De huidige stand van de rechtsfiguur vereenzelviging. Is deze voldoende afgebakend voor een rechtens juiste toepassing?
Full text linkOnrechtmatige crediteursbenadeling behoeft geen plaats binnen het rechtspersonenrecht. De vereenzelviging is een buitenwettelijke zelfstandige grondslag voor aansprakelijkheid. Deze gaat voorbij aan de zelfstandige identiteit van de rechtspersoon (art. 2:3 BWA) waardoor de aangesproken rechtspersoon medeaansprakelijk wordt voor de gehele vordering. Mede door dit verstrekkende gevolg wordt de vereenzelviging zeer terughoudend toegepast. In 2019 en 2020 werd vereenzelviging toegewezen bij de rechtbank en het Hof. Is er een koersverandering op komst of is er onduidelijkheid in de kaders voor de juiste toepassing
Meertalig taal-in-onderwijsbeleid op Aruba
Full text linkIn de Arubaanse context, waar Papiaments, Spaans en Engels vaak de thuistalen van leerlingen zijn, en Nederlands de instructietaal is, zijn inzichten in hoe het talenonderwijs beter bij de behoeftes van de leerling en de maatschappij kan aansluiten een belangrijke bijdrage aan de verbetering van het onderwijs. Op Aruba heb ik data verzameld via vragenlijsten met leerlingen (n=220) en leerkrachten (n=21), focusgroepen met leerlingen (n=26) en interviews met leerkrachten (n=11), en hier pas ik een kritische discoursanalyse op toe. Zodoende onderzoek ik onder andere hoe taal-in-onderwijsbeleid een rol speelt in praktijken in de klas, of Europees en Nederlands beleid bewust of onbewust invloed hebben, en hoe onderzoeksgebaseerd talenbeleid een succesfactor kan zijn voor meertalige onderwijspraktijken die passen bij de Arubaanse samenleving. De voorlopige analyse geeft ondermeer inzichten over een gebrek aan formeel talenbeleid op scholen, de gevolgen van thuistaalgebruik in de klas en de behoeftes van leerkrachten voor verdere ondersteuning.
Dit onderzoek kan betekenisvol zijn voor onderwijs in andere delen van het Caribisch gebied waar Nederlands als instructietaal wordt gebruikt: het onderzoek belicht het belang van 1. duidelijk en weloverwogen taalbeleid, 2. thuistaalgebruik in het onderwijs in meertalige samenlevingen en 3. leerkrachtprofessionalisering met betrekking tot
taalbewust lesgeven.
Het onderzoek is onderdeel van het Horizon Europe Pluridentities-project, een interdisciplinair project dat meertalige praktijken in het voortgezet onderwijs bestudeert

Full text linkThe GreenComp Evaluation Roadmap: a roadmap for in-depth holistic evaluation of the integration of the GreenComp framework in higher-education curricula

The GreenComp framework identifies 12 competences for sustainability as common ground for higher-education curricula. The framework can be used for self-assessment and the review of curricula. However, a step-by-step method to conduct such a self-assessment is not yet available for the GreenComp framework specifically. Therefore, the authors present the GreenComp Evaluation Roadmap allowing to evaluate the extent to which the frameworks’ competences for sustainability are integrated in higher-education curricula. The application of the GreenComp Evaluation Roadmap to a curriculum taught at the University of Aruba, allows to report on the benefits, limitations and future potential of the approach.
Design/methodology/approach
The proposed mixed-method approach combines hybrid qualitative and quantitative data collection on the integration of the 12 competences for sustainability of the GreenComp framework in higher-education curricula. The authors showcase its potential through application of the GreenComp framework as an evaluation tool to a science, technology, engineering and mathematics-based bachelor program taught at the University of Aruba.
Findings
The GreenComp Evaluation Roadmap not only allows for an evaluation of the curriculum and identification of competence gaps. It also supports educators to conduct a self-reflection on individual course(s) and the program as a whole. The paper shows promising results that the roadmap developed could be a reproducible approach. Moreover, it provides guidance to other higher education institutes for self-evaluation and self-reflection on how the competences for sustainability are integrated in their curricula and how this can be enhanced in the future.
Originality/value
The need to integrate sustainability throughout higher-education curricula is broadly recognized. The GreenComp Evaluation Roadmap contributes to the literature by offering a methodological approach to evaluate the integration of the 12 competences for sustainability throughout a curriculum
Over de vertrouwensrelaties tussen parlement en regering in het parlementair systeem
No full textDit artikel behandelt twee recente Arubaanse en Curaçaose voorvallen die te maken hebben met de vertrouwensrelaties tussen parlement en regering. De voorvallen worden in een breder perspectief van het parlementair systeem geplaatst. Er wordt ingegaan op de vertrouwensregel en het ontbindingsrecht, de invloed van politieke partijen en het vrij mandaat en de rol van de Statenvoorzitter. De auteurs concluderen dat zowel in Aruba als Curaçao blijkt dat de dualistische spelregels in het parlementair systeem niet optimaal functioneren
Diaspora and Digital Discourse: Papiamento/u Research in the Digital Archives of Coleccion Aruba
No full textThis article describes the development, scope and possibilities of the Aruban collaborative digital archive initiative Coleccion Aruba. Coleccion Aruba is an online Aruban digital hub where users can consult historical texts, videos, and images. Among other things, it comprises the digitalized databases of the Aruban National Library, the Aruban National Archive, and the Aruban Archeological Museum. In addition to Aruban documents, it hosts sources from European and regional institutes that touch on the cultural, social, and political history of Aruba and the former Netherlands Antilles. A unique feature is that many of the digitized sources are in Papiamento/u. This article first describes the history and creation of this collection. Second, it demonstrates how Coleccion Aruba has opened up new research possibilities in and about Papiamento/u, and sketches directions for future research on the basis of this collection. Lastly, it explains how the digital collection enables new and decolonial opportunities for the development of Artificial Intelligence solutions for the Papiamento/u language as well as regional and international collaborations between archives, libraries, and research institutions. Because of the scattered and diasporic nature of the Papiamento/u language community, the authors conclude that online digital collections such as this one are essential in ensuring a sustainable future for the language of Papiamento/u as well as research in and about this language
