    Anayasa Mahkemesi Kararları Işığında Hemşirenin Hukuki Sorumluluğu

    Bu çalışmada, Anayasa Mahkemesinin kararlarıyla ilgili resmi sayfasına giriş yapılarak hemşirenin özel hukuk bakımından doğrudan veya dolaylı olarak sorumlu tutulduğu davalar, içerikleri analiz edilmek maksadıyla incelendi. Hukuki sorumlulukla ilgili Anayasa Mahkemesine yapılan beş adet bireysel başvurunun büyük bir çoğunluğunda (%80) adil yargılanma ve %40 oranında da maddi ve manevi varlığını koruma ve geliştirme haklarının ihlalleri hukuki sebeplerinin bulunduğu görüldü. Derece mahkemelerinde açılan davaların konusu, büyük bir oranda (%80) hemşirenin görev, yetki ve sorumluluklarına ilişkindir. İçeriğinde en fazla (%40), tedavi ve bakım uygulamasını gereği gibi yerine getirme yükümlülüğü yer almaktadır ve davaların çoğunluğu (%60) sözleşmeye dayanılarak açılmıştır. Anayasa Mahkemesi kararlarının çoğunluğu hemşirenin lehine sonuçlanmıştır ve hemşire, davanın tarafı pozisyonundadır. Sağlık hizmeti sunumunda önemli ve merkezi bir pozisyon olan hemşirelik mesleğinde, özellikle de hukuki sorumluluk belirlenirken, hemşirenin karar ve uygulamalarını etkileyebilecek faktörlerin ve fiziksel çevrenin göz önünde bulundurulması gerekir. Anayasa Mahkemesi, ancak görev, yetki ve sorumlulukları çerçevesinde konuya dikkat çekebilecektir

    A preliminary investigation of the association between KRAS, NRAS, and BRAF mutations and colorectal cancer in Turkish patients

    Somatic mutations in the GTPase RAS protein family and the downstream serine-threonine kinase BRAF are predicted to be key driver muta-tions in colorectal carcinogenesis by disrupting critical control points in cell cycle regulation. In our study, we aimed to investigate the relationship between KRAS, NRAS, and BRAF mutations in colorectal cancer (CRC) samples and cor-responding clinicopathological data. This retrospective study included 64 CRC patients who were evaluated for KRAS, NRAS, and BRAF mutations in our de-partment between 2022 and 2024. The findings were evaluated according to the age, gender, tumor localization in the colon, and histopathological subtype of the patients in whom the mutation was detected, and the relationships be-tween these variables were analyzed using the chi-square test. KRAS mutations were detected at 29.6%, NRAS mutations at 3.1% and BRAF mutations at 1.6%. No significant relationship was found between mutation rates and the patients' age, gender and colon localization. Our study demonstrated that mutations in KRAS, NRAS, and BRAF were not associated with the age, sex, and tumor loca-tion of CRC patients. The data presented are preliminary findings, and more research is needed to evaluate the clinical and pathological impact of these mutations on colorectal cancer progression and outcomes

    The effect of incentive spirometry with early pulmonary rehabilitation on hospital stay of patients with chronic obstructive pulmonary disease exacerbation

    BACKGROUND:Incentive spirometry (IS) is a cost-effective, easy-to-use, and accessible device used peri-postoperative period for prevention or management of complications via maintaining maximum inhalation and open collapsed alveoli and resolving atelectasis. Although early pulmonary rehabilitation (PR) is known to reduce the length of stay (LOS), it is controversial whether the addition of IS provides a further contribution. This study aimed to investigate whether using IS in addition to early PR in patients with chronic obstructive pulmonary disease (COPD) exacerbation reduces LOS and whether it is a safe technique by assessing hemodynamic responses.METHODS:One hundred thirty patients with acute exacerbation of COPD (AECOPD) during hospitalization were randomized to an early PR group and an additional IS group (PR + IS). LOS (days), pre-, and postsession hemodynamic responses were recorded.RESULTS:The LOS was significantly lower in the PR + IS (5.34 days) group than in the PR group (7.17 days) (P = 0.026). Changes in respiratory rate (breaths/min) and oxygen saturation (%) were within the well-tolerated interval in both groups and there was a statistically significant difference in the PR + IS group (P 0.05).CONCLUSION:The usage of IS in addition to early PR in patients with AECOPD reduced LOS by approximately 1 day compared to PR alone.     A Review of the Possibility of Application for Concrete Norm Control by the Turkish Football Federation Arbitration Board

    Arbitration, as an alternative dispute resolution method, is becoming more popular for resolving sports disputes and is also rising in Turkish law. Under the Constitution of the Republic of Turkey (the Constitution), objections to sports federations' decisions related to the management and discipline of sports activities can only be made to arbitration, which is the authorised body. Additionally, the arbitration board's decisions are considered final and cannot be appealed to the judiciary. According to the Constitution and other relevant statutes, the Turkish Football Federation Arbitration Board (TFF Arbitration Board) has been designated as the only authorised body to which objections can be made against decisions related to the management and discipline of sports activities by the Turkish Football Federation. However, it is uncertain whether concrete norm control is possible if the parties claim or if the TFF Arbitration Board finds that the laws applied by the Board in cases where it acts as a mandatory arbitral body are unconstitutional. It should be possible to raise objections to the Constitutional Court to protect the fundamental rights and freedoms guaranteed by the Constitution for sports stakeholders and to eliminate unconstitutional regulations in sports law. This study evaluates the conditions for resorting to concrete norm control, as stated in Article 152 of the Constitution, within the scope of the mandatory arbitration proceedings of the TFF Arbitration Board.     Çocuk ve Adölesanlarda Metabolik Sendrom Bileşenleri ile D Vitamini Düzeyi Arasındaki İlişki: Kesitsel Araştırma

    Amaç: Çocuk ve adölesanlarda metabolik sendrom (MetS) bi leşenleri ile D vitamini düzeyi arasındaki ilişkiyi değerlendirmektir. Gereç ve Yöntemler: Bu kesitsel çalışma, bir üniversite hastanesinin pediatri polikliniğine vücut ağırlığı artışı nedeniyle ile başvuran 6-18 yaş arası 118 çocukta yürütülmüştür. Çocuklara ait demografik bilgi ler anket aracılığı ile toplanmıştır. Çocukların bazı antropometrik öl çümleri (vücut ağırlığı, boy uzunluğu, bel çevresi, boyun çevresi) alınmış olup vücut kompozisyon analizleri yapılmıştır. MetS tanısında çocuklar için modifiye edilmiş Ulusal Kolesterol Eğitim Programı Ye tişkin Tedavi Paneli III [National Cholesterol Education Program Adult Treatment Panel (NCEP ATP III)] kriterleri kullanılmıştır. Bul gular: NCEP ATP III kriterlerine göre MetS prevalansı %34,7’dir. Çocukların 73’ünde (%68,9) D vitamini eksikliği/yetersizliğinin ol duğu saptanmıştır. Abdominal obezitesi olan çocuklarda D vitamini düzeyi abdominal obezitesi olmayanlara göre istatistiksel açıdan an lamlı derecede daha düşüktür (p=0,002). Çocukların abdominal obe zite dışındaki MetS bileşenlerine göre D vitamini açısından istatistiksel açıdan anlamlı fark olmadığı saptanmıştır. MetS’li çocukların orta lama beden kitle indeksi (BKİ) z-skoru, boyun çevresi, bel çevresi ve vücut yağ yüzde değerleri MetS olmayanlara göre yüksektir (p<0,05). Serum 25(OH)D düzeyi ile BKİ z-skoru (r=-0,291, p=0,002), bel çev resi (r=-0,240, p=0,013), boyun çevresi (r=-0,331, p=0,001), vücut yağ yüzdesi (r=-0,348, p=0,001) ve sistolik kan basıncı (r=-0,204, p=0,036) arasında negatif yönde bir ilişki olduğu saptanmıştır (p<0,05). Sonuç: Bu çalışma sonucunda, yaklaşık her üç çocuktan birinde MetS saptan mış olup, MetS bileşenlerinde abdominal obezitesi olan çocuklarda D vitamini düzeylerinin daha düşük olduğu saptanmıştır. Bu sonuçlar, ço cukluk çağında D vitamini düzeylerinin iyileştirilmesinin MetS riskini azaltma açısından yararlı olabileceğini düşündürmektedir

    Validity and Reliability of the Turkish Version of the Dynamic Evaluation of Motor Speech Skill (DEMSS-TR) Test for Children With Speech Sound Disorders

    BackgroundChildhood apraxia of speech (CAS) is a complex motor speech disorder that requires careful differential diagnosis, particularly in languages where validated diagnostic tools are lacking. The Dynamic Evaluation of Motor Speech Skill (DEMSS) is a widely used tool for identifying CAS, but a Turkish version had not yet been developed.AimsThis study aimed to adapt DEMSS into Turkish (DEMSS-TR) and evaluate its psychometric properties for use with Turkish-speaking children with speech sound disorders (SSD).MethodsEighty-two monolingual Turkish-speaking children aged 3;0 to 6;11 with SSDs participated. Participants were assessed for speech-motor skills, oral-motor function, articulation, and language development. Following translation and pilot testing, DEMSS-TR was evaluated for internal consistency, test-retest reliability and intra- and inter-rater reliability. Validity was assessed through expert-based content validation, cluster analysis and receiver operating characteristic (ROC) analysis.ResultsDEMSS-TR demonstrated strong reliability and validity. Cronbach's alpha exceeded 0.90 for all subtests and the total score. Test-retest coefficients ranged from 0.823 to 0.991, with inter- and intra-rater reliability consistently above 0.90. Content validity was supported by expert ratings, with all items exceeding a content validity ratio of 0.80. Cluster analysis revealed three distinct participant groupings consistent with CAS, mild CAS and non-CAS diagnoses. ROC analysis showed high sensitivity and specificity across subtests and total score, confirming the tool's diagnostic accuracy.ConclusionsDEMSS-TR is a reliable and valid assessment for identifying CAS in Turkish-speaking children with SSDs. Its dynamic, structured format allows clinicians to observe motor speech behaviours under cued and spontaneous conditions, supporting accurate diagnosis and treatment planning.     Synthesis, structural characterization, and photoluminescence behavior of NaCa4(BO3)3:Tb3+phosphors Co-doped with K plus : Insights into radiation-induced defect formation and charge compensation via DFT calculations

    This study explores the structural, optical, and electronic properties of NaCa4(BO3)3:Tb3+ phosphors, with and without K+ co-doping, via experimental techniques and Density Functional Theory (DFT). X-ray diffraction confirmed Tb3+ and K+ incorporation without phase change. Optimal green photoluminescence at 542 nm occurred at 2 wt% Tb3+; higher doping led to quenching due to multipolar interactions. While Tb3+ enhanced luminescence, K+ co-doping reduced it, likely from charge imbalance and defect formation. DFT results aligned with experiments, showing minor lattice distortion from Tb3+ and structural instability from K+, reflected in a slight band gap reduction (from 5.00 eV to 4.97 eV). Bader charge and formation energy analyses confirmed K+ does not fully compensate for charge imbalance, contributing to non-radiative centers and reduced luminescence. CIE analysis indicated tunable emission between green and yellow-green.     Anatomical structures of the obturator foramen and its importance for pelvic interventıons

    BackgroundIn clinical scenarios such as pelvic fractures, damage to the obturator neurovascular bundle, obturator neuropraxia, and mesh placement in patients with incontinence, preserving the anatomical structures related to the obturator foramen (OF) is crucial. This study aims to investigate the anatomical variations of the OF as a guide for identifying failure criteria and improving success parameters in clinical practice.MethodsThe OFs of one hundred adult dry pelvic bones were examined. Measurements were evaluated using ImageJ software. The morphology of the OF and the presence of bony projections on the inner surface of the foramen were assessed.ResultsThe anterior-posterior length was 5.24 +/- 0.8 cm on the right and 5.17 +/- 0.87 cm on the left. The superior-inferior length was 4.69 +/- 1.83 cm on the right and 4.66 +/- 1.69 cm on the left. The anterior-posterior vertical angle was 98.21 +/- 9.95 degrees on the right and 98.48 +/- 13.9 degrees on the left; the superior-inferior horizontal angle was 90.7 +/- 10.95 degrees on the right and 97.56 +/- 9.42 degrees on the left. The OF was categorized into six distinct types: quadrilateral (23%), ellipsoid (22%), and oval (17%). The ellipsoid-type OF showed a greater anterior-posterior length compared to the other types, while the triangular-type OF exhibited a greater symphysis pubis length. Notably, bony projections on the anterior edge of the inner surface of the OF were observed in 33% of cases. Additionally, bony projections on the posterior edge of the OF were described for the first time.ConclusionIn cases where OF is narrow and variable, and where bony projections are present on its inner surface, performing an osteotomy may help protect the obturator neurovascular bundle

Söz konusu sistemde fail ve mağ-dur, özgür iradeleriyle ve tarafsız bir üçüncü kişinin yardımıyla bir araya gelerek sorunu ele almakta ve fail, üzerinde anlaştıkları bir edimi ifa etmek suretiyle işlediği suç nedeniyle ortaya çıkan haksızlığı telafi etme yoluna gitmektedir.Fail ve mağdurun uzlaştıkları edimin uygulanmasına ilişkin özel hukuk ba-kımından birtakım sorular akla gelmektedir. Taraflar arasındaki edimin iş hukuku kapsamında değerlendirilip değerlendirilmeyeceği, iş sağlığı ve gü-venliği mevzuatının “çalışan” olarak kabul ettiği geniş çerçevenin içine failin dahil edilip edilmeyeceği, edimi ifa eden faillerin sosyal güvenlik hukuku kapsamında yer alıp almayacağı sorunları ile karşı karşıya kalınmaktadır. Çalışmamızda söz konusu hususlarda ilgili hukuk düzenlemelerinin yeterli olup olmadığı incelenecek ve istisna hükümler de dikkate alınarak, uygula-mada yaşanılan veya yaşanabilecek sorunların çözümüne yönelik değerlendirme yapılacaktır
