    The Role of Law Enforcement Against Illegal Logging in the Framework of Special Offences: A Case Study in Indonesia

    Illegal logging is a complex and destructive environmental crime with multidimensional impacts on Indonesia's ecosystems, society and economy. Although the government has established regulations such as Law No. 41/1999 and Law No. 18/2013, this practice is still rampant. This research aims to evaluate the effectiveness of law enforcement against illegal logging practices within the framework of special offences and identify various structural, juridical and technical obstacles faced by law enforcement officials. Using a qualitative method and a juridical-sociological approach, data was collected through literature study, legal document analysis, and the author's critical reflection on the empirical conditions of law enforcement in the field. The results show that law implementation often only targets field actors and has not been able to reach the intellectual actors behind organised crime networks. Weak inter-agency coordination, lack of technology utilisation, limited resources, and the involvement of unscrupulous officials are the main inhibiting factors. On the other hand, economic pressure and the lack of access to legal resources in the community also encourage their involvement in illegal logging practices. Therefore, the effectiveness of law enforcement needs to be complemented by socio-cultural approaches and community empowerment, as well as the integration of local and religious values in policy strategies. This research includes strengthening institutional capacity, legal transparency and active community involvement in forest monitoring to promote a fair and sustainable legal system

    Necessity of Establishment an Independent Environmental Court in Iraq

    The issue of the environment and its protection receives resonance at the Iraqi Law. Under the Environmental Protection and Improvement Law No. 27 of 2009, the ministry of environment MoE is entrusted with creating a commission or members among the MoE employees tasked to take necessary action to stop any pollution act. Also, they enjoys a judicial mandate to reveal the environmental crimes and their circumstances after they occur, to bring them to trial, and to impose punishment on those who committed it by unspecialized courts on environment. These environmental courts in Iraq described with poor and smoth procedures regarding environmental issues. Therefore, under SDGs, Iraq obligated to detect fair and justice for future generations , exactly SDG16. This study revealed that this observing mechanism, whether proactive or preventive, is unsatisfactory. The findings underscore the essential need for a legal framework in establishing environmental court in Iraq could improve access to justice in a manner that is fairer, faster, and more cost-effective than general court systems

    The nature of corporate organization is such that requires that it may need finances from sources that demand repayments on certain agreed terms; if it fails to repay as at when agreed, it tends to be said to be insolvent. Instead of allowing liquidation of such company because it is unable to repay its debt, administration can be used revive and if possible bring-back the company to its feet. Administration ensures the rescue of insolvent corporate organizations. This paper anchors on the objectives of administration as business rescue mechanism under the Companies and Allied Matters Act 2020. According to this study, the 2020 Companies and Allied Matters Act's introduction of administration has greatly raised the likelihood that rescue mechanisms will be used to bring failing businesses back to life. Suggestions include improving the environment for corporate or company rescues in the nation through appropriate implementation and educating stakeholders on the value of administration as stipulated in the Companies and Allied Matters Act 2020

    Financial Services Authority Is Responsible For Monitoring Illegal Investments In Indonesia

    The purpose of this research is to understand how the public perceives illegal investments and how the supervision and protection by the Financial Services Authority towards illegal investments impact. As shown by the establishment, the efforts of the Financial Services Authority to supervise and prevent illegal investments have encouraged investment in Indonesia. The Investment Alert Task Force and other preventive and repressive measures, because there are still illegal investment companies or illegal investment activities that manage to evade supervision, this does not mean that the Financial Services Authority officials have fully succeeded. The activities of the Financial Services Authority have not yet been fully implemented in society. The Financial Services Authority still lacks efforts to educate the public. The Financial Services Authority still lacks efforts to educate the public through socialization. The Financial Services Authority also formed an investment alert task force to monitor investments, especially those that are unclear, such as illegal investments. The sanctions imposed on illegal investment perpetrators are also very lenient

    This study examines the importance of integrating technology-oriented goals and principles in Uzbekistan’s foreign policy. Uzbekistan has traditionally focused on regional connectivity, trade relations and security considerations in its foreign policy. However, in this rapidly advancing technological era, the country should make a strategic shift toward technological integration to maintain regional competitiveness and ensure balance of power stability. The initial two stages, Irruption and Frenzy, are crucial in identifying the significance of artificial intelligence (AI), renewable energy, cybersecurity, and digital markets, and exploring potential partnerships such as South Korea, the United States, Japan, and Germany. Depending on secondary data that were collected from online and print publications. The paper identified issues ranging from inadequate funding, decentralization of National Universities Commission (NUC) operation, staff training, National Universities Commission (NUC) collaboration approaches with stakeholders, mobility facilities, appointment processes of National Universities Commission (NUC) Executive Secretary, shortage of personnel to the poor release of the budget as some of the major issues to urgently address to enable the commission to carry out its supervisory functions effectively. Based on these issues, the paper hereby recommends that there should be an immediate increment in the budgetary allocation of the commission. The Executive Secretary of the commission should engage university stakeholders more on issues concerning the policy anprogramme development of the commission. The Executive Secretary of the commission should create a medium where Private institutions and international institutions can support the commission in terms of finance and technical assistance

    Political Influence, Appointment of Principal Officers, Staff Recruitment, and Establishment of Tertiary Institutions in Nigeria

    The purpose of this study was to assess the extent of political influence on the appointment of principal officers, staff recruitment and establishment of tertiary institutions in Nigeria. The paper used secondary data. The secondary data were collected from both print and online publications through content analysis. The papers’ findings revealed that there is political influence on the appointment of principals’ officers of tertiary institutions in Nigeria. The study also disclosed that staff recruitment in tertiary institutions and the establishment of tertiary institutions in Nigeria were influenced politically by politicians in power. Based on the findings of this study, the paper recommends that: The government should grant full autonomy to tertiary institutions in Nigeria. The government should allow full implementation of all agreements reached with the Academic Staff Union of Universities (ASUU) to empower the institutions to follow the recruitment policy and recruit into the various institutions. Tertiary institutions regulatory agencies should be mandated to develop a national plan on tertiary institutions establishment and locations to prevent politics in the location and siting of institutions across the country

    Corruption Academic Staff and Infrastructure Facilities in Tertiary Institutions in Nigeria

    This paper examined the impact of corruption on the availability of academic staff and infrastructure facilities in Nigerian tertiary institutions using secondary data that were collected from print and online publications. The study concluded that there is significant relationship between corruption and shortage of academic staff and inadequate infrastructure facilities in the Nigerian tertiary institutions. The implication of this is that the quality of tertiary education will be affected negatively. The realization of tertiary education depends on the availability of qualified and adequate academic staff and infrastructure facilities. Academic staff are the implementer of curriculum in the tertiary institutions and to do this, the academic staff and students need adequate infrastructure facilities. Based on this discovered, the paper hereby recommended that the government should deploy technologies and artificial intelligence to curb corruption in the management of tertiary institutions. The government should ensure effective monitoring and evaluation system to the development of facilities in the tertiary institutions across the country

    Analysis of Some Statutory Framework on Environmental Pollution in Nigeria

    The need to conserve, promote, protect and improve human environment interrelations through ensuring pollution free terrestrial, marine, aquatic, and aerial environments in both rural and urban environments is fundamental to sustainable growth of any society in modern times. Every person or body must ensure it does not contribute to the pollution of the environment beyond what the ecosystem can absorb. Pollution is the alteration of the natural use of environmental resources as to make it lose or change its natural, biological, chemical and physical essence beyond the capacity of the environment to absorb. There are activities which are contrary to natural existence of the environment but which does not distort the composition or nature of environmental resources. To prevent destruction of environmental resources through pollution, regulation and statutes have enacted for what should be done. Statute like the Petroleum Industry Act 2021, National Environmental Standards and Regulations Enforcement Agency Act 2007 as amended and regulations made thereto would be the focus of this article. It was found that environmental pollution cannot be overcome by the agencies under the extant Acts and regulations because scientific processes, techniques and equipment required to tackle pollution is yet to be made available to the Agencies responsible for environmental pollution control and abatement. It was recommended that Agencies like Nigerian Midstream and Downstream Petroleum Regulatory Authority and NESREA should synergise in areas of technical assistance and pollution remediation equipment acquisition and utilisatio

    Implementation of the Prohibition of Selling Policy on the Sidewalks of Java Road, Jember Regency

    Sidewalks are pedestrian paths located on the side of the road. Sidewalks function to provide convenience for pedestrians so that they are not disturbed by traffic drivers. Street Vendors or commonly called PKL are business actors who conduct business activities for a certain period of time in public facilities using trading facilities that are easily dismantled. However, the existence of sidewalks for pedestrians has now changed its function to become a location for street vendors to sell. This causes a narrower traffic area and creates congestion and disrupts the activities of pedestrians. The purpose of this study is to determine the extent to which the Implementation of Regional Regulation Number 6 of 2008 on the prohibition of selling on Java Street, Jember Regency. Research method: This research uses qualitative methods. The collection techniques used are interviews and observations. Research objectives: the purpose of this study is to review the extent of the success of Regional Regulation Number 6 of 2008 around Jalan Jawa, Jember Regency. The results of this study obtained the conclusion: that the traders already understand the prohibition of selling around the sidewalk and the shoulder of the road, but due to the inadequacy of relocation land, the traders are still allowed to sell on the sidewalk of Jalan Jawa on condition that they still pay attention to the cleanliness of the surrounding environmen
