    Los impactos de la reforma de la ley de quiebras y recuperación judicial en la responsabilidad de los administradores de las sociedades comerciales en recuperación judicial

    La responsabilidad de los socios y administradores por las obligaciones de la empresa en el ámbito de la Recuperación Judicial y la Quiebra es un tema que adquirió contornos específicos a partir de la promulgación de la Ley n. 14.112/2020, que modificó la Ley n. 11.101/2005 (Ley de Recuperación y Quiebra). A través de una investigación bibliográfica y cualitativa, el presente artículo tiene como objetivo evaluar, desde la perspectiva de los deberes fiduciarios, cuáles son los límites de la responsabilidad de los administradores frente a las obligaciones de la empresa en proceso de recuperación, mediante un análisis de las modificaciones introducidas por la Ley n. 14.112/2020 y sus efectos. Por esta razón, se considera que no es el mero incumplimiento o cualquier “mala decisión” lo que impondrá responsabilidad a los administradores, siendo fundamental el incumplimiento de los deberes fiduciarios de diligencia, lealtad y de información para la acción de responsabilidad o el incidente de desconsideración de la personalidad jurídica, siempre de manera excepcional, favoreciendo la independencia de la administración de la compañía y excluyendo la aplicación jurisprudencial que antes estaba vigente

    Séquelles de la COVID-19 : revue intégrative de la littérature

    La grande affinité entre la protéine Spike du virus SARS-CoV-2 et le récepteur de l’enzyme de conversion de l’angiotensine 2 est postulée comme l’une des principales raisons de la forte taux de transmission virale, ce qui a conduit l’OMS à déclarer la COVID-19 comme une Urgence de Santé Publique d’Intérêt International, ainsi qu’à adopter des mesures de contenances de la propagation virale. De plus, grâce au mécanisme physiopathologique du virus, on observe généralement des symptômes non spécifiques, une évolution atypique, principalement chez les personnes âgées et immunodéprimées, ainsi qu’une progression plus rapide et létale. De même, avec l’avancement des connaissances sur l’histoire naturelle de l’infection virale, des symptômes persistants et/ou des séquelles ont été constatés, entraînant des dysfonctionnements organiques et ayant un impact négatif sur la qualité de vie des patients. Ainsi, l’objectif de l’article était de présenter une revue intégrative sur les principales séquelles de la COVID-19 pour les années 2021 et 2022. À cette fin, des articles complets ont été recherchés dans les bases de données de recherche Scientific Electronic Library Online, Biblioteca Virtual em Saúde et PubMed, en portugais et en anglais, et la méthodologie PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) a été utilisée, avec la sélection de 14 articles. Parmi les résultats, on peut noter : la physiopathogénèse de la COVID-19 persistante repose sur la théorie des phénomènes immunitaires secondaires à l’infection, une réponse immunitaire anormale et la présence du virus dans des endroits immunologiquement privilégiés ; la fatigue, la dyspnée, les altérations cognitives subjectives, les séquelles neurologiques, les maladies inflammatoires du système nerveux central et les dysfonctions olfactives post-virales sont des complications courantes ; des preuves d’une relation causale entre la COVID-19 et la thyroïdite subaiguë ont été présentées ; un plus grand nombre de complications et d’hospitalisations a été démontré chez les patients présentant une carence en vitamine D ; ainsi que la présence de symptômes neuropsychiatriques dans la population des professionnels de la santé. En conclusion, la rareté des travaux portant directement sur les séquelles de la COVID-19 a été constatée, rendant nécessaire un approfondissement de ces recherches en vue de la création de protocoles plus spécifiques pour le diagnostic

    Biotic homogenization in tree communities of tropical forests: a systematic review

    A systematic literature review was conducted on biotic homogenization in tropical forests and its consequences for the diversity of tree communities. We evaluated articles indexed in Scopus® and Web of Science® from 1945 to 2022. The selection of publications was carried out using the Rayyan platform. The bibliometric method used for database mapping was co-word analysis in VOSviewer software. We distinguished three lines of research on biotic homogenization: invasion ecology of species; environmental and anthropogenic factors; and functional and phylogenetic diversity. The most studied and perhaps the most affected component was the taxonomic component. Biotic homogenization events are widely distributed throughout the tropical region, with the most affected forest type being tropical rainforest, and the main cause identified was land use change related to anthropogenic degradation. Studies on biotic homogenization in the tropics have intensified in the last decade and have resulted in significant advances in understanding this process, such as the realization that hyperdiverse environments are susceptible to biotic homogenization, which can be mediated by generalist native species.     Dental trauma in childhood: integrative review

    The aim of this work is to conduct a literature review on aspects of dental trauma in deciduous dentition, based on data found in the PUBMED, LILACS, BBO, and SCIELO databases regarding the proposed topic. Trauma to deciduous teeth occurs in preschool children and is often associated with behavioral traits such as curiosity and restlessness, leading children to explore environments that result in falls, leading to an increased incidence of injuries. The success of post-traumatic care is related to the emergency care provided at the time of the event, as delayed treatment can result in a series of problems according to the trauma suffered. To avoid problems resulting from trauma and delayed treatment, there are protocols and guidelines that can be used in the treatment of dental trauma, with each treatment corresponding to a type of trauma

    Indigenous ethnoknowledge about stingless bees (Apidae: Meliponini) in the Brazilian territory: Bibliometrics

    This study aimed to analyze the characteristics of scientific productions that address the knowledge of indigenous peoples about stingless bees in different ethnicities, in the Brazilian territory, through bibliometric analysis. Thus, we sought to answer the following question: what are the characteristics of scientific publications with the theme in question found in the databases in the research tools? As descriptors, the following keywords were used: “Brazilian Indigenous Knowledge and Stingless Bees”, in the databases of Google Scholar and Scopus, totaling 18 (eighteen) scientific productions, in Spanish, English and Portuguese, with no year limit, and the survey was conducted in October and November 2022. As a result, we obtained: 10 (ten) (56%) scientific articles, 2 (two) (11%) master’s dissertations, 2 (two) (11%) doctoral thesis and 4 (four) (22%) scientific papers published in annals of events, covering the period from 1982 to 2020, notifying the representativeness of the unconventional literature in this research. The study evidenced the contribution of Higher Education Institutions – federal public HEIs and the little performance of state HEIs with research on the subject, in addition to large gaps with regard to: the time and evolution of publications, the periodicity of journals and, especially, the geographical scenario with the presence of indigenous ethnicities in their relations with stingless bees in the Brazilian territory.     The importance of agribusiness in the United States in promoting food security

    The expression “food security” appears at the end of the 2nd. World War, before the misery installed in different countries. In opposition to food security that guarantees a dignified survival, there is food insecurity, represented by the lack of basic inputs for a diet that guarantees energy and vitality to individuals. Food insecurity around the world is on a vertiginous scale, aggravated by the Covid-19 pandemic. Global hunger is caused by different factors: population growth; social differences; more or less extreme weather events; constant rises in food prices; insufficient demand and distribution to the most needy regions; among other structural and conjunctural deficiencies. To combat this humanitarian tragedy, the forms of cultivation and production in agriculture evolved to version 5.0, bringing new practices and cutting-edge equipment to the field. This article was developed, according to the methodology of bibliographical research, aiming to answer the question: how does the modernization of North American agribusiness collaborate with the fight against food insecurity? The objective is to present the modernization of existing planting techniques and possible improvements, based on Agriculture 5.0. As a result of the analysis and interpretation of the selected literature, it was found that the adoption of new technologies arising from Agriculture 5.0 optimize all planting and food cultivation practices, from the collection of information in real time through drones, and interpretation of the data received in computers that make possible the purchase, use and control of inputs, pest control, optimization of the harvest and its greater use

    O presente artigo pretende demonstrar como vem ocorrendo a ascensão do direito relacionado às mulheres no âmbito penal, demonstrando que as diversas conquistas femininas obtidas até os dias atuais partiram de grandes manifestações, lutas e reivindicações, as quais tiveram como objetivo a paridade de tratamento em relação aos homens, seja no cotidiano ou nas relações jurídicas. Além disso, o artigo apresenta casos de grande repercussão no mundo jurídico, os quais foram responsáveis pela elaboração de diversos institutos penalizadores. Assim sendo, o estudo aqui realizado esclarece todo o desenvolvimento da legislação penal até a recente declaração de inconstitucionalidade da tese da legítima defesa da honra nos crimes passionais, a qual, por muito tempo, foi utilizada como meio de defesa ao agressor de mulheres em casos de adultério e, principalmente, em casos de feminicídio. Dessa forma, apesar das diversas conquistas jurídicas, o artigo indica que ainda há um longo caminho a ser percorrido no sentido da igualdade de tratamento entre os gêneros

    Heuristic evaluations for accessibility decisions: a systematic literature review

    There are more and more people who are using technology on a daily basis to communicate and access information, including the elderly and people with disabilities. Assistive technologies, also called technical aids, are accessibility and inclusion resources that provide a greater degree of autonomy and assistance for people who have some degree of difficulty in using resources in their contact with real and virtual environments. The aim of this study is to investigate the perceptions about the heuristic assessment of accessibility in software by undertaking a systematic review of the literature that covers the last 5 years. This started off with a total of 8548 published papers that are indexed in the Scopus and Web of Science databases. Twelve relevant research questions were drawn up that were answered in accordance with the results found in the final set of articles. Two groups of keywords were created to assist in the search for papers and a filtering process was applied to the results of the searches. The research shows, by means of figures and tables, evidence about the growth of scientific papers in the area. The lead authors and journals that publish on evaluating the accessibility of software are listed, as are answers to the questions about which evaluative models, heuristics, metrics, limitations, assistive technologies and target audiences are most cited in published papers. This study also analyzes the co-citation of the references and couples bibliographic sources. The research showed evidence that there is no general consensus on the use of a single model to assess accessibility, but that the W3C WCAG guidelines are the sources most used to reference heuristics and metrics in studies of this type. It was also noticed that most studies do not focus on assistive technologies, but are widely used to support decisions on websites
