JAPANESE ADMINISTRATIVE ADR IN ENVIRONMENTAL MATTERS : ITS DEVELOPMENTS AND CHALLENGES

    No full text
Japanese administrative environmental ADR is quite a unique model of an environmental tribunal. It has not only general features of ADR compared to court procedures, but also some advantages as an administrative organ. In addition, the administrative ADR body at the national level has the potential for judicial review. This paper analyses the legal system and practise of the Japanese model and clarifies its characteristics and challenges.Article信州大学経法論集 5(ブラジル・日本国際セミナー特集号) : 117-139(2019)departmental bulletin pape

“KAROSHI” : Comparative overview of Brazilian and Japanese Law related to Karoshi

    No full text
Karoshi (death from work exhaustion) has been subject of several studies in Japan in the recent years. The health ministry reported 93 cases of suicides or attempted suicides directly linked to work pressure in 2015, but the national police agency declared that work was partly responsible for 2,159 suicides in 2015. In this sense, Prime Minister Shinzo Abe proposed, together with the main Employers ' (Keidanren) and Workers' (Rengo) unions in Japan, to establish a legal limit of over 100 hours per month. Although such a measure may be considered by some as a progress in the history of Japanese labor law, since there is currently no limit to the law, this proposal has been harshly criticized. This is because it is too much above the 80-hour limit established by the Ministry of Health, Labor and Social Welfare as a limit for the configuration of karoshi, and quite close to 105 hours worked monthly by Matsuri Takahashi, the young Dentsu worker driven to suicide by the daily and excessive hours of work. On the other hand, in Brazil, the discussion of the subject is restricted to the sugar cane cutter worker, and there is only few research on other cases concerning karoshi. The aim of the present paper is to investigate the Brazilian and the Japanese Law related to karoshi, mainly the cases analysis in each system, and comment on the difficulties faced by them.Article信州大学経法論集 5(ブラジル・日本国際セミナー特集号) : 243-264(2019)departmental bulletin pape

Toll -like receptor ligand-dependent inflammatory responses in chick skeletal muscle myoblasts

    No full text
Epub 2018 Oct 30Toll-like receptors (TLRs) are a group of sensory receptors which are capable of recognizing a microbial invasion and activating innate immune system responses, including inflammatory responses, in both immune and non immune cells. However, TLR functions in chick myoblasts, which are myogenic precursor cells contributing to skeletal muscle development and growth, have not been studied. Here, we report the expression patterns of TLR genes as well as TLR ligand-dependent transcriptions of interleukin (IL) genes in primary-cultured chick myoblasts. Almost TLR genes were expressed both in layer and broiler myoblasts but TLR1A was detected only in embryonic layer chick myoblasts. Chick TLR1/2 ligands, Pam(3)CSK(4) and FSL-1, induced inflammatory ILs in both layer and broiler myoblasts but a TLR4 ligand, lipopolysaccharide, scarcely promoted. This is the first report on TLR ligand-dependent inflammatory responses in chick myoblasts, which may provide useful information to chicken breeding and meat production industries.ArticleDEVELOPMENTAL AND COMPARATIVE IMMUNOLOGY. 91:115-122 (2019)journal articl

Continental weathering in the Early Triassic in Himalayan Tethys, central Nepal: Implications for abrupt environmental change on the northern margin of Gondwanaland

    No full text
The geochemistry of Triassic mudstones in the Himalayan Tethys sequence, central Nepal, was studied with respect to changes in sedimentary facies, grain size, and source rocks. The Triassic sedimentary facies of mudstone and carbonates show deposition in offshore to hemiplegic environments. The rare earth element (REE) pattern of the Permian and Triassic mudstones suggests uniformity correlatable to average shale. The major element geochemistry of the Early Triassic Griesbachian-early Smithian mudstones indicates a sediment supply from strongly weathered sources with the chemical index of alteration (CIA) values of 76–81. However, the mudstones in the late Smithian show weakly weathered sources with CIA values of 68–74. The lower part of the Middle Triassic Anisian mudstones return to Early Triassic paleoweathering levels. There are no significant relationships among lithofacies, the grain size of the sediments, and CIA values. Thus, the abrupt change of the degree of paleoweathering in the Early Triassic, late Smithian time, suggests a dramatic decrease in continental weathering, which is related to a predominantly arid climate in the northern marginal area of Gondwana.ArticleJOURNAL OF ASIAN EARTH SCIENCES.79, Part A:288-301(2014)journal articl
