    Protecting AI-generated inventions under the UK's IP regulatory regime

    The United Kingdom is one of the world's oldest and most progressive IP legal systems. UK presents one of the most pragmatic and conscientious IP legal systems when regulating unconventional technologies such as Artificial Intelligence (AI) and AI inventions. By adopting a blend of conservative and progressive approaches to AI regulation, the UK's IP legal system promises to be one of the most robust, optimal and collegial AI regulatory jurisdictions for critical legal analysis and examination. UK's regulatory and policy regime for AI and AI inventions is emerging from the multi-stakeholder and multiinstitutional consultative process in which the perspectives from eminent academics, experts from industry, state regulatory and research institutions are being solicited and synthesized. The UK is currently undertaking a consultation on the impact of artificial intelligence (AI) on intellectual property (IP) Law, specifically on patents and trade secrets. The outcomes of this consultation will help shape the UK's IP framework, ensuring it remains fit for purpose in the digital age and encourages innovation while protecting the rights of inventors and creators. The research paper critically examines the legal and economic intricacies and ramifications of the UK's quest to fashion a futuristic yet conscientious IP legal regime for regulating AI and AI-generated inventions. By adopting a doctrinal, critical legal and economic analysis approach, the research paper first examines the fitness of the UK's patent, copyright and trade secret laws for protecting AI-generated inventions to accentuate the regimental and regulatory inadequacies therein. The paper cross-examines how such regulatory inadequacies and implications are being resolved through the consultative engagements between the UK's Artificial Intelligence Office under the auspices of the UK's Intellectual Property Office and experts from academia and industry

    Victims of Cybercrimes: Are they protected enough?

    In the modern digital age, seemingly harmless online communications have transformed into sophisticated traps designed to exploit human vulnerabilities. What appears to be an unbelievably good investment opportunity, a life-changing lottery win, or a persuasive request from a stranger is often a very well-crafted scheme designed to deceive. The digital revolution in India has undoubtedly been transformative, connecting millions of people to the global network and creating unprecedented opportunities for communication and commerce. Yet, this technological progress has opened new ways for cybercriminals, who continuously evolve their strategies to target individuals across urban and rural landscapes. The impact of cybercrime extends far beyond mere financial loss. These digital crimes strike at the fundamental human need for trust, leaving victims not just monetarily damaged but also socially disoriented. Each fraudulent interaction weakens the digital ecosystem’s credibility, further creating a chain of anxiety and scepticism. This article examines the demographics most vulnerable to cybercrimes, explores the specific crimes they face, and evaluates the recourse mechanisms available to them. It also addresses systemic gaps and offers improvement solutions. By focusing on the impacts on people who are vulnerable, this analysis highlights the human cost of cybercrime and the need for strong protective measures

    Artistry of resistance: An allegorical reading of life, art and freedom in contemporary India

    Literature covering activism from a politico-cultural perspective has often discussed “art as resistance” and “art in resistance,” but very rarely does the work position “resistance as an art” (Ettinger and Virtanen 2005). Brahma Prakash’s Body on the Barricades (2023) is one such work that metaphorically places resistance as an assertive art in a political backdrop where curtailment, oppression and marginalisation continue to exist in the most unapologetic forms. The book brings in the dimension of the 2020 pandemic and its aftermath where one saw the political and social oppression intensify everywhere, and only in this given backdrop, one cannot help but rethink how the present-day oppression conjured up over the years. The “body” is experiencing breathlessness, both from a physical as well as figurative point of view. There could be several creative ways to read the book, but two significant contentions come out fairly in the end—the assertion of identities against “curtailment”-producing artistic patterns and decoding the patterns and meanings of both, the oppressor and the oppressed, including artists

Consciousness is understood without integrating with broader social and cultural situations. The understanding of consciousness also requires one’s critical understanding of social context and group processes. Law has a more significant role in demystifying itself from the brain and consciousness trajectory and keeping a balance by considering precedents critically. This article also ventures into how consciousness can be understood in the social arena of decolonization and the possibility of neuroscience in informing the law in its reformation for justice

    Crystals and Mud: The Evolution of the Transfer of Property Act in Colonial India

    Under the British, the period between 1861 and 1887 was significant for India. The government enacted several statutes concerning various substantive common law areas, and one of them was the Transfer of Property Act (hereinafter, “TPA”), 1882. With this legislative exercise, the Crown was aiming to establish its political and sovereign dominance over the Indian territory by codifying the English common law in the form of “wise, clear, and ascertainable” provisions. With such crystalline (crystal-like) provisions, the crown intended to preclude the Indian judiciary from flexibility of further development. However, this intention was not successful, and subsequently, the crystalline nature of these laws diluted. With the circumstance-based application, like equity, the TPA became a mixture of crystalline and muddy provisions

    Anti‐consumption research: A systematic literature review and research agenda

    This research aims to address the fragmented perspectives in the literature on anti-consumption by conducting a systematic literature review. The major goal is to offer an integrated and holistic understanding of the essential factors impacting consumer behavior within the anti-consumption domain. By utilizing the SPAR-4-SLR protocol, we examined 86 studies, encompassing diverse theories, contexts, characteristics, and methodologies (TCCM). A conceptual framework that outlines the antecedents, mediators, and outcomes of anti-consumption behavior was developed by combining variables in this study. The results highlight the diverse factors shaping individuals' anti-consumption behaviors, shedding light on the complex dynamics that vary across industries, cultures, and consumer segments. Additionally, this research has pinpointed neglected domains that have received limited attention in this field and put forth pioneering pathways for future research by incorporating the TCCM framework. Specifically, this research proposes potential future research directions, including exploring theories like social learning theory, behavioral reasoning theory, and self-determination theory. Furthermore, we recommend employing advanced methodologies like longitudinal studies, netnography, and neuromarketing to push the boundaries of knowledge in this field. By identifying these theoretical and methodological gaps, the study makes a substantive contribution to advancing academic inquiry and practical applications in anti-consumption research

    Link strength prediction in global financial networks using optimized BiLSTM models: A case of dynamic cross-market equity networks

    This study develops a model to forecast crossmarket linkage strengths for global stock market networks using dynamic edge weight graphs and optimized BiLSTM approach. It uses forty-three global market indices data of 14 years duration. The models are trained using historical network structure data over a series of time steps. Additionally, hyper-parameter tuning is performed to optimize performance. The model is validated using nested cross validation and are benchmarked against XGBoost and Deep Neural Network. Optimized models are experimented using multiple sets of network structures (unfiltered, filtered, low edge weighted networks) and optimum training sizes are obtained. Model trained with unfiltered networks demonstrated better relative predictability

    Higher transpiration in plant invasive species impacts soil water

    Studies on plant invasives are largely focused on their impacts on plant community structure, native biodiversity, ecosystem services, and economy, but their ecosystem effects as high water-spenders are underestimated. Here, we report contrasting results in transpiration volumes in Prosopis juliflora (Sw.) DC (Prosopis juliflora), a widespread invasive alien, its native non-invasive congener, Prosopis cineraria (L.) Druce (P. cineraria), and an unrelated co-occurring native, Azadirachta indica A. Juss. (Azadirachta indica) at 3 sites spread across North and South between 200 and 550 m elevations in India. Our results demonstrate that P. juliflora shows higher transpiration than the native P. cineraria and A. indica at all the three investigated sites. The transpiration volumes of P. juliflora were 2.9–8 times higher than P. cineraria and A. indica at Jodhpur, and 6–11 times higher than A. indica at New Delhi and Hyderabad, respectively. The soil moisture content in the rhizosphere of P. juliflora dominated sites was 2–5 times lower than that of P. cineraria and A. indica dominated sites during summer. The results clearly demonstrate that invasive species transpire more water than the natives that consequently leads to decrease in soil moisture availability. Our investigations provide a strong rationale for managing the alien invasive P. juliflora and restoring native vegetation. Controlling the invasive species is particularly important for the regions with prolonged hot summers and freshwater shortages, such as tropical Asia, Middle East and tropical Africa, where P. juliflora has invaded vast areas

    Intraday lottery demands in cryptocurrency market

    Purpose Using the high-frequency intraday data of the top 100 most liquid cryptocurrencies, this study aims to examine the presence of the MAX effect in the cross-sectional pricing of cryptocurrencies. Additionally, it delves into the pricing implications of idiosyncratic volatility (IVOL) and skewness, both idiosyncratic and systematic, across the cross-section of cryptocurrency returns and their interaction with the MAX measure. Design/methodology/approach Driven by the growing influence of high-frequency trading (HFT) in the cryptocurrency market, the study modifies Bali et al.’s (2011) MAX measure by incorporating an hourly forecast horizon and 5-min log returns from the preceding hour. The relationship between MAX, IVOL and skewness over the past hour and expected returns is examined using portfolio-level analysis and Fama and Macbeth’s (1973) cross-sectional regressions. Findings The findings indicate that an increase of one standard deviation in MAX corresponds to a 0.043% decline in subsequent returns for cryptocurrencies, suggesting overvaluation due to increased demand. These results are robust to other traditional price determinants. Untangling the MAX from other proxies of the lottery, the study reveals that MAX is the true effect in the cryptocurrency market. The results are robust to several sensitivity checks, such as varying MAX measures and holding periods. Originality/value The study pioneers the investigation of lottery-like demand within cryptocurrency markets at the intraday frequency. To the best of the author’s knowledge, this is the first paper untangling the association between MAX and IVOL in the cryptocurrency market and thus offers valuable insights into investor behavior in these emerging markets
