Archaeology of landscape: field survey in the Valley of Hadzhiiska, Byala and Aheloy River
Get PDFIn the autumn of 2020 and spring of 2021, archaeological and geological field surveys were conducted within the Nessebar and Pomorie municipalities, as part of the project “Archaeology of Landscape: Patterns of Reconstruction of the Ancient Environment.” The project aims to reconstruct the landscapes of the Southern slopes of The Emine Stara Planina Mountain during Antiquity, as well as investigate human impact on the environment and archaeological sites. During the surveys, 102 new archaeological sites were discovered (see Fig. 1). Two sites date back to the Late Chalcolithic period, four to the Late Bronze Age, and nine small settlements to the Early Iron Age. These settlements were located along the banks of the Aheloy River and Hadzhiiska River. The majority of the sites (51 settlements) date back to the second half of the 1st millennium BC. Eleven settlements were dated to the Archaic and Classical periods, and ten to the Hellenistic period. Thirty sites did not yield enough diagnostic artifacts, and thus were largely dated to the second half of the 1st millennium BC. The Early and Late Roman periods, as well as Late Antiquity, were represented by a total of 54 sites, with 13 sites from the Roman period and 41 from Late Antiquity. However, this remains a conditional division, as some of the sites from Late Antiquity could potentially date back to the 2nd and 3rd centuries. The Medieval period was represented by 46 sites, with three sites dating back to the earliest part of the period (8-10th century). These sites contain pottery from the First Bulgarian Kingdom, while eleven sites belong to the 10th-12th centuries, and eighteen sites to the 13th-14th centuries

Legal Regime of Improvements Carried out in Jointly Owned Property
Get PDFThe present article examines the problems arising in one of the specific hypotheses of the general claim for unjust enrichment within the meaning of Article 59 of the Obligations and Contracts Act. In the predominant part of the practice, the courts do not examine in detail the question of whether the impoverished plaintiffs had the intention at all and whether they would objectively receive the property benefits appropriated by the unauthorized person using the foreign item. In this way the practice literally creates an “objective” unjustified enrichment in the presence of usage of someone else‘s property without legal grounds and an established right of ownership of the plaintiff. Further developing this scenario leads to a situation in which the court does not examine whether the plaintiff actually suffered impoverishment, despite the explicit requirement of the norm of Article 59, paragraph 1 of the Obligations and Contracts Act for the presence of such as part of the elements of the factual composition of the norm. The indicated tendency of the judicial practice will be the examined subject of analysis in the following article

Is Moral Criticism of Law Possible?
Get PDFIn this article I represent the project for moral criticism of law, as developed by Robin West in “Narrative, Law and Authority”. I analyse how the issue of moral criticism of law comes to the fore in the context of legal positivism and I further render it problematic within the Critical Legal Studies that unmask and expose the processes of law’s legitimation in society. I give reasons for the need of applying the methods of the humanities for reaching an independent moral perspective that is not entirely a product of the legal system. I discuss the objections to the humanistic project so that to demonstrate their deficiencies and to reject them, and at the end to reinforce this project as a possible and meaningful moral critique of law
