Emergency remote teaching and learning during COVID-19 pandemic: Efficacy of a four-stage model
The COVID-19 pandemic created the need for a global change in tertiary education. Universities that traditionally relied on contact with students in physical classrooms were forced to consider modes of remote teaching to mitigate the risks of infection due to physical proximity. This study evaluates the emergency remote teaching implemented within the Department of Information Technology at the Durban University of Technology, South Africa. An emergency remote teaching model with four stages consisting of: preparation, synchronous and asynchronous teaching and learning, e-assessments and reflections are described, analysed and evaluated with reference to both lecturers and students. The evaluation is performed using both qualitative and quantitative research methods. Qualitative analysis was performed on 29 sources using content analysis. 229 initial codes were identified and first categorized into 13 subcategories and finally to the four categories synonymous with the adopted four-stage emergency remote teaching model: preparation (135 references), asynchronous and synchronous teaching and learning (67 references), e-assessments (25 references) and reflections (8 references). Quantitative data on the use of the learning management system from 2019 to 2020 evaluated the results of the applied changes in practice. From the results, it was evident that students and lecturers invested much time in the learning management system with 13 tools being adopted by the 49 analysed subjects. The learning management system was used extensively for communication, assessment and dissemination of subject content. The comparative results of the data from the 2019 and 2020 academic years showed that the majority of the 2020 subjects’ final results were statistically higher than the 2019 results. Results of analysis revealed the success of the implementation of the four-stage emergency remote teaching model.

Revealing invisibility: Interpreting social and behavioral aspects of the Coronavirus pandemic through student documentary photography
Life for the population in the Czech Republic came to a standstill in spring 2020 due to measures enacted in relation to the Coronavirus epidemic: a travel ban and closed borders, the cancellation of physical lessons at all types of school, the closure of stores except those securing basic necessities, radical restrictions to free movement of people. This unprecedented situation became the inspiration for creative work by students at the Studio of Advertising Photography at Tomas Bata University in Zlin. Since joint work in the studio was not possible, the students were given their assignments as part of the Digital Photography classes in the form of a document reflecting the social situation during the Corona crisis. Selected visual narratives, or photo novellas, are a methodical component of arts-based research, meaning the use of art artefacts and imagination for a more complete knowledge of this mode of social reality. Verbal commentary complements the images’ topic by interpreting the main themes of the selected photographic images: Easter festivities without religious services, sewing facemasks and covering faces, newly discovered meanings of borders and emptiness, the social role of meals in family life. The Coronavirus crisis has revealed the hidden opportunities of a new way to see and discover again how to evaluate our everyday life, something which in the haste of each ordinary day can become subconscious routine.

La efectividad del Protocolo n.º 16 al Convenio Europeo de Derechos Humanos y su potencial impacto constitucional en España
This essay tackles Protocol No. 16 to the ECHR as a positive instrument for judicial dialogue and effective multilevel protection of fundamental rights. Such approach is emphasized in Part I, together with the praxis of the ECtHR’s advisory jurisdiction since the entry into force of Protocol No. 16 on 1 August 2018. Part II examines the virtuality and effectiveness of Protocol No. 16 in Spain by criticizing, on the one hand, Spain’s incomprehensible reluctant position towards the acceptance of the Protocol and, on the other hand, its potential indirect constitutional impact on our country. Part III focuses on the projection of Protocol No. 16 within the European Union and on the need to articulate the triple relationship between the ECtHR, the CJEU and the National Courts. Finally, Part IV includes some final conclusions and proposals aimed at underlining the role of Protocol No. 16 as an optimisation vector of the constitutional fundamental rights system in Spain.

Dicha aproximación se enfatiza en la parte I, junto con la praxis de la jurisdicción consultiva del TEDH desde la entrada en vigor del Protocolo n.º 16 el 1 de agosto de 2018. En la parte II se examina la virtualidad y efectividad del Protocolo n.º 16 en España criticando, de un lado, la incomprensible posición española reticente hacia la aceptación de dicho Protocolo y, de otro lado, su potencial impacto constitucional indirecto en nuestro país. La parte III pone el foco de interés en la proyección del Protocolo n.º 16 en el seno de la Unión Europea y en la necesidad de articular la triple relación entre el TEDH, el TJUE y los tribunales nacionales. Por último, la parte IV incluye unas conclusiones y propuestas finales tendentes a subrayar el papel del Protocolo n.º 16 como vector de optimización del sistema constitucional español de derechos fundamentales.

La editorial Atelier ha publicado esta colectánea de textos, del profesor Pablo Sánchez-Ostiz –previamente publicados, con excepción del estudio introductorio y el capítulo referido a la culpabilidad–. En esta contribución, el lector tiene la oportunidad de acceder a una serie de temas relacionados con el estudio de la Parte Especial. Su autor expone en este trabajo la necesidad de abordar un análisis de esa parte del Derecho Penal en base a la necesidad de estructurar y organizar los delitos con arreglo a criterios que los cohesionen (o los unan). No se trata de un libro sobre la Parte Especial en sentido clásico, pues ni se estudian ni se analizan los comportamientos delictivos de manera sistemática o de forma tradicional; por el contrario, el lector encontrará en este trabajo una propuesta sobre el correcto estudio de esa Parte del Derecho Penal
La fragilidad del derecho fundamental a la protección de datos personales del menor ante la exposición de su vida personal y familiar en la red: De la necesidad de nuevos mecanismos y garantías legales
The legal protection of minors when parents share their personal data on social networks is a challenge for 21st century law. The current immersion in the Information Society encourages people to share, with increasing frequency, aspects of their private lives on these online platforms. In this new context, we notice the existence of a certain number of parents who are influencers whose professional activity consists of sharing –with global reach– on the Internet and social networks fragments of their lives in order to promote products and services, or rather, a large number of them expose the lives of their minor children in exchange for a certain economic benefit; furthermore, it is worth noting that a certain number of parents allow the minor to carry out this occupation. This being the case, we wonder whether the legal system contemplates mechanisms to protect minors and safeguard their rights in the event that the parents do not act in the best interests of the minor.
Received: 13.09.2022Accepted: 11.12.2022La protección jurídica del menor cuando los progenitores comparten datos personales del mismo en redes sociales se presenta como un reto para el Derecho del siglo xxi. La actual inmersión en la Sociedad de la información incita a las personas a compartir, cada vez con mayor frecuencia, aspectos de la vida privada en estas plataformas online. En este nuevo contexto, advertimos la existencia de un determinado número de padres y madres influencers cuya actividad profesional consiste en compartir –con alcance global– en Internet y redes sociales fragmentos sobre su vida con el fin de promocionar productos y servicios, antes bien, un gran número de los mismos, revelan la vida de sus hijos e hijas menores de edad a cambio de un determinado beneficio económico. Más aún, cabe contemplar, que un determinado número de progenitores permiten que el propio menor ejerza tal ocupación. Así las cosas, nos preguntamos si el ordenamiento jurídico contempla mecanismos a efectos de proteger al menor y salvaguardar sus derechos para el caso en el que los progenitores no actúen en atención al interés superior de este.

Los Objetivos de Desarrollo Sostenible (ODS): Hacia un nuevo contrato social intra e inter-generacional
The Sustainable Development Goals (SDGs) proclaimed by United Nations in 2015 are aimed at being the road map of the international community to achieve a necessary balance between economic growth, social justice, and the protection of the environment. Without a doubt, the fight against climate change is the most urgent goal in this uncertain beginning of a new century. In spite of some achievements, the truth is that the global pandemic of Covid-19, the war of aggression in Ukraine, and the climatic emergence are having devastating effects on SDGs. A renewed commitment and higher political will are necessary to meet the expectations of humankind.
Received: 30.09.2022Accepted: 21.11.2022Los Objetivos de Desarrollo Sostenible (ODS) proclamados por las Naciones Unidas en 2015 pretenden servir de hoja de ruta de la comunidad internacional para lograr un más que necesario equilibrio entre el crecimiento económico, la justicia social y la protección del medio ambiente. Sin ninguna duda, la lucha contra el cambio climático es el objetivo más urgente en este incierto comienzo de siglo. A pesar de algunos logros en objetivos concretos, lo cierto es que la pandemia global del Covid-19, la guerra de agresión en Ucrania y la emergencia climática están teniendo efectos devastadores en la consecución de los ODS. Hará falta un mayor compromiso y una mayor voluntad política si queremos estar a la altura de las exigencias que tiene planteadas ante sí la humanidad.

A partir de las revoluciones liberal-burguesas de finales del siglo XVIII, como bien se sabe, se fueron imponiendo de modo progresivo las consecuencias organizativas del principio democrático, ampliando el círculo de los electores e incrementando el peso de los parlamentos. La democratización del poder, la inserción del pluralismo en el Estado y la configuración de éste, en muchos casos, a modo de Estado descentralizado políticamente, permitió a su vez, al menos en ciertas constituciones de Europa, configurar la solidaridad como principio jurídico sustentador del nuevo orden, de un renovado Estado territorialmente descentralizado, social y democrático de Derecho

El derecho humano a la vivienda entre la población inmigrante en España
The article presents an analysis of immigrants’ access to housing in Spain from a human rights perspective. This population resides in practically all Spanish neighborhoods and municipalities, although they tend to concentrate in areas of cheap and degraded housing that end up being stigmatized by the native population. Immigrants find it particularly difficult to access decent housing, mainly because of their precarious economic situation, the absence of effective public policies, and racist attitudes on the part of homeowners and tenants. Regarding this last point, we propose an analysis based on three stages for/levels of the study of social exclusion: the State, the market and civil society (macro, meso and micro) in order to observe the influence that each of these agents has on the fulfillment of the human right to housing experienced by the immigrant collective in Spain.
Received: 02 February 2022Accepted: 31 May 2022El artículo presenta un análisis sobre el acceso a la vivienda de los inmigrantes en España desde una perspectiva de los derechos humanos. Este colectivo que reside en barrios y municipios españoles tiende a concentrarse en determinadas zonas de viviendas baratas y degradadas y que, consecuentemente, terminan siendo estigmatizadas por la población nativa. No en vano, los inmigrantes encuentran especiales dificultades para acceder a una vivienda digna por una serie de cuestiones, pero, fundamentalmente por una situación económica precaria derivada, en algunos casos, de la ausencia de políticas públicas eficaces y de las actitudes excluyentes por parte de los propietarios y arrendatarios de vivienda. Sobre este último punto, se propone un análisis a tres niveles para el estudio de la exclusión social: el Estado, el mercado y la sociedad civil, (macro, meso y micro) para observar así la influencia de estos agentes en el grado de cumplimiento del derecho humano a la vivienda que experimenta el colectivo inmigrante en España.
