
al aprendizaje. No se han observado diferencias significativas entre metodologías en relación al deseo
de obtener una mejor calificación en el desarrollo de las actividades, mostrar la valía personal ante los
demás y la necesidad de ampliar información para el desarrollo del trabajo.Educació
Post-traumatic cognitions and quality of life in terrorism victims: the role of well-being in indirect versus direct exposure
Get PDFBackground: The effect of indirect (versus direct) exposure to a traumatic event on the quality of life of terrorist
attack victims has received considerable attention in the literature. However, more research is required to examine
whether the symptoms and underlying processes caused by both types of exposure are equivalent. Our main
hypothesis is that well-being plays a different role depending on indirect vs. direct trauma exposure.
Methods: In this cross-sectional study, eighty direct victims of 11-M terrorist attacks (people who were traveling in
trains where bombs were placed) and two-hundred indirect victims (individuals highly exposed to the 11-M
terrorist attacks through communications media) voluntarily participated without compensation. To test our
hypothesis regarding the mediating role of indirect exposure, we conducted a biased corrected bootstrapping
procedure. To test our hypothesis regarding the moderating role of direct exposure, data were subjected to a
hierarchical regression analysis.
Results: As predicted, for indirect trauma exposure, well-being mediated the relationship between post-traumatic
dysfunctional cognitions and trauma symptoms. However, for direct trauma exposure, well-being moderated the
relationship between post-traumatic dysfunctional cognitions and trauma symptoms.
Conclusions: The results of our study indicate that the different role of well-being found between indirect (causal

The judicial electronic auctions: analysis of the reality in the judicial courts
Get PDFLas subastas judiciales electrónicas han supuesto un cambio fundamental en la práctica judicial. La reforma de la Ley de Enjuiciamiento Civil ha hecho necesaria la comunicación entre los órganos judiciales y otros operadores jurídicos –hasta ahora ajenos a este procedimiento– como son, el Portal del BOE y la Agencia Tributaria; y ha realizado modificaciones en la tramitación que han hecho posible que se multiplique la eficacia de la publicidad, información y transparencia. Sin duda, se ha agilizado la tramitación pero también se han planteado interrogantes sobre cuestiones prácticas derivadas, casi siempre, de la falta de medios técnicos adecuados, aunque también de la necesidad de interpretar la norma de forma acorde con el buen fin de la ejecución. En nuestro trabajo, intentaremos abordar un diagnóstico de cuál es la situación actual de las subastas electrónicas y su realidad práctica.The judicial electronic auctions have brought a fundamental change in the judicial practice. The amendment of the Civil Prosecution Law has made the communication between the judicial organs and other legal operators –until now, outside of this procedure– necessary, such as the Portal of the Spanish
Official Gazette «BOE» and the Tributary Agency. Also, the amendment has made changes in the procedure that have made possible that the efficiency of the advertising, information and transparency multiplies. Undoubtedly, the procedure has sped up, but questions have also been raised on practical
issues, which are almost always a result from the lack of suitable technical means and the need to interpret the law according to the good end of the execution. Teacher's self-efficacy within the physical education context

autoeficacia de los docentes españoles en el contexto de la
educación física de Educación Primaria, Secundaria y
Bachillerato. Participaron 81 profesores a los que se les aplicó
el Cuestionario de Autoeficacia de las Competencias
Profesionales del Docente (CACPD), con un CFI=,92; TLI=,92;
RMSEA=,04; se analizaron los datos en función del género,
los años de experiencia, la titularidad, la etapa educativa y la
comunidad autónoma española mostrándose las competencias
docentes que definen un modelo de profesor excelente y eficaz
novedoso hasta la fecha. El profesor de educación física debe
ser un líder creativo que sepa establecer una relación de
reciprocidad con los alumnos y con gran capacidad para
adaptarse a los cambios. Ha de poseer una técnica didáctica
cada vez más consolidada, donde la capacidad de
autorreflexión y metacognición le lleve a aplicar mejores
estrategias en su desempeño docente, repercutiendo así en la
calidad educativa.The present work focuses on the study of the beliefs of Spanish
teachers' self-efficacy in physical education in Elementary,
Middle and High School. Eighty-one Spanish teachers of
physical education filled out the Self-Efficacy Questionnaire of
Professional Teacher Competencies (CACPD), with an IFC =,
92; TLI =, 92; RMSEA = 4.0. The results were analyzed
according to gender, years of experience, professional rank,
school grade and the Spanish autonomous community. The
study shows the teaching competences that define an excellent
and effective teacher model at present. A physical education
teacher must be a creative leader, able to establish a
relationship of reciprocity with the students, and to adapt to the
constant changes that occur in any educational process. He or
she must possess an increasingly consolidated didactic
technique, where a capacity for self-reflection and
metacognition leads him or her to employ superior teaching
strategies, and thus, influence the quality of education.Educació
