No full textThe objective of this project was to diagnose the environmental impacts and propose mitigation strategies in the remaining sub Andean forest ‘El Espejo’, located in the micro-basin of the Ambalá creek, immersed in the campus of the Universidad de Ibagué. El Espejo is a fragment of forest with a hectare of extension that conserves a great diversity of native species of the sub-Andean ecosystem. In order to conduct this study, three methodological phases were implemented: diagnosis, analysis and proposal. As a result, there was strong pressure on the area and negative impacts were identified, associated with contamination by solid waste, litter accumulation, which do not allow the natural regeneration of the forest, and fragmentation of the area. From this result, strategies of protection and sustainable management were proposed, which allowed to project this remaining area as a conservation and protection space.El objetivo de este proyecto fue realizar un diagnóstico de los impactos ambientales y proponerestrategias de mitigación en el remanente de bosque subandino El Espejo, ubicado en lamicrocuenca de la quebrada Ambalá, inmerso en el campus de la Universidad de Ibagué. El Espejoes un fragmento de bosque con una hectárea de extensión que conserva una gran diversidad deespecies nativas del ecosistema subandino. Para la realización de este estudio se implementarontres fases metodológicas: diagnóstica, analítica y propositiva. Como resultado se evidenció unafuerte presión sobre la zona y se identificaron impactos negativos, asociados con contaminaciónpor residuos sólidos, acumulación de hojarasca, que no permite la regeneración natural delbosque, y fragmentación del área. A partir de esto, se plantearon estrategias de protección ymanejo sostenible, que permiten proyectar este remanente como un espacio de conservación yprotección

The principle of good faith and money paid in excess by the State Administration: An analysis of the judgments of the Council of State
No full textIn the following article will be presented the criteria that have been developed in Colombian Council of State Jurisprudence around the non-refoulement of money that was paid in excess by the Administration State, also it describe how the Good faith general principle of law operates; for that aimit was made a study about sentences that this High Court has pronounced in the last tenyears, it means that this includes the period between 2007 and 2017, term in which have many judicial decisions that solves this type of claims raised by the State entities, specifically to be initiated annulment and re-establishment of the right claim, which it has been call by some authors as a detrimental action.
The effect on the State patrimony is not take into account in judicial decisions, since there is an enrichment and correlative impoverishment of the public Treasury, being cause for the Administration mistakes to recognize and give extra money to individuals. In any case, the application of the presumption of good faith cannot be accepted when the profit was obtained through anilegal action, however, to order to return the money gived to individuals by the Contentious Court, prevails the subjective aspect with which the particular acted to receive those economic benefits.En el presente artículo se expondrán los criterios que han sido desarrollados en la jurisprudencia del Consejo de Estado colombiano en torno a la no devolución de dinero que fue pagado en exceso por parte de la Administración Estatal; en este se describe cómo opera el Principio General del Derecho de la buena fe; para tal fin se realizó un estudio de las sentencias que este alto Tribunal ha proferido en los últimos diez años; es decir, en el periodo comprendido entre el año 2007 y 2017, lapso en el que han proliferado decisiones judiciales que resuelven este tipo de pretensiones alzadas por las entidades estatales, específicamente al ser incoado el medio de control de nulidad y restablecimiento del derecho, el cual ha sido denominado por varios autores como acción de lesividad.
El efecto en el patrimonio del Estado no es tenido en cuenta en las decisiones judiciales, dado que existe un enriquecimiento y un correlativo empobrecimiento del tesoro público, siendo sin más la causa, el error de la Administración al reconocer y entregar dinero adicional a los particulares; en todo caso, no puede aceptarse la aplicación de la presunción de buena fe cuando se ha obtenido lucro a través de una acción reprochable; sin embargo, para que el juez contencioso ordene devolver sumas de dinero por parte de los particulares, prima el aspecto subjetivo con el cual actuó el particular para recibir esos beneficios económicos.
