Analiza odabranih pitanja o javnim beležnicima iz perspektive zakonodavstva Republike Srbije, uporednopravnih rešenja i izvora prava Evropske unije uz osvrt na mogućnost unapređenja zakonodavstva Republike Srbije
Zaštita žigom zaštićenih oznaka u metaverzumu – predmet Hermès International v. Mason Rotschild
Različiti oblici komunikacije u metaverzumu otvaraju niz pravnih pitanja u vezi sa intelektualnom svojinom, pre svega sa upotrebom žigom zaštićenih oznaka. Spor koji je izazvao najviše pažnje u vezi sa upotrebom oznake za obeležavanje tokenizovane robe u metaverzumu tiče se žiga francuskog proizvođača torbi i modnih aksesoara – Hermes (franc. Hermès). Kompanija Hermes nosilac je žiga Birkin za kožne ženske torbe, simbola luksuza i prestiža. Umetnik Mejson Rot-čajld (Mason Rotschild) upotrebio je oznaku MetaBirkin (MetaBirkin) za obeležavanje nezamenlјivih tokena koji za predmet imaju virtuelne torbe veoma sličnog izgleda kao Hermesove. Rotčajldovo umetničko delo prodato je za desetine hilјada američkih dolara, nakon čega je napravio novu kolekciju. Kompanija Hermes podnela je tužbu sudu u Nјujorku protiv Rotčajlda za proizvodnju i prodaju nezamenlјivih tokena MetaBirkin, od kojih je svaki digitalna slika Hermesove Birkin tašne kao da je od krzna. Klјučno pravno pitanje je da li neovlašćena upotreba tuđe žigom zaštićene oznake za fizičku robu u kontekstu nezamenlјivih tokena predstavlјa povredu žiga. U martu 2023. godine sud je doneo presudu, jednu od prvih u ovoj oblasti, da kolekcija digitalnih slika krznenih torbi u vidu nezamenlјivih tokena MetaBirkin dovodi potrošače u zabludu da je reč o Hermesovim Birkin tašnama. Ovom presudom prvi put je određena pravna priroda nezamenlјivih tokena, u smislu da su oni sličniji robi, na koju se primenjuju zakoni o žigovima koji sankcionišu neovlšćenu upotrebu tuđe žigom zaštićene oznake, nego umetničkim delima kod kojih su određeni oblici korišćenja tuđe žigom zaštićene oznake od strane trećih lica dozvolјeni
Public service and human resources management standards in 2023 Principles of public administration – something old and something new?
The objective of the paper is to examine what are the key novelties in the SIGMA/
OECD Human Resources Management (HRM) standards set out in the 2023
edition of the Principles of Public Administration. The public administration
reform values contained in the revised version of the Principles have become new
benchmarks against which the progress in public administration reform will be
measured in the EU acceding countries. The author concludes that a new edition
of the Principles of Public Administration from 2023 imposes fewer rules
while requiring better practices and results in the analysed areas of public service
and HRM, taking into account emerging social context changes (i.e. digitalisation,
need for more flexibility in working arrangements etc.) which is a welcome
development. The Principles also demonstrate a gradual change of the requirements
of the EU for accession to potential member states in the field of public
administration, from "check-box" approach towards assessing the effects of
the reform in practice. The question, however, remains to which extent the new
version of the Principles will be able to exert pressure on public administration
reform efforts in the acceding countries, especially in politically sensitive areas
such as civil service politicisation. The author concludes that this will largely
depend on the EU’s decision on “what matters most” in the accession process and
the ability of the acceding countries to apply and internalize key Principles’ values,
such as professionalism, integrity and neutrality
Public figure status and failure to request retractions in damage compensation disputes against tabloids
This paper explores the legal complexities surrounding public figures
and the request of retractions in damage compensation disputes
against tabloids. The study focuses on two primary legal
questions: whether the heightened scrutiny public figures face justifies
a more lenient approach to media liability, particularly in
the context of tabloids, and whether the failure to request a retraction
by the harmed individual should serve as a mitigating factor
for the media in legal disputes.
Through a detailed analysis of both theoretical perspectives and
relevant case law from the European Court of Human Rights and
the U.S. Supreme Court, the paper examines the balance between
the public’s right to be informed and the protection of individual
rights, such as privacy and reputation. The discussion highlights
how tabloids, as a specific subset of the media, frequently violate
journalistic standards in their pursuit of sensationalism, often
resulting in significant harm to public figures.
The paper argues that while public figures are required to tolerate
a higher degree of criticism, this does not inherently reduce the
accountability of tabloids for their actions. Moreover, the non-issuance
of a retraction should not automatically mitigate the tabloid’s
liability, especially when the retraction process could exacerbate
the harm suffered by the individual. Ultimately, the paper calls for stricter legal standards in cases involving tabloids, emphasizing
the need to protect public figures from disproportionate harm while
maintaining the integrity of free speech and the press
Between compensation and performance: navigating remedies from PICC to national legal systems
This article presents a comparative analysis of remedies for
non-performance in international contract law, focusing on
the UNIDROIT Principles of International Commercial Contracts
(PICC), the United Nations Convention on Contracts for
the International Sale of Goods (CISG), German law, French law
and English law. It examines the theoretical frameworks, practical
implications, and comparative nuances of each legal system,
providing an evaluation of how these frameworks address
non-performance and the influences they exert on international
contract law. Through this analysis, this study aims to elucidate
the nuances and influences of each legal system on the relations
between non-performance and damage compensation. The paper
aims to determine which remedy offers a more equitable solution
within different legal contexts, especially for PICC. The paper
offers a comprehensive understanding of how various legal systems
address remedies for breach of contract, highlighting their
similarities, differences, and influences on one another
Comparative analysis of the EU AI Act and the CoE framework convention on AI, human rights, democracy and the rule of law
Artificial Intelligence (AI) is used in many aspects of everyday life providing a
variety of benefits for its users, as well as provoking different risks of violations
of human rights. Beside the fact that AI accumulates a big profit for companies
and develops economies, it is still a “black box” which effects to societies
are not predictable at all. Leaving AI as a global phenomenon unregulated at
the market can provoke legal uncertainty, undermine the rule of law, as well
as decrease economic growth. In December 2023, the Council of the EU and
the EU Parliament reached the political agreement to adopt the Regulation
on Artificial Intelligence (EU AI Act) which will be the first horizontal legally
binding act in the world in this field. The Council of Europe’s Committee of
Ministers adopted the Council of Europe Framework Convention on Artificial
Intelligence, Human Rights, Democracy and the Rule of Law (Framework
Convention) on 17 May 2024. The aim of this investigation is to make a comparative
analysis how AI has been regulated by the EU AI Act and the Framework
Convention, introducing their similarities and differences. The doctrinal
and descriptive methods will be used for achieving this aim
Radnopravni položaj zaposlene koja doji
Radnopravni položaj dojilјa nije privlačio pažnju stručne javnosti, sve do izdvajanja ove kategorije zaposlenih legislativom Evropske unije i Međunarodne organizacije rada. Od tada, dojilјe uživaju gotovu identičnu zaštitu na radu kao i trudnice, a ova zaštita se uglavnom svodi na bezbedne uslove rada. Imajući na umu značaj dojenja, pitanje položaja dojilјa u svetlu usklađivanja porodičnog i profesionalnog života sve više dobija na značaju. Povezanost radnog prava i dojenja veća je nego što se čini, a cilј rada jeste da istraživanjem uporednog prava na temu dojenja utvrdimo podesnost norme koja postoji u domaćem pravu, a tiče se pauze za dojenje, efikasnost primene i mogućnost za promenu ove norme, ne bi li se povećao procenat žena koje doje, a koje ne odustaju od zaposlenja zbog porodičnog života
Diferencirana integracija u Evropskoj uniji i dinamika savremenih pravnih poredaka
Dinamika savremenog pravnog poretka uslovljena je pravnim i vanpravnim
činiocima, nacionalnog i nadnacionalnog dometa. Prilikom analize dinamike
savremenog pravnog poretka mora se uzeti u obzir i ubrzani tehničko-tehnološki
napredak budući da tehnološke promene menjaju faktičke odnose u društvu i na taj
način iskušavaju izdržljivost, prilagodljivost i vitalnost prava. Dinamika
pravnog poretka Evropske unije, kao složene, sui generis, organizacije država
članica uslovljena je, između ostalog, dinamikom pravnih poredaka njenih članica.
Da li u današnjem kompleksnom i dinamičnom okruženju, Evropska unija može da
proprati i „pomiri” dinamiku savremenih pravnih poredaka svih država članica i
na koji način ih može uklopiti u pravni poredak EU koji se takođe suočava sa
brojnim izazovima? Rad nastoji da odgovori na pitanje da li se u okviru instrumenta
diferencirane integracije iskristalisalo jedno od rešenja za usaglašavanje
dinamike pravnih poredaka država članica unutar EU. Nakon uvodnih napomena, u
radu je predstavljen koncept diferenciranosti/ fleksibilnosti u pravu EU. Nakon
toga razmotrena su ograničenja primene diferencirane integracije, kao i principi
koji se moraju poštovati prilikom primene ovog instrumenta. Zatim su analizirane
unutrašnja i spoljašnja dimenzija diferencirane integracije. Naposletku su
ispitani različiti nivoi, slojevi, koncentrični krugovi evropskih integracija u
budućnosti
Izazovi zaklјučenja ugovora putem elektronskog zastupnika - predlog za uređenje de lege ferenda
Moderno poslovno okruženje odlikuje se učestalim zaklјučenjem ugovora
korišćenjem takozvanih elektronskih zastupnika. U vezi sa elektronskim
zastupnicima postavlјa se čitav niz pitanja, počev od pojma elektronskog
zastupnika, preko pitanja punovažnosti i osnova punovažnosti ugovora
zaklјučenih putem ove tehnologije, pa sve do pitanja pravnih posledica
realizacije rizika koje generiše upotreba elektronskih zastupnika u
postupku zaklјučenja ugovora.
Uočivši određene manjkavosti u srpskom pozitivnom pravu kada je reč o
ovim pitanjima, autor je nastojao da, metodom upoređivanja pravnih rešenja
pojedinih stranih pravnih sistema sa stanjem u domaćem pravu, ponudi
određene predloge za de lege ferenda unapređenje. Stoga se u radu se pristupa
analizi pomenutih pitanja, a radi otklanjanja potencijalnih dilema i
problema tumačenja pozivitnopravnih pravila. Analizom elektronskog
zastupanja, autor nastoji da dâ svoj doprinos dalјem razvoju elektronske
trgovine u uslovima ekspanzije digitalne tehnologije, a sve u cilјu
sprečavanja nastupanja brojnih rizika skopčanih sa upotrebom tehnologije
elektronskog zastupanja, te, globalno gledano, omogućavanja nesmetanog
odvijanja trgovine
Investment Migration from the Standpoint of International and EU Law
Investment migration programmes are used by over eighty states
globally and pose serioussecurity and criminalrisks. Their existence
is additionally complex in the EU, as EU citizenship opens up its
internal market and grants a set of political rights. Relying
predominantly on the normative-legalmethod,the authors analyse
the compatibility ofinvestmentmigrationwith international and EU
law. The purpose of this analysis is twofold. First, it determines
whether national autonomy in citizenship matters is subject to
limitations by international and EUlawsince they impactthe legality
of investment migration. Second, implications of the Nottebohm
case are analysed to determine the relevance of the genuine link
criterion for the international recognition of nationality. It was
concluded thatthe genuine link criterion does not affectthe legality
ofinvestmentmigration in international and EUlaw. Instead, legality
is achieved if investment migration programmes comply with rules
on combating corruption,money laundering, and tax evasion.While
authors give due regard to the autonomy of EU law, the need to
avoid the danger of the “vertical aspect” of international law
fragmentation, i.e., incoherence between EUand international law,
and to avoid the creation of an imbalanced legal environment is
considered a priority
