    A comparison between formal debt administration and debt review - the pros and cons of these measures and suggestions for law reform (Part 2)

    Roughly a decade ago, after complaints from consumers about abuse of the debt administration procedure, the Department of Justice and Constitutional Development launched a project aimed at reforming this procedure This project was however suspended because of an independent initiative by the Department of Trade and Industry to reform consumer protection legislature, culminating in the National Credit Act of 2007. Sadly, when instituting the debt reviewing procedure in the National Credit Act the legislature let pass a golden opportunity to properly and completely revise the law regarding debt relief measures. In addition the legislature did not properly consider the relationship between debt review and other existing debt relief measures, in particular the administration order. The aim of the first part of this article is therefore to analyse administration as set out in the Magistrates Court Act and debt review as set out in the National Credit Act, and in doing so to identify certain positive and negative aspects of both these procedures. In the second part of this article a comparison between administration and debt review is drawn and suggestions for possible legal reform are made. The authors suggest that South Africa is in need of a complete reformation of its debt rescheduling measures and that the legislature should make provision for a single measure applicable to all debt rescheduling cases. With regard to the comparison drawn between administration and review, the authors highlight the main issues the legislature should, according to them, take into accordance when contemplating such a new rescheduling process

    Daar is tans geen internasionale erkende of geldige insolvensiestelsel wat toegepas kan word in die geval van die insolvensie van ’n staat nie. R egeringsamptenare en owerhede regoor die wêreld poog tans om die impak van die huidige internasionale ekonomiese krisis te versag deur gebruik te maak van verskeie kunsmatige ondersteuningsmeganismes en ekonomiese beleidsreaksies. Akademici sowel as beleidmakers pleit reeds geruime tyd vir die ontwikkeling van internasionale maatreëls ten einde so ’n internasionale ekonomiese krisis te hanteer en sodoende die herhaling en erns daarvan te beperk. ’n Doeltreffende en effektiewe insolvensiestelsel is ’n kritiese komponent van elke goed-funksionerende mark-ekonomie en die huidige debat oor ekonomiese globalisering kan ook nie geïgnoreer word nie . Die onlangse ekonomiese ondergang van Griekeland en ander Europese lande het die behoefte beklemtoon om ekonomiese aangeleenthede ten opsigte van staatsinsolvensies op ’n tydige, ordelike en voorspelbare wyse aan te spreek. Die doel van hierdie bespreking is nie om die moontlike oorsake, implikasies en oplossings vir die huidige internasionale ekonomies krisis te bespreek nie, maar om ’n oorsig van sekere aspekte met betrekking tot staatsinsolvensie te gee en die behoefte aan ’n internasionale insolvensie-raamwerk te beklemtoon. So ’n stelsel het die potensiaal om toekomstige finansiële krisisse te voorkom of minstens die impak daarvan te verlig

    Sustainable Development and the Culture of uBuntu

    Volhoubare ontwikkeling en die bewaring van die omgewing is nie een en dieselfde begrip nie. In die lig van die historiese agtergrond van die ontwikkeling van die begrip, word dit verstaan dat dit ten minste die sentrale elemente van “intergenerational and intragenerational” ekwiteit beliggaam en behels die integrasie van die drie pilare van volhoubare ontwikkeling, naamlik ekonomiese groei, die bewaring van die omgewing en sosiale ekwiteit. Hierdie artikel doen aan die hand dat kultuur as ’n vierde pilaar in die volhoubare ontwikkeling vergelyking bygevoeg moet word en kennis moet hiervan geneem word in enige poging om volhoubare ontwikkeling teweeg te bring. Die inheemse reg kultuur is in die konteks van ’n multikulturele samelewing in Suid-Afrika verseker, en moet daarom in ag geneem word in die volhoubare ontwikkeling-dialoog. Daar word voorgestel dat omdat ubuntu die kern inheemse waarde-sisteem beliggaam, dit ’n betekenisvolle rol in die bereiking van volhoubare ontwikkeling kan speel. Die idee van ubuntu word bespreek sowel as die rol wat dit alreeds in die ontwikkeling van die reg in Suid-Afrika vertolk het. Omdat kultuur sosiale gedrag inlig, moet strategieë om volhoubare ontwikkeling te implementeer in lyn wees met die heersende waardes van die betrokke gemeenskap. Terwyl dit kan werk in ’n homogene samelewing, kan daar moontlik probleme ontstaan waar daar ’n multikulturele samelewing is soos die van Suid-Afrika en hier word dit voorgestel dat harmonisering ’n oplossing mag bied. Die konsep van volhoubare ontwikkeling soos wat dit ontwikkel het moet nie geneer word nie maar moet ingelig en verryk word deur die inheemse filosofie van ubuntu. Nie alleen sou dit in die belang van volhoubare ontwikkeling dien nie, maar dit sou ook polities dienstig wees indien volhoubare ontwikkeling die Westerse sowel as die Afrika etos reflekteer en dit sou in lyn wees met die visie wat in die aanhef tot die Grondwet van die Republiek van Suid-Afrika, 1996 vervat is: ‘Ons, die mense van Suid-Afrika, ... Glo dat Suid-Afrika behoort aan almal wat daarin woon, verenig in ons verskeidenheid.

    Keeping children safe whilst playing sport: What can South Africa learn from the United Kingdom experience?

    Sportbeheerliggame het ernstige problem in die gesig gestaar met kinderbeskerming en was dikwels nie toegerus om die problem te hanteer nie. ’n Sleutelvraag was of daar van sportbeheerliggame verwag is om die problem alleen die hoof te bied en of kinder beskerming in sport deel moes uitmaak van ’n breër holistiese stelsel van kinderwelsyn wat ook ander organisaies moes insluit. Die Verenigde Koninkryk het daarna gestreef om ‘n beskermende raamwerk van kinderwelsyn dwarsoor alle sport te bewerkstellig wat deur sportbeheerliggame afgedwing word, en fokus op onderrig en opleiding van vrywilligers wat by sport betrokke is. ’n Sleutelpunt was die skepping van die Child Protection in Sport Unit binne die National Society for the Prevention of Cruelty to Children. Die Safeguarding Vulnerable Groups Act 2006 het ’n sentrale ligaam, die Independent Barring Board, later verander na die Independent Safeguarding Authority ingestel wat verantwoordelik is vir die bedryf van ’n keuring- en uitsluitingskema. Sport klubs val binne die omskrywing van “Regulated Activity Provider” en moet die status van enige persoon wat gereeld by bedrywighede betrokke is en kontak met kinders het, nagaan. Aanvanklik is die vlak van bedrywighede wat as gereelde kontak beskou is, taamlik laag gestel sodat ’n groot aantal aktiwiteite en persone binne die omskrywing sou val. Latere hersienings het voorgestel dat die vlak van bedrywighede beter omskryf en op ’n hoer vlak gestel word ten einde die proses meer vaartbelein te maak. In Suid-Afrika, bevorder Sport en Ontspanning Suid-Afrika gestruktureerde deelname aan sport- en ontspanningsbedrywighede in skole en die opheffing van sport in skole en sportklubs. Die Suid-Afrikaanse sportsektor moet ook die problem van seksuele teistering en misbruik is sport aanspreek en kan in hierdie verband gerus uit die ondervinding in die Verenigde Koninkryk leer

    Conceptualising student resilience in higher education: A scoping review

    The construct of resilience has received growing attention in the higher education literature over the past three decades. However, conceptualisations of resilience are widely varied. Since resilience has often been viewed as a fixed trait an individual either possesses or lacks, the influence of context on resilience is frequently underestimated. The purpose of this review is to gain a better understanding of how resilience is conceptualised in the broader context of higher education literature. A scoping review of the conceptualisation of resilience within higher education is provided based on the methodological framework for scoping reviews developed by Arksey and O’Malley. The scoping study method is guided by the need to identify all pertinent literature, irrespective of study design. The initial search via the EBSCO, ERIC and PsychINFO databases yielded 189 records. Altogether, 41 contributions were included in the scoping analysis. Each resource was evaluated thematically to identify key categorisations of resilience. Three overarching themes were identified, including (1) resilience as an internal construct, (2) resilience as an external or environmental construct, and (3) resilience as a malleable, growth construct. These categorisations can equip universities to design more comprehensive student support programs that do not focus on a singular interpretation of resilience. For educators, practitioners and policymakers this review highlights the need for a multifaceted approach to fostering resilience in higher education. Future research on how resilience is conceptualised specifically within an African context is recommended

    Exploring the integration of Artificial Intelligence into Geography education through a hybridised TPACK–Place–AI framework

    Since the 1960s, Geography educators have used digital technologies such as GIS and remote sensing to enrich spatial learning. The rise of artificial intelligence (AI) extends these tools by enabling transformative, data-driven, and personalised learning experiences while fostering essential 21a Century skills. However, many educators remain unaware of AI’s potential benefits and risks. Situated within South Africa’s unequal digital landscape, this study aims to raise awareness and broaden Geography educators’ understanding of effective and ethical AI integration in Geography education. It proposes a hybrid TPACKPlace- AI framework that extends the established Technological, Pedagogical and Content Knowledge model through insights from a critical pedagogy of place. The framework emphasises that AI integration must be pedagogically sound and socially responsive, foregrounding ethics, justice, power, and context. The paper thus offers a theoretical foundation for critically engaging with AI in Geography education
