Dieser Beitrag befasst sich mit dem Jugendgerichtsgesetz
(JGG) von 1923 als erstem eigenständigem Jugendstrafrecht in Deutschland. Im Rahmen der strafrechtlichen Sonderbehandlung Jugendlicher konnten dabei spürbare Verbesserungen für diese erzielt werden. Dennoch wurde der angestrebte effektive Vorrang der Erziehungsmaßregel vor

Die vorliegende Anmerkung führt zunächst kurz in die Problematik des Falles ein und stellt anschließend das Urteil dar, wobei bewusst politisch neutral formuliert wird. Sodann sollen das Urteil und das Problem analysiert und bewertet werden

Ein Auslandsjahr in Nottingham oder Der Studienfortschritt eines Erasmus-Aufenthalts
Fördert das Erasmus-Stipendium einen Auslandsaufenthalt, der dem Studierenden allein der persönlichen Erfahrung und der Vertiefung von Sprachkenntnissen, insbesondere aber der Auszeit vom Studium dient? Unterbricht ein Erasmus-Aufenthalt das rechtswissenschaftliche Studium also zumindest fachlich auf ineffektive Weise? Nach ein bzw. zwei Erasmus-Semestern an der University of Nottingham müssen wir diese Fragen eindeutig verneinen. Nicht nur in persönlicher und sprachlicher, sondern gerade auch in fachlicher Hinsicht stellt ein derartiger Auslandsaufenthalt eine große Bereicherung dar

The Dawn of Article 18 ECHR: A Safeguard Against European Rule of Law Backsliding?
This article examines an underexplored avenue for the protection of the rule oflaw in Europe: Article 18 of the European Convention on Human Rights. Thisprovision prohibits States from restricting the rights enshrined in the EuropeanConvention for any other purpose than provided for in the Convention. In thiscontribution, the author argues, based on a combination of textual, systematicand purposive interpretations of Article 18, that the provision is meant tosafeguard against rule of law backsliding, in particular because governmentalrestrictions of human rights under false pretenses present a clear danger tothe principles of legality and the supremacy of law. Such limitations of rightsunder the guise of legitimate purposes go against the assumption of good faithunderlying the Convention, which presupposes that all States share a commongoal of reinforcing human rights and the rule of law. Article 18 could thereforefunction as an early warning that European States are at risk of becoming anilliberal democracy or even of reverting to totalitarianism and the destruction ofthe rule of law. The article then goes on to assess the extent to which the EuropeanCourt’s case-law reflects and realizes this aim of rule of law protection, and findsthat whereas the Court’s earlier case-law left very little room for an effectiveapplication of Article 18, the November 2017 Grand Chamber judgment inMerabishvili v. Georgia has made large strides in effectuating the provision’sraison d’être. As the article shows, however, even under this new interpretation,challenges remain

Paarbeziehungen und Mietverha?ltnisse weisen auf emotio naler Ebene parallele Strukturen auf: Beide werden ha?ufig mit großer Euphorie begonnen und enden mit heftigen Aus einandersetzungen bei der Abwicklung. Das nichteheliche Zusammenleben wirft auch rechtliche Fragen auf, die sich an der Schnittstelle zwischen Familien- und Mietrecht befinden. Einige dieser Fragen sollen im folgenden Beitrag beleuchtet werden
