Marco jurídico de las cooperativas en Cuba. Tracto histórico y realidad actual
En el presente trabajo se valora el tracto histórico por el que ha transitado el marco jurídico de las cooperativas en Cuba, identificando las limitaciones y potencialidades ofrecidas a estas formas asociativas en cada período. Se hará especial énfasis en la realidad actual, iniciada con el perfeccionamiento del modelo económico cubano, donde se constata un proceso de expansión de las cooperativas hacia otros sectores de la economía nacional además del agropecuario. Las perspectivas jurídicas de este proceso experimental en curso también serán objeto de una valoración general, teniendo en cuenta las últimas novedades legislativas en la materia cooperativa, en especial la letra de la nueva Constitución de la República de Cuba de 2019.Recibido: 25 octubre 2019Aceptado: 18 noviembre 2019Publicación en línea: 20 diciembre 2019In this paper, the historical tract through which the legal framework of cooperatives in Cuba has been traced is valued, identifying the limitations and potential offered to these associative forms in each period. Special emphasis will be placed on the current reality, initiated with the refinement of the Cuban economic model, where a process of expansion of cooperatives to other sectors of the national economy besides agriculture is observed. The European Higher Education Area: A road to the future or at way’s end?
The goal of the Bologna Process was to develop a European Higher Education Area within a decade. The goal and the process proved to be attractive, new countries steadily applied for accession, and the Bologna Process has brought about substantial reforms. At the same time, the drive and optimism of the early years has given way to more measured optimism and even a sense of disillusion as we approach the 20th anniversary of the Bologna Declaration. The article outlines six phases in the development of the European Higher Education Area and then looks at some of the main challenges the EHEA faces as it approaches its third decade. Structural reforms have been the hallmark of the EHEA, and in this area the main challenges concern implementation rather than the development of new structures even if some policy challenges also remain. In the run-up to the 2018 Ministerial conference, EHEA faced a bitter debate on the character of the EHEA itself, linked to the questions of how to foster implementation of commitments undertaken and what it means to be a voluntary process. The fundamental values on which the EHEA builds are now threatened in some EHEA members, the role of the EHEA in a global context, and its relevance and governance constitute other challenges.

Régimen de propiedad y trabajo por cuenta propia en Cuba: De 1959 a la nueva Constitución de 2019
In July 2018, the National Assembly of Cuba began the process of discussing a new draft Constitution, which was approved, by referendum, in February 2019. This Constitution is the legal-formal concretion of a whole set of social and economic transformations that have been taking place on the island since the early 1990s, with the fall of the socialist bloc. The present article carries out an analysis of the transformations that have occurred during the period in terms of property and regulation of self-employment, as well as of the new features that the new Constitution introduces in these aspects.Received: 4 April 2019Accepted: 21 June 2019Published online: 31 July 2019En julio de 2018, la Asamblea Nacional de Cuba inició el trámite de discusión de un nuevo proyecto de Constitución, cuya aprobación, mediante referéndum, se produjo en febrero de 2019. Implicaciones de la «gig-economy» en las relaciones laborales: el caso de la plataforma Uber
The rise of the gig-economy is having a significant impact on job creation all across Europe. More and more young workers are being employed in platforms such as Uber, Deliveroo or Glovo, supplementing their part-time jobs to earn additional income. This paper aims at analizing, taking the taxi-hailing company Uber as a case study, the employment status of those who offer their services through these platforms. In this respect, the article carries out a detailed assessment of the defining features of these new emerging contracts, with a focus on determining whether an employment or independent contractor relationship exists on the basis of recent judgements and administrative doctrine. The last section of the paper presents some ad hoc regulatory proposals that could weigh up the conflicting interests involved: on one hand, the need of ensuring basic social protection for platform workers and, on the other hand, the rising popularity of the gig-economy from both offer and supply approaches.Received: 15 February 2019Accepted: 21 June 2019Published online: 31 July 2019En un entorno laboral cada vez más digitalizado, proliferan en España nuevas formas de trabajo al margen del actual cuadro normativo. Así, plataformas de la «gig-economy» como Uber, Deliveroo o Glovo cuentan cada día con más «microtrabajadores» dispuestos a prestar servicios y realizar pequeños encargos. Este artículo trata de analizar, partiendo del caso de la plataforma de transporte urbano Uber, la relación que une a las plataformas digitales y a aquellos que ofrecen sus servicios en éstas. En este sentido, se analiza a partir de un análisis pormenorizado de los rasgos definitorios de estas nuevas formas contractuales, la existencia de laboralidad a la luz de los últimos pronunciamientos administrativos, jurisprudenciales y doctrinales habidos hasta la fecha. Paying court to the future – has the time for an asean trade tribunal arrived?
Con el clima global para el comercio multilateral experimentando una marcada desaceleración y el mecanismo de solución de controversias (MSC) de la Organización Mundial del Comercio bajo una fuerte tensión, la atención ha comenzado a centrarse en la priorización de las estructuras comerciales regionales. Si bien los MSC de la ASEAN han seguido tradicionalmente un camino consensuado hacia la resolución, este documento analiza las oportunidades actuales para establecer un Tribunal de Comercio de la ASEAN (TCA) permanente. Tal entidad necesitaría encajar dentro de los límites de un paso cauteloso en el desarrollo gradual del sistema de comercio de la ASEAN basado en normas, ampliando las oportunidades para utilizar el arbitraje en controversias y para proporcionar un procedimiento para garantizar una interpretación coherente de la legislación comercial de la ASEAN.Recibido: 22.10.2019 Aceptado: 21.11.2019 Publicación en línea: 31.12.2019With the global climate for multilateral trade experiencing a marked slowdown and the dispute settlement mechanism (DSM) of the World Trade Organization under severe strain, attention has started to turn to the prioritizing of regional trade structures. Although ASEAN DSMs have traditionally pursued a consensual path towards resolution, this paper discusses the current opportunities for establishing a permanent ASEAN Trade Tribunal (ATT). The Community Law of Public Contracts: An Infravalorated Pillar of the Overcoming of the Nationalism and of Construction of the European Identity
Desde la adhesión de España a las Comunidades Europeas en 1986, la legislación española de contratos públicos acepta el principio de no discriminación por la nacionalidad, abandonando el proteccionismo nacional de los contratistas presente en la legislación española. La Ley 9/2017 de Contratos del Sector Público consolida ese proceso histórico de adaptación de la legislación española de contratos públicos. En el Derecho europeo de los contratos públicos aparece una identidad europea, una «nacionalidad europea» de los contratistas nacionales de los Estados miembros.Recibido: 02 julio 2018 Aceptado: 16 julio 2018 Publicación en línea: 27 febrero 2019Since the accession of Spain to the European Communities in 1986, Spanish legislation on public contracts has accepted the principle of nondiscrimination by nationality, abandoning the national protectionism of contractors present in Spanish legislation. Law 9/2017 on Contracts of the Public Sector consolidates that historical process of adaptation of the Spanish legislation of public contracts. The compulsory character of human rights norms as a trait of european identity
En este trabajo hemos estudiado el lugar que ocupan las normas que proclaman y defienden los derechos humanos en los sistemas jurídicos tanto del Consejo de Europa como de la UE, examinando qué consenso reúnen y cómo han sido protegidas frente a posibles ataques, con objeto de dilucidar si su especial protección constituye un rasgo de la identidad europea. En este sentido, hemos podido apreciar como en los ordenamientos jurídicos de estas dos organizaciones internacionales europeas los derechos humanos se tratan de proteger de forma muy especial, haciendo coherente la proclamación que en algunas disposiciones de sus tratados constitutivos se hace de los derechos humanos como uno de los valores esenciales de esas organizaciones internacionales. Además, el conjunto del resto de mecanismos jurídicos existentes en el marco del derecho del Consejo de Europa y de la UE para la protección de los derechos humanos ofrece esa misma imagen global de una intención por parte de los Estados miembros de estas organizaciones de situar a las normas proclamadoras y protectoras de los derechos humanos por encima de la voluntad de los Estados, o lo que es lo mismo, creando una especie de derecho imperativo europeo, con lo que quizá podamos concluir que el carácter imperativo de los derechos humanos es uno de los rasgos característicos de la identidad europea.Recibido: 02 julio 2018 Aceptado: 05 septiembre 2018 Publicación en línea: 27 febrero 2019In this paper, we have studied the place that the norms that proclaim and defend human rights occupy in the juridical systems of the Council of Europe and the European Union, looking for their consensus and how they have been protected, aiming at determining whether their protection is a constituent trait of the European identity or not. In this sense, we have realized that both juridical systems try to protect human rights in a very special way, thus making credible the fact that in some provisions of their constituent treaties it is affirmed that human rights are part of the fundamental values of those organisations. Moreover, the remaining juridical mechanisms set up in order to protect human rights in the EU and the Council of Europe show the intention of their member states to place the norms that proclaim and protect human rights above the singular will of states. Therefore, the member states intent to create a sort of peremptory norms, something that allow us to conclude that the peremptory character of human rights norms is a constituent trait of the European identity.Received: 02 July 2018 Accepted: 05 September 2018 Published online: 27 February 201
British Values and Principles as Part of the European Identity through the Council of Europe
La decisión del Reino Unido de abandonar la Unión Europea ha comportado numerosas críticas al Reino Unido por su euroescepticismo. Sin embargo, desde este trabajo argumentaremos que, especialmente, justo después de la Segunda Guerra Mundial, el Reino Unido estuvo y continúa estando profundamente comprometido con la unidad europea y su institucionalización. El Reino Unido siempre defendió un modelo institucional de carácter intergubernamental, respetuoso con la soberanía nacional de los estados y acorde con el marco institucional de la comunidad internacional. Este modelo es el que finalmente prosperaría en el Congreso de la Haya y posteriormente, quedaría plasmado en el Consejo de Europa. Además del modelo institucional, el Reino Unido inspiró e impulsó la adopción de principios y valores británicos, intensamente defendidos en la Segunda Guerra Mundial, que hoy forman parte de la identidad europea, como son el parlamentarismo, la democracia o el respeto a los derechos humanos. Asimismo, argumentaremos que Europa es mucho más que la Unión Europea y que otras organizaciones, como el Consejo de Europa realizan una tarea extraordinaria a la hora de impulsar, consolidar e implementar los llamados valores y principios europeos. En este sentido, todos los modelos para una Europa unida son igualmente válidos. No sólo aquellos que defienden el modelo federalista deben ser considerados europeístas, también aquellos que defienden un modelo intergubernamental deben ser considerados europeístas.Recibido: 02 julio 2018 Aceptado: 14 septiembre 2018 Publicación en línea: 27 febrero 2019The decision of the United Kingdom to withdraw from the European Union has raised considerable criticism by those who consider the United Kingdom to be Eurosceptic. However, this paper argues that, particularly after the Second World War, the United Kingdom was and continues to be deeply committed to the unity of Europe and its institutionalisation. The United Kingdom has always supported an institutional model of an intergovernmental nature, respectful of the national sovereignty of the states and in accordance with the institutional framework of the international community. This model was the one that thrived in the Hague Congress and later was set down in the Council of Europe. In addition to the institutional model, the United Kingdom inspired and promoted the adoption of British principles and values, intensely defended in the Second World War, which today form part of the European identity, such as parliamentarism, democracy or respect for human rights. It also argues that Europe is much more than the European Union and other organisations, such as the Council of Europe, carry out an extraordinary task when it comes to promoting, consolidating and implementing the so-called European values and principles. In this sense, all models for a united Europe are equally valid. Inclusión democrática e igualdad política en una Dêmoicracia europea en transformación
The article holds that the main threat to the construction of a common Europe after the multidimensional crisis that began in 2008 is the loss of citizens’ democratic status. Section I introduces a non-exhaustive description of the crisis of democracy in Europe stating that, even if it initially was an economic crisis, it has had echoes on other areas. Even if the transversal explanatory factor of this phenomena is the increase of inequalities, the cause of the crisis of European democracy are not these inequalities but their effect: the appearance of an increasing political precariat. Section Two focuses on analysing the sense in which this new subject represents the crisis of democracy in Europe: their exclusion from the interest weighting process violates the basic principles of political equality and democratic inclusion. Section Three proposes that, even if the answer should necessarily be European, the traditional federal and sovereigntist alternatives do not provide an adequate theoretical perspective. The dêmoicratic option, in turn, accepts descriptively reality as it is, i.e. without denying the existence of national political facts, while it also keeps the normative aspiration of building shared decision-making frameworks for the construction of democracy in Europe.Received: 26 January 2018Accepted: 18 February 2019Published online: 30 April 2019Este artículo sostiene que la principal amenaza para la construcción de una Europa común tras la crisis multidimensional iniciada en el 2008 es la pérdida de estatus democrático de la ciudadanía. El artículo parte de una descripción no exhaustiva de la crisis de la democracia en Europa afirmando que, si bien tuvo por origen la crisis económica, ha tenido ecos en otras áreas. Siendo el incremento de las desigualdades un factor explicativo transversal, la causa de la crisis de la democracia no son estas desigualdades, sino su efecto: la aparición de un creciente precariado político. La segunda sección analiza en qué sentido este nuevo sujeto representa la crisis de la democracia en Europa: su exclusión del proceso de ponderación de intereses vulnera los principios básicos de igualdad política e inclusión democrática. La tercera sección plantea que, si bien la respuesta ha de ser europea, las alternativas tradicionales federal y soberanista no ofrecen la perspectiva teórica adecuada. La opción dêmoicratica, por el contrario, acepta descriptivamente la realidad como es, i.e. sin negar la existencia de hechos políticos nacionales, a la par que persiste en la aspiración normativa de continuar trabajando en común por la construcción de la democracia en Europa.Recibido: 26 enero 2018Aceptado: 18 febrero 2019Publicación en línea: 30 abril 201
