    Legal Status of Third Gender in India with Special Reference to Kanpur Division

    Liberty, equality, and fraternity, which have been provided by the Constitution to the people of India, are the main goals of social, economic, and political justice. The main purpose of \u27justice\u27 is to establish harmony between individual interests and social interests.1 Despite this, there is a section of society that was forced to be deprived of the right to equality due to its unclear gender and sexual identity, but on 15 April The “NALSA Verdict” given by the Supreme Court in 2014 was a landmark judgment for the status of the third gender community and for giving them a clear identity. All the fundamental rights given under the Indian Constitution apply equally to the third gender and provides a clear identity to the third gender community.     Abstract: Patriarchy is the name of a global effect of domination made possible by a myriad of power relations at the micro-level of society. With this knowledge in mind, Anita Desai seems to have adopted a skeptical stance towards the modern discourses on emancipation that have a claim to universal truth and to represent the Archimedean leverage point from which the society can be moved. Rather she has made an attempt at focusing on the power relations at the micro-level of society without giving privilege to a general theory and a single locus of resistance to Patriarchy. In her fiction, she has resurrected the subjugated knowledge she, like a genealogist, has located many discontinuous individual women’s struggles against different forms of power in different patriarchal societies. These struggles are mainly organized from two post-colonial strategic positions: appropriation and abrogation. As a corollary of this, her female protagonists, equipped with oppositional consciousness and sometimes endowed with a vision of an alternative world, are found to selectively either appropriate or abrogate different social institutions and cultural practices to serve their personal ends

    Abstract Children are a Treasure their worth we cannot Measure. Children are the ultimate gift to two people who love each other. There is no bigger responsibility, and yet a relationship with a child, can bear the greatest rewards. It is not exaggerating to say that CHILDREN are one of the most precious gifts of God to every living creature on this planet. And it’s docile here to say that a woman is complete when she becomes a mother & a family is complete when a child is born. But unfortunately there are some couples who remain shunned from this magnificent God gift. Advances in Assisted Reproductive Techniques such as donor insemination and, embryo transfer methods, have revolutionized the reproductive environment, resulting in Surrogacy, as the most desirable option. The system of Surrogacy has given hope to many infertile couples, who long to have a child of their own. But at the same time Surrogacy is challenging the Social, Legal, Ethical and Religious Ethics and Ethos of Mankind. My Research paper throws light on the darker side of Surrogacy and try’s to answer the question “Whether a Child who is purchased by the Intended Parents has any Right?” I have just submitted my Thesis on Surrogacy and so my Paper shall unveil certain facts which are the result of my Six years of Research on this topic. Under any Surrogacy arrangement, the Intended Parents are considered to be the most important party and therefore majority of Surrogacy contract are drafted in support of Intended Parents overlooking the Rights of Surrogate and the Child. The Surrogate Mother and the child born via Surrogacy are totally neglected in the entire arrangement. My paper shall act as a reservoir of Knowledge as I have left no stone unturned to enlighten the readers about the Pathetic and Deplorable life which the product named as “DESIGNER BABY” are bound to live once they are born

    The democratic governance system has developed as the most popular governance system in the modern era, democratic governance system has been adopted in most countries of the world. Under the democratic governance system, it is possible to ensure the participation of common people in governance without any discrimination, which is not possible in any other governance system in such a wide way. The assured participation of the common people in the democratic governance system is not only an indicator of the success of democracy, but it is also important from the point of view of the convenience of governance. The local government system is accepted as a major link to ensure the participation of common people in democracy. Recognizing the importance of the local governance system in Indian democracy, emphasis was laid on the adoption of the local governance system under policy-directive elements in the constitution, which became legally effective in the form of the Panchayati Raj system under the 73rd Constitutional Amendment Act. In the Panchayati Raj system, it was expected to ensure the participation of common people without any discrimination, but due to gender discrimination for centuries, women in India were kept away from governance power, but according to the basic ideals of democracy, freedom, and equality, women in governance power Provision for reservation has been made constitutionally to ensure equal participation of men, so that women can also strengthen the roots of democracy by their participation in governance. Under the Haryana Panchayati Raj Act, of 1994, a provision for reservation has been made for women under the 73rd constitution. The provision of reservation has definitely increased the participation of women in Panchayati Raj Institutions at the local level and women empowerment has been able to get direction

The British did the work of dividing Hindus and Muslims through many acts. Because of this communalism started between Hindus and Muslims. Muslim League and Jinnah worked to increase this communalism. Apart from this, Hindu Mahasabha also worked to increase communalism, due to which communal violence broke out and thousands of people lost their lives. Congress also contributed in promoting communal politics in the country. On many occasions, Congress did not give importance or gave too much importance to the Muslim League, due to which its ambition increased, which later became the reason for the partition of the country

    In India, women have been considered a goddess since time immemorial. Because only women do the work of carrying forward the creation of the universe. Women are considered to be the first teachers of the child in the form of mothers. When a young person becomes a doctor, someone will become a President, someone will become a Prime Minister and some will contribute to nation-building by becoming a teacher. Then it is said that the way children are brought up and brought up, their personality is formed in the same way, and accordingly, they contribute to the building of the nation.     महिला केवल सृष्टि की रचना ही नही करती है बल्कि वह वच्चे को जन्म देने के साथ ही साथ उसके स्वास्थ्य और शिक्षा आदि पर भी ध्यान देती है। वह बच्चे का उचित रूप से पालन करती है। और एक देश के भविष्य का निर्माण करती है। लिंग के आधार पर न्याय (Gender justice) सभी से संबधित है इसके महत्व को समझते हुये संयुक्त राष्ट्र द्वारा कई विश्व सम्मेलन आयोजित किए गए। महासभा द्वारा वर्ष 1979 में महिलाओं के विरूद्ध सभी प्रकार के भेदभावों की समाप्ति पर अभिसमय (Convention on the all forms of discrimination against women) अंगीकर किया तथा वर्ष 1981 में लागू हुआ भारत में भी इसको 1993 में अनुसमर्थित किया। वर्ष 2001 को महिला सशक्तिकरण वर्ष (women’s empowerment year) के रूप में मनाया जाता हैं केवल इतना ही नही महिला सशक्तिकरण वर्ष मनाये जाने के उपंरात भारत के तत्कालीन राष्ट्रपति महामहीम श्री के.आर. नारायणन ने गणतंत्रत दिवस के अतिंम भाषण में महिलाओं के विरूद्ध अपराध बढ़ने पर अत्यधिक चिंता व्यक्त की थी। महिलाओं के प्राचीन काल से वर्तमान तक समाज मे अपनी महत्पूर्ण भूमिका का निर्वाह किया है। महिला ने हर कदम पर सफल रहते हुये समाज की उन्नति को साकार रूप दिया है, इतना ही नहीं, बल्कि महान व्यक्तियों की सफलता मे भी महिलाओं का विशेष योगदान रहा है, जैसे महाकवि कालिदास के पीछे विद्वोत्मा, तुलसीदास के पीछे उनकी पत्नी, महात्मा गांधी के जीवन मे उनकी मॉ पुतली बाई इत्यादि की प्रेरणा शामिल थी। महिला गृहस्थ जीवन की आधार शिला है एक महिला परिवार मे कई अहम भूमिकाओं का निर्वहन करती है कही वह मॉ के रूप में कही वह पत्नी के रूप में वही एक बहन भी है एक आर्दश मित्र भी और एक सेविका बन कर भी वह निस्वार्थ भाव से सेवा करती है
