Upaya Hukum Terhadap Rumah Susun yang Tidak Memenuhi Persyaratan Teknis dalam Sertfikat Laik Fungsi
Full text linkThe scarcity of land has prompted a shift towards vertical housing solutions, with apartments gaining prominence as a viable alternative to traditional single-family dwellings. However, In creating a suitable apartment development, the apartment developer should pay attention to the requirements for the apartment, one of which is contained in the form of Sertifikat Laik Fungsi (SLF) based on Law No. 20 of 2011. SLF essentially functions in providing legality for the operation of an apartment and providing a sense of security. However, in fact there are still flats that have SLF, but they do not comply with the actual condition of the building's reliability, causing losses to the flat's occupants. One of them occurred at the PH Flats. For this reason, the author is interested in studying legal violations regarding SLF ownership by the PH Flats along with the legal measures that can be taken by the residents of the flats due to the losses they suffer. This research is based on normative research methods as well as statutory and conceptual approaches with data sources and types of primary legal materials. The results of this research indicate that legal violations regarding SLF ownership are caused by mal administrative actions by Dinas Cipta Karya dan Tata ruang in issuing SLF along with violations of building reliability requirements carried out by apartment developers. There are legal remedies that can be taken by apartment residents, both in litigation and non-litigation efforts.
 
The Effect of Market Orientation and Competitive Advantage on Retail Industry Marketing Performance with Trust as a Mediation Variable
Full text linkPurpose: This study aims to analyze the influence of market orientation and competitive advantage on marketing performance in the retail industry in the digital transformation era, with trust as a mediating variable. This study's novelty lies in exploring trust as an intervening variable, providing a deeper understanding of its role in improving marketing performance.
Method: This study uses a quantitative approach with Structural Equation Modeling analysis using SmartPLS 4 software. Primary data were collected from management and employees in the retail sector, with a conceptual framework linking market orientation, competitive advantage, trust, and marketing performance. The sample involved employees involved in retail operations, thus providing relevant insights into the industry dynamics.
Result: The results of the study indicate that market orientation and competitive advantage have a significant effect on marketing performance. In addition, both variables also have a significant effect on trust. Trust, in turn, has a significant positive effect on marketing performance. Trust also mediates the relationship between market orientation and marketing performance and between competitive advantage and marketing performance. This finding confirms the important role of trust as a mediating variable in strengthening the influence of market orientation and competitive advantage on marketing performance. Further research is recommended to explore other moderating or mediating variables, such as digital literacy or organizational culture. Expanding the study to different industries can also provide a broader perspective on market orientation, competitive advantage, and trust dynamics
Analisis Politik Hukum Pertanahan Terhadap Perlindungan Data Sertifikat Elektronik
Full text linkTechnological advancements and digital breakthroughs have prompted the Ministry of Agrarian Affairs and Spatial Planning, in collaboration with the National Land Agency, to modernize land administration by implementing electronic land registration through digital certificates. In 2021, the introduction of Electronic Land Certificates (STE) began with the release of Regulation Number 1 of 2021 by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency. This regulation was subsequently replaced and updated with Regulation Number 3 of 2023, focusing on the issuance of digital documents within land registration processes. Despite its benefits, this innovation has introduced new challenges, particularly in addressing the risks associated with cybercrime. One significant threat is the potential loss of an electronic certificate due to hacking. To address these concerns, both vertical and horizontal legal protection is necessary. The minister must ensure that comprehensive legal safeguards are in place, protecting against government interference as well as threats from individuals or other groups in relation to the security of electronic certificates. The research question raised in this paper is whether there is an adequate legal framework regulating the protection system of electronic certificate data stored in electronic vaults. The purpose of this paper is to analyze the political law of land administration regarding electronic certificates and to examine the legal protection of data stored in electronic vaults. This study concludes that the validity and security of electronic land certificates require comprehensive safeguards, including encryption mechanisms and the role of the National Cyber and Crypto Agency (BSSN), to prevent risks of digital loss or manipulation
Perbandingan Hukum Jaminan Fidusia Antara Indonesia dan Belanda Pasca Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019
Full text linkThe Constititional Court Decision Number 18/PUU-XVII/2019 significantly changed the execution mechanism of fiduciary guarantess in Indonesia. Previously, creditors holding a Fiduciary Guarantee Certificate could directly execute the guarantee without a court ruling. Nevertheless, after the ruling, enforcement may proceed solely when the guaranteed asset is handed over willingly as a result of the debtor’s acceptance of their noncompliance. Otherwise, the creditor must seek court approval. This shift creates legal uncertainty and weakens the creditor’s legal standing. This paper addresses two main issues: (1) What are the impacts of the Constitutional Court Decision Number 18/PUU-XVII/2019 in conjuction with Decision Number 2/PUU-XIX/2021 on creditor protection in fiduciary guarantees ? And (2) How does the post-decision guarantee system in Indonesia compare to the Dutch legal system, particularly in terms of creditor protection and execution procedures? The study examnines how the Constitutional Court’s rulling affects vreditors’ right while also considering the Dutch non-possessory (silent pledge) as a potential reference for legal reform. Since 1992, the Netherlands has replaced fiduciary guarantees with the silent pledge, a system that ensures creditor priority without requiring court involvement and offers stronger legal certainty. This model may serve as a viable solution to improve the fairness and effectiveness of fiduciary guarantee enforcement in Indonesia
The Impact Of Online Game Addiction On Financial Behavior (Case Study Of Gen Z In Sub Urban Islamic Economic Perspective)
Full text linkPurpose: The purpose of this study is to examine, from an Islamic economic standpoint, the effects of online game addiction on the financial behavior of Generation Z in suburban regions. This study is novel because it combines behavioral finance, digital consumption patterns, and Islamic ethical values to investigate how digital-native youth handle their finances after engaging in prolonged gaming. This has not been extensively studied in prior research, especially in the context of Islamic economics.
Method: This study used a qualitative case study methodology. 13 members of Generation Z living in suburban Sidoarjo who fit the description of online gamers who play for more than five hours every day and have dealt with in-game purchases made up the unit of analysis. Triangulation was used to ensure the validity of the data. Islamic financial behavior theories served as the foundation for the conceptual framework, and descriptive qualitative analysis with phases of data reduction, presentation, and conclusion drawing was the analytical methodology employed.
Result: The findings reveal that online game addiction significantly influences impulsive and unplanned digital spending habits among Gen Z. While many informants are aware of Islamic financial principles, their application in daily financial decisions remains minimal. However, some informants have begun adopting more responsible behaviors. This study contributes to the growing discourse on Islamic behavioral finance and recommends the development of contextualized Islamic financial literacy models for digital-native generations. Antara citra dan realita: Peran CSR terhadap return saham dalam bayang-bayang penghindaran pajak
Full text linkPurpose – This study aims to test and analyze the effect of corporate social responsibility on stock returns, as well as the role of tax avoidance as a moderating variable in health service and pharmaceutical sector companies listed on the IDX for the 2021-2023 period.
Methods – This study uses a quantitative approach with secondary data sources. Data analysis was conducted using Moderated Regression Analysis (MRA) to test the interaction relationship between CSR and tax avoidance on stock returns.
Findings - The results of this study indicate that CSR disclosure has a positive effect on stock returns. Meanwhile, tax avoidance does not moderate the effect of CSR disclosure on stock returns.
Implications - This study provides theoretical contributions to the development of signaling and legitimacy theory, as well as practical benefits for academics, companies, investors, and government in understanding the relationship between CSR, tax avoidance, and stock returns as a basis for decision making and policy making.
Originality - This study enriches the literature by presenting tax avoidance as a moderating variable in the relationship between CSR and stock returns, which has rarely been examined in previous studies
Analisis wacana kritis atas aspek sosial dari isu keberlanjutan
Full text linkPurpose – The purpose of this study is to explain the emerging narratives about the social aspects of sustainability issues in companies that belong to the technology sector of the new economy listing board.
Methods – The paradigm used in this research is discourse analysis. Researchers used the document analysis method that focus more on social aspects due to the indirect and low impact in this studied sector.
Findings - This research unravel the emerging narrative amongst companies’ reports in the new economy listing board technology. Those are compliant, transparent, and strongly committed to running social programs to contribute the SDGs. These narratives are confirmed by the triangulations in the mass media that demonstrated the real conditions. In conclusion, the emerging naratives bring about the message that elaborate the focus of the company in addressing the sustainability issues, which is about compliance or achieving certain targets.
Implications - This research can contribute to add insights in sustainability research and the researcher wants to show that the public can see the narrative built on sustainability reports that are reported on sustainability issues.
Originality - Previous research has mostly discussed the manufacturing and banking sectors while the technology sector is still very rarely studied
STUDI KEPATUHAN DAN KENDALA PAJAK BAGI INFLUENCER TIKTOK DI INDONESIA
Full text linkDigital transformation has given birth to new professions such as influencers, who earn income from endorsements, sponsorships, and content monetization on platforms such as TikTok. The increasing income of influencers makes taxation an important issue in the Indonesian tax system. However, many influencers still do not understand or ignore their tax obligations. This study aims to show the importance of tax for influencers as a form of individual responsibility and contribution to the country. In addition, applicable tax regulations, legal risks for non-compliance, and the effect of tax on endorsement prices and influencer business strategies are also discussed. The method used is qualitative with a normative and empirical legal approach. With this approach, it is hoped that it can provide a deeper understanding of the presence of tax among TikTok influencers and its impact on their business decisions in choosing collaborations, pricing strategies, and sustainable sources of income
Efek Samping Agranulositosis Imbas Metamizole: Kajian Pustaka
Full text linkAgranulositosis merupakan kondisi yang jarang terjadi, namun dapat berpotensi fatal dan menyebabkan kematian apabila tidak ditindaklanjuti secara tepat dan cepat. Insidensi agranulositosis yaitu 6,2 juta kasus/penduduk/tahun. Agranulositosis imbas obat dapat disebabkan oleh analgesik antipiretik metamizole, dimana aksesibilitas metamizole mudah di Indonesia. Tujuan penulisan artikel ini adalah untuk memaparkan kejadian agranulositosis imbas metamizole. Tinjauan pustaka dilakukan dengan pencarian artikel melalui basis data Pubmed dan Google Scholar. Berdasarkan eksplorasi literatur, beberapa faktor risiko yang mempengaruhi kejadian agranulositosis adalah jenis kelamin, usia lanjut, infeksi virus dan durasi penggunaan yang lebih lama. Oleh karena itu, diperlukan pertimbangan mengenai manfaat dan risiko penggunaan metamizole.
Agranulocytosis is a rare but potentially fatal condition that can lead to death if not promptly and appropriately managed. The incidence of agranulocytosis is estimated at 6.2 cases per million population per year. Drug-induced agranulocytosis can be triggered by the use of the analgesic and antipyretic agent metamizole, which remains widely accessible in Indonesia. This article aims to present findings related to agranulocytosis induced by metamizole. This literature review was conducted through article searches in the PubMed and Google Scholar databases. Based on the reviewed literature, several risk factors influencing the occurrence of agranulocytosis include female gender, older age, viral infections, and prolonged duration of metamizole use. Therefore, careful consideration of the benefits and risks of metamizole use is essential in clinical practice.

Formulasi dan Uji Stabilitas Sediaan Masker Gel Peel-Off Ekstrak Seledri (Apium graveolens L.) dengan Variasi Konsentrasi Polivinil Alkohol (PVA)
Full text linkSeledri (Apium graveolens L.) memiliki kandungan flavonoid, saponin dan tanin yang memiliki aktivitas antibakteri pada Cutibacterium acnes. Penelitian ini bertujuan untuk mengembangkan manfaat seledri dalam bentuk masker gel peel-off dengan konsentrasi polivinil alkohol (PVA) sebagai lapisan film sebesar 4%, 7%, dan 10%, serta mengetahui hasil uji mutu fisik dan uji stabilitas menggunakan metode cycling test dengan suhu ± 4°C dan ± 40°C selama 3 siklus. Analisis data hasil uji stabilitas diolah menggunakan uji One Way ANOVA. Hasil uji mutu fisik menunjukan bahwa masker gel peel-off ekstrak seledri dengan variasi konsentrasi PVA memiliki perbedaan pada hasil uji organoleptis, uji pH, uji daya sebar, uji daya lekat dan uji waktu mengering. Hasil uji stabilitas menunjukkan bahwa ketiga formula masker gel peel-off ekstrak seledri stabil selama pengujian. Konsentrasi PVA yang menunjukkan hasil paling baik yaitu PVA 10% dengan bentuk sangat kental, pH 5,42 ± 0,02, daya sebar 5,16 ± 0,03 cm, daya lekat 5,23 ± 0,06 detik, dan waktu mengering 18,0 ± 1,0 menit.
Celery (Apium graveolens L.) contains flavonoids, saponins and tannins which have antibacterial activity against Cutibacterium acnes. This study aims to develop the benefits of celery in the form of a peel-off gel mask with a concentration of polyvinyl alcohol (PVA) as a film layer of 4%, 7%, and 10%, also determining the results of physical quality and stability tests using the cycling test method with temperatures of ± 4°C and ± 40°C for 3 cycles. Analysis of stability test data was processed using the One-Way ANOVA test. The results of the physical quality test showed that the celery extract peel-off gel mask with variations in PVA concentration had differences in the results of organoleptic, pH, spreadability, adhesion and drying time tests. The stability test results showed that the three celerys extract peel-off gel mask formulas were stable during testing. The PVA concentration that showed the best results was 10% PVA with a very thick form, pH 5.42 ± 0.02, spreadability 5.16 ± 0.03 cm, adhesiveness 5.23 ± 0.06 seconds, and drying time 18.0 ± 1.0 minutes.
