Cadre normativ-instituționale ale construcției sociale a profesiei de consilier de probațiune în zona de Nord-Est a României și în Republica Moldova: Institutional Regulatory Frameworks of the Social Construction of the Probation Counselor Profession in North-East Romania and the Republic of Moldova
The present article aims to analyse the institutional regulatory frameworks of the activity of probation counselors in Romania and the Republic of Moldova, and their impact on the social construction of the profession of probation counselor. The theoretical frameworks are pegged by the three paradigms on justice: retributive, restorative and humanistic (based on human rights). The model of probation implemented in the two states, according to the existing normative framework, is tributary to the retributive paradigm. We notice an intention of the legislator to harmonize the national legislation with the European frameworks in the field, by introducing certain regulatory frameworks based on restorative and humanistic justice, but there are also inconsistencies in transposing those into normative frameworks of functioning of probation. The cultural context of the two countries is unfavorable for the social alternatives to imprisonment, the dominant mentality being highly retributive. The epistemic and axiological frameworks of the probation services in Romania and the Republic of Moldova are generally tributary to the prisonocentric paradigm, belonging to the model of retributive justice. The probation system is generally seen as an alternative to imprisonment, and less as an alternative to the punishment. We must notice that the regulatory progress of the Romanian system of juvenile justice, which eliminates the idea of punishment applied to the minors, the sanctioning measures applied, including the custodial ones are considered educational measures, not punitive ones

Cooperarea în educația incluzivă: perspective comparative între sistemul românesc și cel francez: Cooperation in Inclusive Education: Comparative Perspectives between the Romanian and the French System
Inclusive education means access to education for all children, regardless of their characteristics, while respecting the right of children to follow the school most appropriate to their needs. To achieve this goal, effective cooperation between all educational actors is needed. The main aim of the present article is to analyze how to work in a team, how inter institutional collaboration takes place, and how partnership with parents is conducted in inclusive education. By comparison we chose the French system, which has a long history of special education and Romanian, which inherited from the communist period an institutional system for the care of children with disabilities. This article is based on 82 individual semi-structured interviews with different categories of social actors involved in inclusive education. The main difficulties with teamwork are related to the devaluation of the work of new specialists recently introduced and to the lack of organization of the work of the specialists. Blocking information at the level of an institution is the main difficulty in interinstitutional communication. Resistance of parents to recognize children’s problems is one of the reasons why the partnership between specialists and parents does not work. The study has identified several strategies to improve the difficulties encountered: regular team meetings, partnership setting, clear objectives and rules between institutions, child service based on a contract with parents, and parent involvement in the evaluation and re-evaluation process of the child. The results of this study suggest that the process of school inclusion needs to be better supported

The statistical procedures used for data processing have to be considerate depending on measurement variables level: nominal, ordinal, interval or ratio type. Here are presented some examples for ordinal variables, where calculated mean is misleading and gives a wrong interpretation. For the categorical variables, we propose an indicator resulted from the informational entropy, as a measure of the responses distribution in a survey. Calculations are made for a Likert scale, survey data from 1991 to 2010. The indicator allows us to make a global characterization of the distributions, items ranking, dynamic comparisons and patterns identification

Whistleblowing Practices Benchmarking for Top-ranking Public and Private Employers
The study concerns the legitimization and institutionalization of an emerging field of preoccupation – that of whistleblowing or integrity denouncement in Romania. The research design relies on acomparative best practice approach achieved through a parallel online analysis between 20 ministries as central administration entities, nine of the most profitable state-owned enterprises (SOEs) and a sample of private corporations tagged as premium employers in graduate surveys. Provisions on whistleblowing are included in the code of business ethics of corporations and due diligence governance policy of public-sector organizations. The conceptual model of comparative investigation relies on a benchmarking framework applied to official corporate websites and analyzes the following categories: coverage (types of misconduct), accessibility (internal and external communication means), addressability (targeted stakeholders), core principles, technical specifications and explanations on process stages. Organizational procedures on whistleblowing strive to be comprehensive enough to cover a fragmented, heterogeneous and highly atomized area of illegal, unethical, or offensive behavior. Findings suggest informal collective mechanisms involved in ethics should be integrated across any and all administrative procedures to enhance legitimacy and applicability of the latter. Moreover, the emerging concept of ethical crowdsourcing can play an important role as insider’s civil alarm that serves the purpose of prevention and early detection of misconduct across the three categories of investigated organizations. The article discusses solutions to upgrade such procedures aiming to maximize transparency and civic participation, involving counselling, training, mediation and arbitration techniques, dedicated ombudsperson, hybrid outsourcing strategies, through the lens of theoretical connections to agency and accountability
