    Creation, Development and Impact of the General Principles of Community Law: Towards a Jus Commune Europaeum?

    The aim of this research is two-fold. First, the general principles of Community law are analyzed as ”legitimacy principles” which permit the European Court of Justice to review the acts of the institutions and the Member States. Second, the basic assessment is to reckon the general principles of Community law as effective tools for the building of a jus commune europaeum when they ”travel back" to the national legal systems. The creation of this common law is realized in the administrative and constitutional areas. Indeed, following an etiological approach, the general principles of Community law can be divided into three main groups: the administrative principles (such as proportionality and legitimate expectations), the due process principles which constitute “hybrid principles” as they are imbued with administrative and constitutional values (such as the right to be heard), and, finally, fundamental rights

    År 1996 prövades i Frankrike ett fall som gällde användningen av varumärket PAYLINE. Käranden med hemvist i Frankrike och svaranden med hemvist i Tyskland var båda behöriga innehavare av det aktuella varumärket i sina respektive länder. Det påstådda intrånget bestod i att svaranden använt varumärket på en webbplats med den tyska domänadressen brokat.de, belägen på en server i Tyskland, som var åtkomlig från Frankrike. När målet kom upp till prövning ställdes den franska domstolen bland annat inför den internationellt processrättsliga frågan om domstolen var behörig att ta upp målet om det tyska företagets användning av varumärket till prövning. Det rör sig här om en fråga om domsrätt som inte har ett självklart svar. Den franska käranden kan argumentera för att fransk domstol måste vara behörig att ta upp målet till prövning. Det rör ju, om än indirekt, skyddet för franska varumärken. Den tyska svaranden kan lika lätt finna argument mot fransk domsrätt. Det handlar ju om ett tyskt företags användning av ett tyskt varumärke, på tyskt territorium, där ingen avsikt funnits att rikta sig mot den franska marknaden. En talan riktad mot sådan användning måste prövas i Tyskland. Argumenten går uppenbarligen isär och i denna intressekonflikt illustreras detta arbetets centrala problem

    The texts in this book are based on a selection of the paper presentations and Keynote lectures held during the Centre for Scandinavian Studies Copenhagen – Lund’s (CSS) second biannual international conference in the field of Scandinavian Studies.  The conference took place in Lund, at the joint Faculties of Humanities and Theology of Lund University between May 16-18, 2019.  This year’s theme was “Scandinavian Languages and Literatures Worldwide – Prospects and Challenges” and the central topics being researched and discussed were: Scandinavian Literature in the World Translations of Scandinavian Literature Scandinavian Children’s Literature in the World Linguistic and literary constructions of the North The Framing of Scandinavian Studies Worldwide Nordic Languages in the World / World Languages in the Nordic Countries The conference had three Keynote lectures: Språk och psykologiskt lokalsinne, by Sigrid Combüchen (Author and former Senior Lecturer at the Centre for Languages and Literature, Lund University) [see below] Region.     The text and software experiments on international law and technology collected in this volume produce an irritating echo. It is an irritating echo because, at times, the algorithmic attempts to modify, create, and translate legal texts reveal residual traces of reality which rigorous and systematic legal processes aimed to eradicate. Conversely, it is also irritating because, at times, the algorithmic engagement with law surpasses the lawyer’s desire to reduce reality into legal form by ruthlessly succeeding with the expulsion of any non-technological elements from the realm of legal language.     Sofi Qvarnström var lektor i retorik vid Lunds universitet. Hon avled i augusti 2018. Hon var en person som berörde många, både som akademiker och som medmänniska. Berättelser, retorik och medier samlar elva texter skrivna av vänner och kollegor till Sofi. Texterna tar sina utgångspunkter i hennes forskningsintressen, hennes lärargärning och i de existentiella frågor som väcks i samband med att en närstående rycks bort. Boken är indelad efter Sofis teoretiska infallsvinklar och hennes empiriska intressen. I bokens första del behandlas berättandet – såväl de berättelser vi delar med våra medmänniskor och berättandets retorik i sakprosa och bilder. Bokens andra del behandlar medier och retorik, dels hur medieformer påverkar det som kommuniceras i dem, dels retoriska principer för argumentation. I bokens avslutande del behandlas teman från moderniseringen av Sverige. Här får vi ta del av diskussioner om litteraturen och scenkonsten i förhållande till kvinnokampen, och om betydelsen av före- och framställningar om Norrland

    History of Photography in the Nordic Countries: A reasoned bibliography of sources and history of photography research for the period from 1839 to 1865

    The present reasoned bibliography was published in Swedish in 1990 as part of a series of reports issued by Linköping University, Arbetsrapporter från Tema Kommunikation, as number 1990:4 in the series. It gained some diffusion among history of photography specialists in the Nordic countries, but was never printed. In the thirty years that have passed since then, no new and comprehensive reasoned bibliography of the earliest Nordic history of photography has been published. There are therefore reasons for making the bibliography available in a digital format, in Swedish as well as in English. The survey is structured such that each country is dealt with separately, and the sources divided into contemporary sources, later publications, and research. The presentation of contemporary sources – unprinted sources, commentary in newspapers and periodicals, and manuals from 1839-1865 – still constitutes a current overview from each Nordic country. The presentation of later publications, however, goes no further than 1990. The infrastructure and focus of research have changed radically over the past three decades. Rather than updating the bibliography with research literature from the current era, I have chosen to present it as a historiographic snapshot from 1990. That will allow it to serve as a starting point for other research overviews with current assumptions and perspectives
