Legal Outcomes of Litigation After Iatrogenic Genitourinary Trauma
Objective: To evaluate plaintiff and defendant characteristics associated with iatrogenic genitourinary (GU) trauma litigation and outcomes of closed claims. Methods: LexisNexis was queried in April 2023 using terms related to GU organs and injury, and manually reviewed for iatrogenic cases. Case details including defendant, organ involvement, and legal outcome were obtained. Multinomial regression analysis was performed to identify factors associated with outcome. Results: Four hundred ten cases involving 611 defendants were identified, with the ureter the most commonly affected organ (202/410, 49.3%). Most cases involved adult plaintiffs (380, 92.7%) and resulted in favor of the defense (227, 55.4%). Injuries resulted most frequently from gynecologic surgeries (179, 43.7%). Defendants were most commonly obstetricians/gynecologists (243/611, 39.8%) and urologists (168, 27.5%). Penile (OR 6.3 [95% CI 2.5-16.1]) and urethral (OR 4.8 [2.0-11.7]) injuries were associated with greater odds of a plaintiff verdict relative to ureter injury. A plaintiff verdict was also more likely when defendants were academic hospitals compared to individual practitioners (OR 4.3 [1.9-9.9]). In cases ruling in favor of the plaintiff, indemnity payments were larger when the defendants were comprised of individual practitioners compared to a hospital or medical group (median 250,000, P \u3c.001). Conclusion: Urologists may be involved in medical malpractice lawsuits for iatrogenic injury even when they are uninvolved in the index procedure. Most cases that reach litigation result in defense verdicts regardless of the GU organ injured. Defendant characteristics associated with plaintiff verdicts are more nuanced, and providers should be aware of potential downstream effects of litigation
Multigenerational Family Business Succession: An Extreme Case Study
Family businesses balance performance with family, employee, and consumer needs, and they exist in most private and public sector areas. Although family businesses must continuously manage decisions that impact the never-ending succession task, we have limited knowledge of how multiple successions play out over time. Against this backdrop, we present an extreme case of how a family business, Kinsmith Finance, thrived through three successions; we focus on how the generations involved shaped the succession path using combinations of adapting to emerging circumstances and reinforcing decisions from previous generations. By adopting a case study design with three embedded succession cases, we examine the reoccurring events to uncover eight underlying decision patterns that shaped the overarching succession path. Together, these findings show how the family business used critical decision events to create and reinforce succession opportunities, in turn fostering successful successions across four generations. As a result, we provide an elaborate account of eight decades of family business evolution, offering novel insights into multi-generational succession
Malpractice Litigation Related to Management of Varicocele: A Legal Database Review
There have been studies that examined litigation procedures stemming from the management and treatment of various urological issues [6, 8]. Varicocele is a common urologic condition and can be associated with pain, subfertility, and infertility, thus greatly impacting patient well-being and quality of life. It has a prevalence of 15% in the general male population and up to 35% in males with infertility [9]. Varicocele has a range of treatment options, from observation to pain management to surgical correction. To our knowledge, no legal claims database investigation into varicocele cases exists. Elucidating the factors that go into varicocele litigation could provide valuable insight into management considerations for this disease and provide an opportunity to improve care for patients. A FAIR Ontology for APS Beamline Experiments
Data produced at the 1-ID beamline APS are often serialized in large, disconnected tables, which can impede the effective reuse and replication of analysis performed for cutting edge research and instrumentation conducted at the facility. This poster describes an alternative approach of utilizing component-based FAIR (Findable, Accessible, Interoperable, and Reusable) ontologies as a framework for organizing and connecting experimental variables. Three packages were developed to facilitate the creation and connection of component ontologies into a fully connected FAIR ontology for an experiment. An ontology-based workflow is also discussed for beamline scientists and users to visualize and connect collected values alongside variable associations. A FAIR ontology builds the capability for automated analysis, enhances data stewardship practices, and enables data interoperability between different beamline facilities inside the APS and across beamline laboratories in the United States
