LA PROTECCIÓN JURÍDICO CONCURRENCIAL DE LA PROPIEDAD INDUSTRIAL
Full text linkOne of the topics covered in the Law against Unfair Competition is the application of the prohibition of unfair competition to practices consisting of the exploitation of products, services and distinctive signs protectable by industrial property rights, both in cases where they have not been protected and in those where they are in fact protected at the time the challenged practice is carried out, or where they were protected in the past. Case law has addressed this matter in accordance with the so-called “principle of relative complementarity,” initially proposed by a segment of the Scholars. This paper is dedicated to studying the legal basis of this principle, its formulation, its implications and limits, as well as the most notable groups of cases.Una de las materias del temario del Derecho contra la competencia desleal es la aplicación de la prohibición de la competencia desleal a prácticas que consisten en la explotación de prestaciones y signos distintivos protegibles por medio de derechos de propiedad industrial, tanto en los casos en que no hubieran sido protegidos, como en aquellos en los que están de hecho protegidos en el momento en que se realiza la práctica cuestionada o que lo estuvieron en el pasado. La jurisprudencia ha abordado el tratamiento de esta materia con arreglo al llamado «principio de complementariedad relativa», inicialmente propuesto por un sector de la doctrina de los autores. Full text linkThis paper analyses, from the perspective of competition law, an increasingly widespread practice in the legal sector. It is the attraction of clients through the payment of commissions to third parties.It is expressly referred to in Article 18 of the Code of Ethics of the Spanish Legal Profession of 2019, which provides that this conduct may not be carried out unless the client is informed of it. Consequently, one of the main purposes of these pages is to analyze and interpret this rule in accordance with the guidelines established in article 3.1 of the Civil Code and taking as a guiding light the requirements derived from the market rules that regulate economic competition.Este trabajo analiza, desde la perspectiva que ofrece el Derecho de la competencia empresarial, una práctica cada vez más extendida en el sector de la Abogacía. Se trata de la captación de clientela mediante el pago de primas o comisiones a terceros. A ella se refiere expresamente el Código Deontológico de la Abogacía Española de 2019 en su artículo 18, al disponer que esta conducta no podrá llevarse a cabo salvo que se informe de ella al cliente. Consecuentemente, uno de los principales propósitos de estas páginas estriba en analizar e interpretar esta norma de conformidad con las pautas que establece el artículo 3.1 del Código civil y teniendo como faro de guía las exigencias derivadas de las reglas del mercado que regulan la competencia económica
El cine de Fritz Lang y la herencia incómoda del populismo: de M (1931) a Furia (1936)
Full text linkThe article analyses the evolution of the ideas embodied by Fritz Lang in M (1931) and later reformulated in Fury (1936), exploring their relation to populism and justice in democratic contexts in crisis. Of particular note is Gabriele Tergit\u27s critique of M, pointing out its ambiguity regarding revenge and people\u27s courts in a period marked by the instability of the Weimar Republic. Lang, initially influenced by this atmosphere, shows in M a discourse that lends itself to populist readings. However, his exile and his insertion in Hollywood lead him to reformulate his vision in the subsequent Fury, where he denounces lynching and advocates institutional justice. Through a comparative analysis of the two films, the article explores the shift from a morally ambiguous position to one closer to classical liberalism, and how these ideas are marked by the political and social changes between interwar Germany and American democracy in the 1930s.El artículo analiza la evolución de las ideas plasmadas por Fritz Lang en M (1931) y reformuladas con posterioridad en Furia (1936), explorando su relación con el populismo y la justicia en contextos democráticos en crisis. Se destaca la crítica de Gabriele Tergit a M, señalando su ambigüedad respecto a la venganza y los tribunales populares, en un periodo marcado por la inestabilidad de la República de Weimar. Lang, inicialmente influenciado por esta atmósfera, muestra en M un discurso que se presta a lecturas populistas. Sin embargo, su exilio y su inserción en Hollywood lo llevan a reformular su visión en la posterior Furia, donde denuncia el linchamiento y aboga por la justicia institucional. A través del análisis comparativo de ambas películas, el artículo explora el paso de una posición moralmente ambigua hacia una más cercana al liberalismo clásico, y cómo dichas ideas están marcadas por los cambios políticos y sociales entre la Alemania de entreguerras y la democracia estadounidense de los años treinta
The Law оf Ukraine “On Media”: Ethnocultural Aspects in Public Broadcasters\u27 Official Web Resources
Full text linkLegislative norms regulating the media sphere are an important tool for ensuring freedom of speech, transparency, and access to information in modern democratic societies. Each country develops its media legislation in accordance with specific historical, socio-political, economic, and ethno-cultural factors. This article focuses solely on the ethno-cultural aspect of modern media legislation in Ukraine, Germany, and the United Kingdom, which has not yet been the subject of a specialized study. The proposed research does not claim to be exhaustive. It merely outlines general issues and proposes a methodology for studying the ethno-cultural specificity of media legislation in a comparative aspect, using public broadcasters as an example. Each country develops its own models of public broadcasting, the comparative study of which also requires separate research. The article outlines only the general features of the legislative regulation of public broadcasting in the Ukrainian, German, and British media landscapes. The application of the parametric content analysis methodology is demonstrated through examples of specific broadcasters, focusing on the adoption of the Law of Ukraine “On Media” (2022), which marked a significant milestone in the development of Ukraine’s media legal framework. A comparative parametric analysis was conducted on the presentation of information about this law in different formats on three web resources: “Suspilne. Suspilne Lviv” (Ukraine), “DeutschlandFunk” (Germany), and “BBC World Service” (United Kingdom). This analysis also highlighted ethno-cultural aspects in the presentation of information for Ukrainian and foreign audiences, which is crucial in the context of compliance with journalistic standards
La eternidad es reversible
Full text linkStarting from the contrast between natural and built spaces, the transformation and mutation of natural and rural spaces, as well as the progressive annihilation of the borders that separate architecture and urbanism from natural enclaves, a work based on the natural-artificial contrast is proposed. This duality is approached through the concepts of ‘building to destroy’ and ‘the invisible processes of transformation, substitution and destruction’.
To this end, an artistic installation is proposed in which a structure adaptable to the space in which it is placed and made up of metal profiles typical of the world of construction —props, scaffolding, beams, etc.—, and frames of different dimensions intervened on the inside, will articulate the space and contain the pictorial, sculptural and multimedia pieces. These pieces configure and modulate the structure.
In this way an installation is created as a study that deals with the antimonumental and the invisible process of the construction of our dystopian remains, delving into the relationship between ruin and architecture and the layers, strata and components that constitute the ruin-present-future. To this end, we work experimentally and from multiple disciplines with the textures, surfaces and properties of stone, which symbolises the natural and occupied territory, and of materials of a constructive nature: iron, cement, concrete, plaster, rubble, brick... typical of modern architecture, generating a narrative through contrast, transformation and the amalgamation of elements.Partiendo de la contraposición que existe entre los espacios naturales frente a los espacios construidos, la transformación y mutación del espacio natural y del mundo rural, así como la aniquilación progresiva de los bordes que separan arquitectura y urbanismo de enclaves naturales, se propone un trabajo basado en el contraste natural-artificial. Esta dualidad se aborda a través de los conceptos “construir para destruir” y “los procesos invisibles de transformación, sustitución y destrucción”.
Para ello, se propone una instalación artística en la que una estructura adaptable al espacio en la que se sitúa y que se compone de perfiles metálicos propios del mundo de la construcción —puntales, andamios, largueros, etc.— y bastidores de diferentes dimensiones intervenidos en su cara interna, articularán el espacio y contendrá las piezas pictóricas, escultóricas y multimedia. Estas piezas configuran y modulan la estructura.
De esta forma se crea una instalación a modo de estudio que trata lo antimonumental y el proceso invisible de la construcción de nuestros restos distópicos, profundizando en la relación entre ruina y arquitectura, así como en las capas, estratos y componentes que constituyen la ruina-presente-futuro. Para ello se trabaja de una forma experimental y desde múltiples disciplinas con las texturas, superficies y propiedades de la piedra, que simboliza el territorio natural y ocupado, y de materiales de carácter constructivo: hierro, cemento, hormigón, escayola, escombro, ladrillo... propios de la arquitectura moderna, generando una narrativa a través del contraste, la transformación y la amalgama de elementos

Full text linkMore and more newspapers are disappearing or being drastically reduced by hedge funds that are acquiring them. The subject of this research focuses on the business models that could be able to make a newspaper economically viable taking into account the opportunities of digital that clash with another aspect: the low trust of readers in the media and especially in online media. This exploratory, comparative and qualitative study intends to analyze the differences between local newspapers and digital natives in Spain, evaluating the choice of business models and considering how to build a relationship of trust and transparency with readers. The results of the study show that newspapers do not always take full advantage of the various digital opportunities and that the future challenges of journalism range from the transparency of branded content to the request for donations.Cada vez más periódicos están desapareciendo o siendo reducidos drásticamente por los fondos especulativos que los están adquiriendo. El tema de esta investigación se centra en los modelos de negocio que podrían ser capaces de hacer económicamente viable un periódico teniendo en cuenta las oportunidades del digital que chocan con otro aspecto: la escasa confianza de los lectores en los medios de comunicación y especialmente en los medios online. El presente estudio exploratorio, comparativo y cualitativo pretende analizar las diferencias entre los periódicos locales y los nativos digitales en España, evaluando la elección de los modelos de negocio y considerando cómo construir una relación de confianza y transparencia con los lectores. Los resultados del estudio muestran que los diarios no siempre aprovechan al máximo las diversas oportunidades de lo digital y que los retos futuros del periodismo van desde la transparencia de los branded content hasta la petición de donaciones

Apego y síntomas emocionales en familiares de adolescentes con talla baja
Full text linkCaring for an adolescent child with a medical condition such as short stature (TB) is associated with emotional symptoms. Sociodemographic factors and secure attachment may buffer them. The aim was to study factors related to emotional symptoms in caregivers of adolescents with TB. A total of 157 caregivers of adolescents with TB participated. We assessed sociodemographic variables, anxiety, depression and attachment. Many had anxious symptoms (46.90%), depressive symptoms (17.50%) and emotional distress (14.40%). Secure attachment, the presence of fewer children, the absence of chronic conditions in other children, and a lesser affectation of the child\u27s height were associated with less symptomatology. It is important to attend to the family in the process of assessment and treatment of the disease.El cuidado de un hijo adolescente con una condición médica como la talla baja (TB) se asocia con síntomas emocionales. Factores sociodemográficos y el apego seguro pueden amortiguarlos. El objetivo fue estudiar los factores relacionados con los síntomas emocionales de cuidadores de adolescentes con TB. Participaron 157 cuidadores de adolescentes con TB. Evaluamos variables sociodemográficas, ansiedad, depresión y apego. Muchos presentaron síntomas ansiosos (46,90%), depresivos (17,50%) y malestar emocional (14,40%). El apego seguro, la presencia de menor cantidad de hijos, la ausencia de condiciones crónicas en otros hijos y una menor afectación de la talla del hijo se asociaron con menor sintomatología. Es importante atender a la familia en el proceso de evaluación y tratamiento ante la enfermedad

No full textMental health care for caregivers of people with a mental disorder or psychosocial disability provides a comprehensive health plan for society, while equipping this sector with knowledge and appropriate practices to continue providing support to their family members living with a mental health problem. Method. The study had a cross-sectional design with the objective of evaluating the emotional aspects of the role of primary caregivers of young people with mental health problems attending a psychological care center in northeastern Mexico. Sixty caregivers participated with a mean age of 42.40 years (SD= 11.25). The Depression, Anxiety and Stress Scale (DASS-21) was used. Results. 21.6% of the participants presented moderate to severe depression, 25% presented moderate to severe anxiety, although extremely severe anxiety was observed in 15%, and 36.6% presented moderate to severe stress. The three variables are related to each other. In addition, significant differences could be observed between anxiety by sex groups and by socioeconomic level there are differences in the perception of depression or anxiety. Conclusions. The role of informal caregiver of a person with mental health problems not only entails physical wear and tear, but also undermines the mental health of the caregiver, mainly with symptoms of anxiety and stress, so it is important to provide this population group with coping strategies to deal with the worries they live with.La atención en salud mental de quienes cuidan a personas con un trastorno mental o una discapacidad psicosocial, permite proveer de un plan integral de salud a la sociedad, a la vez que se dota a este sector de conocimientos y prácticas adecuadas para seguir proporcionando apoyo a sus familiares que viven con un problema de salud mental. Método. El estudio tuvo un diseño transversal con el objetivo evaluar los aspectos emocionales del rol de cuidadores primarios de jóvenes con problemas de salud mental que acuden a un centro de atención psicológica en el noreste de México. Participaron 60 cuidadores con una media de edad de 42.40 años (DE= 11.25). Se utilizó la Escala de Depresión, Ansiedad y Estrés (DASS-21). Resultados. Un 21.6% de los participantes presentan depresión de moderada a severa, el 25% presenta ansiedad moderada a severa, aunque se observó ansiedad extremadamente severa en el 15%, así como el 36.6% presenta estrés de moderado a severo. Las tres variables están relacionadas entre sí. Además, se pudieron observar diferencias significativas entre la ansiedad por grupos de sexo y por nivel socioeconómico existen diferencias en cuanto a la percepción de depresión u ansiedad. Conclusiones. El rol de cuidador informal de una persona con problemas de salud mental no solo conlleva un desgaste físico, sino que merma la salud mental del cuidador, principalmente con sintomatología de ansiedad y estrés, por lo que es importante dotar a este grupo poblacional de estrategias de afrontamiento para lidiar con las preocupaciones con que viven
