No full text葛野尋之先生 名誉教授称号授与記念This paper attempts to provide insight into the existence and content of procedural rights that should be guaranteed to an accused person in criminal proceedings through a discussion on the abolition of the common law hearsay rule in England and Wales. In Al- Khawaja and Tahery v. United Kingdom, the European Court of Human Rights determined how the “sole or decisive rule” concerning Article 6 § 3（d）of the European Convention on Human Rights should be applied. This paper examines how the requirement of a “fair trial” has functioned in relation to the admissibility of out-of-court statements by considering the specific evidence presented in the Al-Khawaja and Tahery case
Exercising Young Suspects’ Rights to Legal Advice in the Investigation Process in England and Wales : The Effect of Assistance by “Appropriate Adults”
No full text葛野尋之先生 名誉教授称号授与記念This article examines how assistance by “Appropriate Adults”（ hereafter “AA”） affects exercising young suspects’ rights to legal advice in the investigation process in England and Wales. The AA scheme is prescribed under the Police and Criminal Evidence Act 1984（ hereafter “PACE”） and the Code of Practice C（ hereafter “Code C”） to safeguard the rights, entitlements and welfare of vulnerable suspects, including juveniles and vulnerable adults, during police investigation. This article focuses only on juvenile suspects. To consider this issue, the article analyzes the empirical data by Miranda Bevan, who examined the functioning of AA support in practice, focusing on the AA’s roles under the Code C and the difference of familial AAs and non-familial AAs. In terms of assistance by AAs involved in providing emotional support for young suspects and facilitating young suspects’ rights, the article concludes that differences between assistance by familial AAs and assistance by non-familial AAs affect understanding and exercising young suspects’ rights to legal advice
Toward a Guidepost for Quantitative Tightening :The Case of the Bank of Japan
No full textAn exit strategy from large-scale unconventional monetary policy requires central banks to adjust their policy interest rates and the size of their balance sheet. Adjustments of policy interest rates are carried out using neutral interest rates as a guidepost, even in the presence of measurement uncertainty. In contrast, adjustments of balance sheet size, or quantitative tightening (QT), are implemented through trial and error without any standardized guideposts. In this paper, I will develop a guidepost for the QT process in Japan. To that end, I will examine the long-term level of the balance sheet size of the Bank of Japan (BOJ), based on the estimation results for the nonlinear shape of the reserve demand curve. I will then carry out a simulation analysis of the transition path of the BOJ’s holdings of Japanese Government Bonds (JGBs). I will also address concerns over the boundary between fiscal financing and monetary policy by proposing the “extended banknote rules,” both in the long term and in the transition
Internships in Industry-Academia Collaboration : A Review of Previous Research and Future Research Directions
No full text本論文では、インターンシップに関する先行研究を検討し、特に、インターンシップにおける教員・学生・企業との関係性、インターンシップによる企業と社員への影響、インターンシップ制度に関する日本と台湾の比較分析を明らかにする。また、インターンシップに関する今後の研究方向性を、台湾における大学側のキャンリアセンターの役割、台湾半導体産業に関するインターンシップ計画への検討などを説明する。This study reviews prior research on internships, with particular emphasis on three key areas: the relationships among faculty members, students, and companies within the context of internship programs; the impact of internships on companies and their employees; and a comparative analysis of internship systems in Japan and Taiwan. In addition, the paper outlines potential directions for future research, including an examination of the role played by university career centers in Taiwan and a consideration of internship initiatives within the Taiwanese semiconductor industry
