Analysing the recourse lawsuits of public official physicians arising from malpractice from a defensive medicine perspective
7406 sayılı Türk Ceza Kanunu ve Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun' un 14. maddesi ile 3359 sayılı Sağlık Hizmetleri Temel Kanun'una ek 18. madde eklenmiş ve sağlık meslek mensupları için hem soruşturma hem rücu davası süreci öncesi bir izin usulü getirilmiştir. İdare hukuku alanında rücu, idarenin sorumluluğu söz konusu olduğunda, kamu görevlisinin kusuru oranında, idarenin ödemiş olduğu tazminatı kamu görevlisinden talep etmesidir. Rücu davalarının konusunu, sağlık mesleğinin icrası kapsamında yapılan muayene, teşhis ve tedaviye ilişkin tıbbî işlem ve uygulamalar oluşturmaktadır. Kamu görevlisi hekimler için, tıbbi işlem ve uygulamalar nedeniyle malpraktis söz konusu olduğunda, öncelikle idare sorumlu olacaktır. İdarenin tıbbi uygulama hatası nedeni ile tazminat ödemesi durumunda kusuru oranında hekime rücu hakkı bulunmaktadır. Defansif tıp, hukuki ve cezai sorumluluk baskısı altında olan hekimlerin kendilerini korumak adına tıbben gerekli olmayan tetkikler istemesi veyahut yüksek riskli girişimlerden kaçınması şeklinde kendini gösteren tıbbi eylemleridir. Öncelikli amaç, şikayetlerden ve tıbbi malpraktis davalarından korunmaktır. Yapılan düzenlemeler, hekimlerin şikayet ve tazminat baskısı altında olmadan mesleklerini icra edebilmeleri adına önemlidir.Article 14 of the Law No. 7406 on the Amendment of the Turkish Penal Code and Certain Laws added an additional Article 18 to the Basic Law on Health Services No. 3359 and introduced a permission procedure for healthcare professionals before both investigation and recourse proceedings. In the field of administrative law, recourse is the claim from the public official for the compensation paid by the administration in proportion to the fault of the public official in case of the responsibility of the administration. The subject matter of recourse actions is medical procedures and practices related to examination, diagnosis and treatment within the scope of the performance of the healthcare profession. In the case of malpractice due to medical procedures and practices for public official physicians, the administration will be primarily responsible. If the administration pays compensation due to medical malpractice, it has the right of recourse to the physician in proportion to its fault. Defensive medicine is the medical actions of physicians under the pressure of legal and criminal liability, which manifests itself as ordering non-medically necessary examinations or avoiding high-risk interventions to protect themselves. Doğu Düşünce Sisteminin Hermann Hesse Romanları Üzerindeki Etkisi
Hermann Hesse, Batı dünyasını eleştirel bir kavrayışla ele alan Batı’ya ve Batılı bireyin kimlik sorununa Doğu düşünce sistemine yönelerek çözüm arayan yirminci yüzyılın en önemli yazarlarından biridir. Hermann Hesse’nin romanlarındaki Doğu anlatısı, Doğulu Öteki’de teselli bulma arzusundan ya da sıradan bir kültürel zemin ve emperyalist dürtüden ziyade Batı’daki kriz ortamı ve Batı’nın gidişatı hakkında bilgi vermesi açısından derin bir anlam içermektedir. Bu çerçevede çalışma, Doğu düşünce sisteminin Hermann Hesse’nin romanları üzerinde yarattığı etkiyi ortaya koymayı amaçlamaktadır. Çalışmada, Hermann Hesse’nin, Siddhartha, Demian: Emil Sinclair’in Gençliğinin Öyküsü, Narziss ve Goldmund, Çarklar Arasında, Boncuk Oyunu ve Bozkırkurdu adlı eserleri karakterler ve tematik yönden incelenmeye tabi tutulmuştur. Eserlerde Batı modernliğinin manevi yönünün insan doğasına ayak uyduramadığına ve materyalist değerleri yükselişe geçirdiğine dikkat çekilmektedir. Bu yönde, Doğu’nun ve bilhassa Hinduizm, Budizm ve Taoizm’in sunduğu değerlerin hem bireysel hem de kolektif açıdan insan doğasına daha uygun olduğu vurgulanmaktadır. Sonuç olarak, Hermann Hesse’nin romanlarında Doğu düşüncesi, Batı’nın ilerleme idealine duyulan şüphe ve ahlaki çöküşü karşısında sentezlenmesi gereken bir çözüm yolu olarak görülmektedir. Parçalanmış Batılı bireyin içinde bulunduğu çıkmazı ve anlam krizini aşıp bütünlüğünü sağlayabilmesi için Doğu düşünce sisteminde olduğu gibi maneviyata ve öğrenmede deneyime yer vermesinin önemi ile insanın doğayla ilişkisinin yeniden gözden geçirilmesi gerektiği ortaya konmaktadır
Determination of the strong coupling and its running from measurements of inclusive jet production
The value of the strong coupling alpha(S) is determined in a comprehensive analysis at next-to-next-to-leading order accuracy in quantum chromodynamics. The analysis uses double-differential cross section measurements from the CMS Collaboration at the CERN LHC of inclusive jet production in proton-proton collisions at centre-of-mass energies of 2.76, 7, 8, and 13 TeV, combined with inclusive deep-inelastic data from HERA. The value alpha(S)(m(Z)) = 0.1176(-0.0016)(+0.0014) is obtained at the scale of the Z boson mass. Assessing the impact of ticagrelor and aspirin treatment on random skin flap survival
BackgroundFlap necrosis is a common complication of random skin flaps. Various methods have been used to reduce flap necrosis. The combined application of aspirin and ticagrelor has not yet been investigated in terms of flap viability. This study aimed to report the effects of combined aspirin and ticagrelor treatment with those of ticagrelor and aspirin treatment alone.MethodsA McFarlane flap with 3 x 9 dimensions was used as an animal model. Four study groups, with 40 rats in total and 10 rats in each group, were designed: the control, aspirin, ticagrelor, and combined ticagrelor-aspirin groups. The drugs were administered daily immediately before the procedure and for a subsequent 7-day period. The rats were examined using radionuclide scintigraphy and photographic and histopathological examination.ResultsScintigraphic examination revealed that flap survival rate was significantly higher in the ticagrelor and combined groups. Neovascularization values were higher in all three groups than in the control group. Acute and chronic inflammation were lower in the combined and ticagrelor groups.ConclusionsCombined ticagrelor-aspirin and ticagrelor-alone treatments were more effective at increasing flap viability. How strong is the rhythm of perception? A registered replication of Hickok et al. (2015)
Our ability to predict upcoming events is a fundamental component of human cognition. One way in which we do so is by exploiting temporal regularities in sensory signals: the ticking of a clock, falling of footsteps and the motion of waves each provide a structure that may facilitate anticipation. But how strong is the effect of rhythmic anticipation on perception? And to what degree do people vary in their ability to capitalize on these regularities? In 2015, Hickok et al. introduced a behavioural paradigm to assess how a rhythmic auditory stimulus affects perception of subsequent targets (Hickok G, Farahbod H, Saberi K. 2015 The rhythm of perception: entrainment to acoustic rhythms induces subsequent perceptual oscillation. Psychol. Sci. 26, 1006-1013. (doi:10.1177/0956797615576533)). They tested five listeners and found that perception (target detection accuracy) fluctuated rhythmically just like the sound rhythm. Here, we replicate the original finding, assess how likely the finding is to be observed for any individual, and quantify effect size in a large sample of adult listeners (n = 149). We introduce a model-based analysis approach that allows separate estimates of amplitude and phase information in target detection responses, and quantifies effect size for individual listeners. Together our results strongly support the presence of oscillatory influences on target detection accuracy, as well as substantial variability in the magnitude of this effect across listeners.Max-Planck-GesellschaftWe thank Greg Hickok and Kourosh Saberi for providing the code and data from the original paper, and for comments on the experimental design. The effect of postpartum-specific anxiety on the type of breastfeeding and mindful breastfeeding
Amaç: Bu araştırmanın amacı; pospartuma özgü anksiyetenin (PÖA) emzirme şekli ve emzirmede farkındalığa (EF) etkisini değerlendirmektir. Yöntem: Tanımlayıcı, kesitsel ve korelasyonel tipteki araştırma, Ocak-Temmuz 2024 tarihleri arasında İzmir Atatürk Eğitim ve Araştırma Hastanesi'nin Kadın Hastalıkları ve Doğum Polikliniği ile Çocuk Sağlığı ve Hastalıkları Polikliniği'ne başvuran 297 kadınla yürütülmüştür. Veriler; Kişisel bilgi formu, Postpartuma Özgü Anksiyete Ölçeği (PÖAÖ) ve Emzirmede Farkındalık Ölçeği (EFÖ) ile toplanmıştır. Veriler IBM SPSS 27.0 paket programında; Mann Whitney U testi, Kruskal Wallis testi, Spearman korelasyon analizi testi ve Bonferroni ileri analizi ile analiz edilmiştir. Method: The descriptive, cross-sectional and correlational study was conducted with 297 women who applied to the Gynecology and Obstetrics Outpatient Clinic and Child Health and Diseases Outpatient Clinic of İzmir Atatürk Education and Research Hospital between January and July 2024. Data were collected with the Personal Information Form, Postpartum-Specific Anxiety Scale (PSAS) and Mindful Breastfeeding Scale (MINDF-BFS). Data were analyzed with the Mann Whitney U test, Kruskal Wallis test, Spearman correlation analysis test and Bonferroni advanced analysis in the IBM SPSS 27.0 package program. p0.05). No statistically significant relationship was found between the total score average of PSAS and the total score average of MINDF-BFS (p=0.191). Conclusion: The majority of the participants had a PSA level below the cut-off point. No relationship was found between postpartum-specific anxiety and breastfeeding style and mindful breastfeeding. Arthur Schopenhauer’ın İsteme Felsefesi: Varoluşsal Bir Esaret Trajedisinin Ana Hatları
Bu makale, isteme kavramının Schopenhauer felsefesinde ne kadar mühim bir yerde olduğunu gösterme ve bu eksenden hareketle Schopenhauer felsefesinin içsel gerilimlerine dair genel bir bilgi verme amacına yöneliktir. Schopenhauer’ın isteme felsefesini boydan boya kat eden bir esaret trajedisi, onun ahlaki ve estetik kurtuluş senaryoları karşısında yaratıcı bir gerilim hattı sergiler. Makalede Schopenhauer’ın felsefesinin öne çıkan tezlerine bu gerilim ışığında yaklaşılmaktadır. Bu bağlamda, öncelikle Schopenhauer’da istemenin nasıl oluşturulduğu Immanuel Kant’ın epistemolojisinden hareketle ortaya konmaya çalışılmıştır. Burada istemenin ana karakteri belirlenerek varoluşun neresinde konumlandırıldığı; etkinliği, aktifliği, yapabilirliği ve yaratabilirliği sorgulanmıştır. Daha sonra, istemenin dünyayı açıklamada Schopenhauer felsefesine tayin ettiği tema, dünyayı istemenin bir tezahürü olarak gören Schopenhauer felsefesinden örneklerle gözler önüne serilmeye çalışılmıştır. Son olarak, Schopenhauer’ın öncüllerinden çıkan istemenin kendisinden kurtulma senaryolarının belirleyici argümanları ele alınarak, felsefesinin özgün kazanımlarının ahlak ve estetikteki veçhelerine ilişkin bir değerlendirme sunulmuştur
Search for heavy neutral Higgs bosons A and H in the t(t)over-barZ channel in proton-proton collisions at 13 TeV
A direct search for new heavy neutral Higgs bosons A and H in the t (t) over barZ channel is presented, targeting the process pp -> A -> ZH with H -> t (t) over bar. For the first time, the channel with decays of the Z boson to muons or electrons in association with all-hadronic decays of the t (t) over bar system is targeted. The analysis uses proton-proton collision data collected at the CERN LHC with the CMS experiment at root s = 13 TeV, which correspond to an integrated luminosity of 138 fb(-1). No signal is observed. Upper limits on the product of the cross section and branching fractions are derived for narrow resonances A and H with masses up to 2100 and 2000GeV, respectively, assuming A boson production through gluon fusion. Transcultural adaptation and validation of the Constipation Assessment Scale in Turkish cancer patients: A diagnostic accuracy study
Constipation is a common and distressing side effect among cancer patients undergoing treatment, significantly affecting their quality of life and treatment adherence. Accurate assessment is essential for timely and effective management. This study aimed to adapt the Constipation Assessment Scale into Turkish and evaluate its validity and reliability among Turkish cancer patients. This methodological study was conducted with 100 cancer patients receiving treatment in a public hospital in & Idot;zmir, Turkey. The adaptation process included translation, back-translation, expert review, and pilot testing. Content validity was assessed using the Content Validity Index, and construct validity was evaluated through confirmatory factor analysis. Reliability was tested using Cronbach alpha, item-total correlations, and test-retest analysis. The Content Validity Index was 1.00, indicating excellent content validity. Confirmatory factor analysis results supported the scale's construct validity with acceptable model fit indices. Cronbach alpha was 0.926, demonstrating high internal consistency. Test-retest analysis showed strong stability over time, with high intraclass correlation coefficients and no significant differences between administrations. The Turkish version of the Constipation Assessment Scale is a valid and reliable tool for assessing constipation in cancer patients. Its use in clinical practice can enhance symptom monitoring and support timely interventions in oncology care
Electromechanical demonstration of premature ventricular contraction-induced atrial cardiomyopathy by P wave duration-to-amplitude ratio (PWDAR) and left atrial strain
Introduction: High premature ventricular contraction (PVC) burden is known to cause atrial remodeling. P wave duration-to-amplitude ratio (PWDAR) is a new P wave index that includes both P wave duration and P wave voltage, which can be considered to effectively evaluate atrial cardiomyopathy. 3D speckle-tracking echocardiography is accepted as a valid and reliable technique for assessment of the left ventricle (LV) and left atrium (LA). Aim: In the present study, we investigated whether patients with a high PVC burden exhibit subclinical left atrial electrical and mechanical dysfunction, assessed electrically using PWDAR and mechanically using 3D-speckle tracking echocardiography. Material and methods: Seventy-five patients with PVC (PVC+) and 75 age- and gender-matched controls were enrolled in the study. Surface 12-lead standard electrocardiograms (ECGs) were recorded. Clinical characteristics and laboratory values of the patients were obtained. Conventional 2D echocardiographic and 3D-STE analyses were performed. Results: The PWDAR was significantly higher in the PVC+ group than in the control group (p < 0.001); and the LAS-r, LAS-active, and LV-GLS were significantly depressed in the PVC+ group (p < 0.001, p < 0.001, p = 0.015, respectively). The multivariate regression models demonstrated that PWDAR (p < 0.001), LAS-r (p < 0.001), LAS-active (p = 0.008), and LV-GLS (p = 0.021) were independent factors predicting PVC-induced atrial cardiomyopathy (PVC-ACMP). Conclusions: Our results revealed subclinical left atrial electrical and mechanical dysfunction in patients with a high PVC burden. PWDAR and left atrial strain parameters can predict PVC-ACMP
