Tourism planning in Bolivia.
No full textTourism is one of the most important economic sectors in the national and international economies. But being under the scrutiny of international competition, improving competitiveness is essential to keep Bolivia among the preferences of the issuing markets. The sustainable development of the sector will be a decisive factor because the resources that allow the development of this activity are mainly human, natural and cultural. The research has a qualitative approach and is complemented by the quantitative one, where the qualitative data was obtained from documentary sources and therefore secondary; and the quantitative data refer to the evolution of the tourism sector and competitiveness. Accordingly, it has been identified that Bolivian tourism competitiveness has not improved significantly due to the performance of the tourism system and the sectoral planning system, which does not have a sustainable development approach. In this perspective, the research enabled the creation of a model that has been called sustainable competitiveness, which aims to explain the interdependence of different categories that are part of this model, which can serve as a reference for the authorities and actors involved to the development of future sectoral development plans. Since the categories of the model are highly complex, it is considered that this research presents in a didactic and referential way the dimensions, components, parts and factors that are part of the tourist activity.El turismo es uno de los sectores económicos de mayor importancia en las economías nacional e internacional. Pero al estar bajo el escrutinio de la competencia internacional, mejorar la competitividad es esencial para mantener a Bolivia entre las preferencias de los mercados emisores. El desarrollo sostenible del sector será un factor decisivo debido a que los recursos que permiten el desenvolvimiento de esta actividad son principalmente humanos, naturales y culturales. La investigación tiene un enfoque cualitativo y se complementa con el cuantitativo, donde los datos cualitativos fueron obtenidos de fuentes documentales y por lo tanto secundarias; y los datos cuantitativos están referidos a la evolución del sector turístico y la competitividad. Conforme a ello, se ha identificado que la competitividad turística boliviana no ha mejorado de manera significativa debido al desempeño del sistema turístico y el sistema de planificación sectorial, que no tiene un enfoque de desarrollo sostenible. En esta perspectiva la investigación posibilitó la conformación de un modelo que se ha denominado de competitividad sostenible, que pretende dar una explicación sobre la interdependencia de diferentes categorías que forman parte de este modelo, el cual puede servir de referencia a las autoridades y actores involucrados para el desarrollo de futuros planes de desarrollo sectorial. No full textThis thesis research work has been generated from the analysis carried out by the Ministry of Government through its General Directorate of Legal Affairs, regarding the hierarchical resources, which originate from the administrative sanctioning procedures initiated by the General Directorate of Migration against foreign citizens and legal entities that have a relationship with the migratory movement. With the understanding that, this hierarchical entity brings together in its structure various Vice-Ministries (Vice-Ministry of Internal Regime and Police, Vice-Ministry of Social Defense and Controlled Substances and Vice-Ministry of Citizen Security) and Directorates (General Directorate of Migration, General Directorate of Penitentiary Regime , General Directorate of Registration, Control and Administration of Seized Assets and General Directorate of Collections); It is evident that it does not have a specialty in matters of immigration sanctions, this aspect being essential when resolving hierarchical appeals, since the expulsion measure affects the human rights of migrants, which are developed and protected by international spheres, and must Therefore, due process must be complied with in its aspect of due foundation, which is required by the Political Constitution of the State, immigration regulations and jurisprudence issued by the Plurinational Constitutional Court. A similar situation occurs in the case of legal entities, since by affecting their assets with the fines imposed by immigration sanctions, it is imperative to comply with said principle.El presente trabajo investigación de tesis, se ha generado a partir del análisis que efectúa el Ministerio de Gobierno a través de su Dirección General de Asuntos Jurídicos, respecto a los recursos jerárquicos, que se originan de los procedimientos administrativos sancionatorios que inicia la Dirección General de Migración contra ciudadanos extranjeros y personas jurídicas que tienen relación con el movimiento migratorio. En el entendido de que, este ente jerárquico aglutina en su estructura a diversos Viceministerios (Viceministerio de Régimen Interior y Policía, Viceministerio de Defensa Social y Sustancias Controladas y Viceministerio de Seguridad Ciudadana) y Direcciones (Dirección General de Migración, Dirección General de Régimen Penitenciario, Dirección General de Registro, Control y Administración de Bienes Incautados y Dirección General de Recaudaciones); evidenciándose que, no ostenta una especialidad en materia de sanciones migratorias, siendo indispensable dicho aspecto a momento de resolver los recursos jerárquicos, puesto que la medida de expulsión afecta derechos humanos de los migrantes, los cuales se encuentran desarrollados y protegidos por esferas internacionales, debiendo por tanto, cumplirse con el debido proceso en su vertiente de debida fundamentación, que así lo exige la Constitución Política del Estado, normativa migratoria y jurisprudencia emanada por el Tribunal Constitucional Plurinacional. The constitutionality of same-sex marriage in Bolivia.
No full textDespite having enacted Law 807 on Gender Identity on May 21, 2016 in order to safeguard the rights of the LGBTI population, allowing the recognition of the right of transgender and transsexual citizens to change their name and gender in their identity document, which in turn allows them to act in their legal life with the identity they had chosen, it was considered possible to conceive of marriage between people of the same gender, since a legal fiction was created that allowed them to exercise this right because they assumed a sexual identity different from that of their partner, this normative provision was so evident that the Bolivian Supreme Electoral Tribunal, through the Plenary Chamber of the Electoral Body, issued the instructions TSE-PRES-015/2017 that allowed in fact marriage between persons of the same sex. However, due to the opposition of deputies, as well as the Christian and Catholic churches, they considered that this recognition violated the traditional family and undermined the principles and values of society, for which reason they filed an abstract unconstitutionality action before the Court Constitutional against the Gender Identity Law, which deserved the Plurinational Constitutional Judgment No. 0076/2017, dated November 9, 2017, which considered that it was not possible to recognize marriage between people of the same sex, which stoned the expectations that up to that moment the LGBTI community built.A pesar de haberse promulgado la Ley 807 de Identidad de Género en fecha 21 de mayo de 2016 con el fin de precautelar los derechos de la población LGBTI, permitiéndose el reconocimiento del derecho de los ciudadanos transgénero y transexuales a cambiar de nombre y género en su documento de identidad, lo que a la vez les permite actuar en su vida legal con la identidad que hubieran elegido, se consideró posible concebir el matrimonio entre personas del mismo género, siendo que se creaba una ficción legal que les permitía ejercer este derecho porque asumían una identidad sexual distinta a la de su pareja, era tan evidente esta disposición normativa que el Tribunal Supremo Electoral de Bolivia mediante la Sala Plena del Órgano Electoral, emitió el instructivo TSE-PRES-015/2017 que permitía en los hechos el matrimonio entre personas del mismo sexo. Empero, debido a la oposición de diputados, al igual que las iglesias cristianas y católicas consideraban que este reconocimiento atentaba en contra de la familia tradicional y menoscababa los principios y valores de la sociedad, por lo que interpusieron una acción de inconstitucionalidad abstracta ante el Tribunal Constitucional en contra de la Ley de Identidad de Género, que mereció la Sentencia Constitucional Plurinacional Nro. 0076/2017, de fecha 9 de noviembre de 2017, que considero que no era posible reconocer el matrimonio entre personas del mismo sexo, lo cual lapidó las expectativas que hasta ese momento construyo la comunidad LGBTI.Capítulo 1: Marco metodológico, Capítulo 2: Marco teórico, Capítulo 3: Análisis, presentación e interpretación de resultados, Capítulo 4: Propuesta, conclusiones y recomendaciones, Capítulo 5: Bibliografí
