Naturaleza de la Corte Interamericana de Derechos Humanos (Corte IDH): ¿tribunal de casos concretos o tribunal suprarregional convencional?
This paper describes the use given by the Inter-American Court to the control of conventionality as a mechanism to define the type of public policies that the State parties must adopt to guarantee social rights protected by it. From that point on, we wonder about the current nature of the Inter-American Court, if it remains a court of cases or if it has become, by its own decision, a conventional supra-regional court.El trabajo describe el uso dado por la Corte IDH al control de convencionalidad como mecanismo para definir el tipo de políticas públicas que los Estados parte deben adoptar para garantizar derechos sociales tutelados por aquélla, y a partir de ello se pregunta sobre la naturaleza actual de la Corte IDH, si sigue siendo un tribunal de casos o se convirtió por propia decisión en un tribunal suprarregional convencional
La libertad de empresa como derecho fundamental en México
Legal recognition of companies in Mexico is not completely clear. Several provisions include the concept but do not define it, and it is addressed by secondary sources in different areas of law. In the commercial area, it has been understood that a company is a commercial activity and has always been treated as such. However, business is the consequence of an act of individual freedom and therefore should be considered as a fundamental right, the right to freedom of business. Freedom of business has been recognized in constitutional texts of several countries in the Western world, especially after the Second World War. This has not been the case in Mexico. Express recognition of this freedom in our country would result in the strengthening of companies, entrepreneurs, market freedoms and, eventually, of democracy itself.El reconocimiento jurídico de la empresa en México no es del todo claro. Varias normas contienen el concepto, pero no lo definen, y en la doctrina es abordado por distintas áreas del derecho. Desde el ámbito mercantil, se ha entendido que la empresa es un acto de comercio y desde siempre se le ha tratado como tal. No obstante, la empresa es consecuencia de un acto de libertad individual y en consecuencia debería considerarse como la manifestación de un derecho fundamental, el derecho a la libertad de empresa. La libertad de empresa ha sido reconocida en los textos constitucionales de varios países del mundo occidental, sobre todo después de la Segunda Guerra Mundial. No ha sido el caso de México. El reconocimiento expreso de la libertad de empresa en nuestro país redundaría en una fortaleza de la figura de la empresa, del empresario, de la libertad de mercado y, en última instancia, de la democracia misma

When and why is the forgotten past recovered?:The Battle of Warsaw, 1920 and the role of local actors in the production of memory
Memory scholars mostly agree that although social memory is culturally constructed, political and institutional actors encounter various constraints when adapting the past to their group’s needs and values. The aim of this paper is to revisit this old question of the malleability and persistence of the past but in the context of the intensive memory production that emerged during a period of rapid change in post-communist transitional states. First, the paper probes the question why some collective memories re-emerge after a long period of suppression while others do not. And secondly, it examines the conditions under which local rather than national actors become more successful in recovering the forgotten past. The focus is on Poland; its distinct history of frequent ruptures in the continuity of commemorative tradition not only opens up opportunities for less constrained work of remembrance but also for repositioning the standing of national and local agents of memory production
Corporate Social Responsibility, Hydraulic Fracturing and Unregulated Space::Recognising Responsibility Without the Law
This paper considers the role of legal regulation in assessing the actions of firms in relation to CSR. Utilising recent legal developments surrounding the controversial practice of hydraulic fracturing as an illustrative example of the issue, it questions whether judging CSR is possible in a legal vacuum. Having established the linkage between CSR and the law the piece moves to illustrate that instances of legal freedom question established conceptions of CSR and warrant a greater exploration of this connection. Whilst instances of this type are conceded as rare, they do question the extent to which, without law, the responsibility of actions can be demonstrated by firms and it is this which the paper highlights

Weak necessity without weak possibility::The composition of modal strength distinctions in Javanese
This paper investigates the semantics of the suffix -NE in Javanese (Austronesian; Indonesia), bringing to light new findings to bear on the composition of modal strength distinctions. In a transparent manner, this functional morpheme derives weak necessity modals from strong necessity modals, but cannot attach to possibility modals to derive weak possibility. Javanese thereby takes a different compositional route to weak necessity than most Indo-European languages, which might lexicalise modal strength distinctions or rely on counterfactual morphology for that purpose. We propose a new type of domain restriction analysis for weak necessity to capture both the defining properties of weak necessity as well as the restriction in Javanese to only necessity modals. Specifically, we propose that -NE requires quantification over a non-empty subset of a minimal witness set for the original quantification. The Javanese data thus show that weak necessity is not a unified phenomenon across languages, and our analysis contributes to a model of crosslinguistic variation concerning the relationship between gradability and modality, and the semantics of weak modal strength
Defining integer valued functions in rings of continuous definable functions over a topological field
Let K be an expansion of either an ordered field or a valued field. Given a definable set X ⊆ K<sup>m</sup> let C(X) be the ring of continuous definable functions from X to K. Under very mild assumptions on the geometry of X and on the structure K, in particular when K is o-minimal or P-minimal, or an expansion of a local field, we prove that the ring of integers Z is interpretable in C(X). If K is o-minimal and X is definably connected of pure dimension 2, then C(X) defines the subring Z. If K is P-minimal and X has no isolated points, then there is a discrete ring Z contained in K and naturally isomorphic to Z, such that the ring of functions f ∈ C(X) which take values in Z is definable in C(X)
