La democrazia e l’educazione, valori cooperativi per i giovani
No full textThe title of the presentation deals with the relations between cooperatives and young people and, more specifically, between the co-operative values and young people. We will discuss the relationship between the cooperative values and young people, as long as they are co-operative values of democracy and education. We will try, in fact, to highlight the diverse nature of the cooperative compared to other forms of business because they carry in their DNA democracy and education, and both should be at the same time, an attraction for young people to get closer to the cooperative world.

Parleremo dei rapporti tra i valori cooperativi e i giovani, alla cui base stanno i valori di democrazia ed educazione. Cercheremo, infatti, di evidenziare la diversa natura della cooperativa rispetto ad altre forme di impresa perchè, esse portano nel loro DNA la democrazia e l’ educazione, ed entrambi dovrebbero essere, allo stesso tempo, un’attrazione affinché i giovani possano avvicinarsi al mondo cooperativo.

No full textThis article aims to show how the contributions of the ECG, the incorporation of the values of the Social economy to the functioning of the economic system and the deepening of democracy are indispensable tools for the construction of a new economic model, which aimed to transform the economic, social and political reality, serve the interest of the society as a whole and the human development, analyzing how we can redirect the economy and society towards a more just model through the implementation of a paradigm shift in our economic activities.

Euskal kooperatiben gardentasun publikoa: aurrerapausoak eta erronkak
No full textLas cooperativas constituyen la alternativa óptima en nuestra Comunidad para combatir las consecuencias de la crisis global, fruto del sistema capitalista imperante. Eso creen, al menos, varios expertos, argumentando que disponen de capacidades para llenar los espacios de exclusión que se han visto agravados y mejorar la prestación de aquellos servicios públicos comprometidos por la misma. Empero, en aras de que los ciudadanos también apoyen dicha idea, las cooperativas deben pasar a exponer el ejercicio que han desarrollado, generalmente, de forma justa y responsable, ya que, por no haber sido conscientes de su importancia quizá, el desafío por la transparencia pública ha ocupado un segundo plano en su seno. Así pues, partiendo de las iniciativas legislativas estatal y autonómicas, el presente artículo analiza las obligaciones que las cooperativas vascas podrían tener en el ámbito de la transparencia. Y es que las imprecisiones y lagunas que se aprecian al respecto evidencian la necesidad de confeccionar un marco estratégico específico, sin olvidar, eso sí, el compromiso que las propias cooperativas deben asumir.
Recibido: 22 octubre 2015Aceptado: 30 noviembre 2015Cooperatives are the best alternative in our community to fight the consequences of the global crisis, prevailing capitalist system’s result. At least, some experts believe it, arguing that they are able to both fill the exclusion spaces that have been aggravated and improve the delivery of public services compromised by it. However, for having citizens’ support too, cooperatives should start proving that their usual practices are as fair as responsible, because, perhaps, for not have been aware of its importance, the challenge of public transparency has taken second place in their midst. Thus, basing on the state and regional legislative initiatives, this paper analyzes the obligations the Basque cooperatives could have on transparency’s area. In fact, the inaccuracies and gaps that can be seen about state the need to implement a specific strategic framework, taking always into account the compromise that cooperatives themselves must assume.

Es un artículo abierto al debate para que se puedan proponer soluciones y alternativas que mejoren puntos concretos de la regulación del sistema cooperativo.

It is a response to the relationships that cooperatives have both with governments in certain countries and with different private organisations in search of external financing, in order to preserve their autonomy and their form of democratic management.

Panorama das cooperativas de crédito no Brasil
No full textThis study presents an overview of the reality of Brazilian credit cooperatives from its rural and solidary origins to its current process of banking its activity to the detriment of the human and social aspects that guide every cooperative enterprise. While discussing the consolidation of the legal bases of credit cooperative societies in Brazil, this essay seeks to identify the transformation of Brazilian credit cooperative thinking, currently tending to a process of «companization» of its legislation and functioning. At the end, based on examples and normative highlights, the risks of this phenomenon are reflected on the perspectives of credit unions in the light of the cooperative identity.

Notes on the autorithy of res iudicata in the European Court of Justice case law
No full textEl principio de seguridad jurídica tiene, como una de sus manifestaciones características, dentro del Estado de Derecho, la fuerza de cosa juzgada (res iudicata) que se atribuye a las sentencias o resoluciones judiciales equivalentes firmes, y que implica tanto su impugnabilidad como su potencial influencia en litigios posteriores que guarden una conexión con el asunto ya resuelto en firme. Sin embargo, es posible que estas decisiones judiciales firmes de jueces nacionales, por diversas causas (error, omisión, interpretación manifiestamente contraria, etc.) vulneren el Derecho de la Unión Europea y, por tanto, afecten tanto a su primacía como a su efectividad en sus relaciones con los ordenamientos jurídicos nacionales. El Tribunal de Justicia ha tenido oportunidad de enfrentarse al dilema de ponderar el principio de fuerza de cosa juzgada con las primacía y efectividad del Derecho de la Unión en diversas sentencias. Este trabajo tiene como objetivo realizar una aproximación y revisar la jurisprudencia más importante al respecto hasta la actualidad.
Recibido: 09 noviembre 2020Aceptado: 17 mayo 2021The principle of legal certainty has, as one of its characteristic manifestations, within the rule of law, the force of res judicata that is attributed to the final judgements or equivalent resolutions, which imply that it is not impugnable and also its potential influence on other cases with a connection to the matter already settled. However, it is possible that these final judicial decisions of national judges, for various reasons (error, omission, a manifestly contrary interpretation, etc.) violate the European Union law and, therefore, affect both its primacy and effectiveness in the relations with national legal systems. The European Court of Justice had the opportunity to confront the dilemma of balancing the principle of res judicata with the primacy and effectiveness of EU law in several cases. This work aims to develop an approximation and review of the most important cases related to this balance until today.

Grouping between cooperatives in Mexico through their laws
No full textLa historia de nuestro país refleja claramente la historia de las cooperativas en México. Desde sus inicios en el México independiente el movimiento cooperativo ha tenido altas y bajas, apoyado mayor o menormente por nuestros gobiernos, sin embargo, actualmente con la entrada en vigor del modelo neoliberal se observa un abandono del cooperativismo por no ser compatible con ese modelo y aun cuando la legislación cooperativa se ha modificado especialmente en el rubro de los organismos cooperativos, el cooperativismo en México se encuentra estancado.

The history of our country clearly reflects the history of cooperatives in Mexico. Since its inception in independent Mexico the cooperative movement has had ups and downs, supported to a greater or lesser extent by our governments, however, currently with the entry into force of the neoliberal model there is an abandonment of cooperativism because it is not compatible with that model and even though cooperative legislation has been modified especially in the area of cooperative organizations, cooperativism in Mexico is stagnant.

El principio de cooperación entre cooperativas. Consecuencias jurídicas y económicas derivadas de su aplicación práctica en Costa Rica
No full textCooperative integration has many manifestations and forms, in this contribution the study of the life of three types of second-degree cooperative organizations known as federations, unions and auxiliary organizations of cooperativism or cooperative consortia has been chosen. The reader will find references to sources related to the constitution, evolution and problems of normative interpretation that are resolved by the National Institute for Cooperative Development. The informative sources are taken from the records of the statutes and their reforms, the Assemblies, legal opinions and some data from the pages that appear on the web.

No full textThe process of European integration has evolved through crises of governance towards ever greater integration of the societies of the participating member states, giving rise to new questions about the political organization of the European continent. At the same time, European societies have become ever more diverse, giving rise to new and complex problematiques of coexistence. Europe must now also deal with the consequences of an economic model based on the consumption of finite resources. Beyond specific crises and events, Europe is therefore faced with a multifaceted challenge of ecological, democratic and societal sustainability. To approach the challenges from the point of view of sustainability means to see the ecological, democratic and societal long-term viability of Europe as made possible by the continuous reconstruction of European societies through innovative cultural, social, economic and political practices under the ecological constraints posed by the limits of our planet.El proceso de integración europea ha evolucionado a través de crisis de gobernanza hacia una integración cada vez mayor de las sociedades europeas, provocando nuevas preguntas sobre la organización política del continente europeo. A la vez, las sociedades europeas se han hecho más diversas, haciendo surgir nuevos y complejos problemas de coexistencia. Ahora, Europa también debe gestionar las consecuencias de su modelo económico basado en el consumo de recursos finitos. Más allá de crisis y acontecimientos específicos, Europa se enfrenta, por tanto, a un desafío multifacético de sostenibilidad ecológica, democrática y social. Abordar los desafíos desde el punto de vista de la sostenibilidad significa ver la viabilidad ecológica, democrática y social a largo plazo de Europa como posible gracias a la reconstrucción continua de las sociedades europeas mediante prácticas culturales, sociales, económicas y políticas innovadoras, dentro de las limitaciones ecológicas definidas por los límites de nuestro planeta
