    Become Recognized Minority in a Multicultural Society: An- Naim’s Theory in Responding to Ahmadiyyah Cases in Indonesia

    This study  aims  to  analyze  the  thoughts  of  Abdullah  Ahmed  an-Naim  related  of  constitutionalism,  human rights and citizenship based on justice in minority groups.  An-Naim’s thoughts on human  rights  can  be  accommodated  to  public  expectations  regarding  the  issue  of  the  Ahmadiyya  community  in  Indonesia.  Read an-Naim’s theory regarding women,  non-Muslim  status  and  apostasy. The issue of human rights initiated by an-Naim will be the basic foundation in the explicit explanation of this paper. Considering the existing social values based on the enforcement of human rights in Indonesia, the position of the Ahmadiyya community must be positioned equally in the law in terms of rights and obligations as  part  of  Indonesian citizens. The state must be neutral considering the Ahmadiyya community in responding to its religious existence.  The government must maintain neutrality in regulating religious life for every citizen in order to create an atmosphere of harmony and peace. This paper attempts to produce a peaceful religious discourse in the context of religious freedom in Indonesia

    Analysis of the Effect of Employee Engagement Mediated Human Resources on Developer Companies in Batam City

    Employee involvement usually affects human resources at company developers in Batam City. The study's primary objective was to identify the factors that most affected employee performance via the medium of employee engagement. The variables of training & development, compensation & benefits, leadership, recruitment & selection, and awards & recognition. The sample of this research are employees of a developer company in Batam City, where the sample acquisition is 384 data. In addition, the SmartPLS 3.2.9 program will be used to analyze the data samples. The test data obtained in this study, namely the direct test, showed that employee engagement was positively and significantly influenced by employee performance, and training & development, while compensation & benefits, leadership, recruitment & selection and reward & recognition were not. The direct test also shows that employee engagement is positively and significantly affected by employee performance, while the independent variable is not. The indirect test results through independent variables did not succeed in mediating employee engagement on employee performance

    Analysis Of Factors Affecting Brand Loyalty On Cosmetic Products In Batam

    This study aims to determine the effect of service quality, brand identification, convenience, trustworthiness, and product quality on brand loyalty by mediating consumer satisfaction on cosmetic products in Batam City. The technique of collecting data is by means of a survey using a questionnaire. The data collected were 330 respondents consisting of women who use cosmetics and live in Batam. The research methodology used is quantitative research methodology and Structural Equation Model analysis method using Smart Partial Least System 3. The results of this study find that service quality and brand identification have a significant positive effect on consumer satisfaction. Convenience, trust, and product quality have no effect on consumer satisfaction. The consumer satisfaction variable has a significant negative effect on brand loyalty

    The Forms of Intellectual Property Rights Waqf as a Part of Productive Waqf

    The paradigm of productive waqf is contained in Waqf Regulation (Law Number 41 of 2004 Concerning Waqf). This regulation expands the scope of property in waqf which was previously only on fixed objects, now includes movable objects, both tangible and intangible. As an intangible movable object, IPR (Intellectual Property rights) is one of the waqf objects in this regulation. However, the forms of IPR waqf has not been explained on waqf regulations . So that, this paper will discuss the forms of IPR waqf as a part of productive waqf form. First, the absolute handover of IPR by the wakif to Nazir.     This research is to uncover Zakiah Daradjat's thoughts on the concept of mental health and mental care. The research method used is library research with content analysis techniques. The results of the study show that as a religious psychologist, Zakiah Daradjat sees spirituality as mental therapy. Mental health is the ability to adjust to yourself, with other people and society and the environment in which he lives. To form a healthy mentality in addition to adjusting, as well as calmness of life, knowing psychiatric disorders / mental illness, spiritual and Islamic education which includes family education, school, society. In his opinion Indeed the peace of life, peace of mind or inner happiness, does not depend much on external factors such as social, economic, political, customary habits and as such; but more depends on the way and attitude to face these factors. So what determines calmness and happiness of life is mental health. Mental health is what determines a person's response to a problem, and his ability to adjust. Mental health is what determines whether people will have the excitement to live or be passive and lackluster. While mental care through creating a relationship between the consultant and the child, accepting the child seriously, forgiving the child (tolerance), knowing the feelings of the child and then reflecting his head, still respecting the child, the child who leads him in the treatment sessions, may not scramble for treatment, and limit restrictions

    The Rule Minimum Age of Marriage in Islamic Family Law in the Muslim World

    Questioning the issue of the minimum rules for marriage in Islam itself is not explained in detail about the minimum age for marriage. In jurisprudence, scholars of different schools of thought have different opinions regarding the minimum age limit for marriage, which in essence, someone who has reached the age of puberty can already get married. This article aims to discuss the minimum rules for marriage that are applied in every Muslim country in the world. The minimum marriage rules discussed are in Indonesia, Algeria, Bangladesh, Egypt, Iraq, Jordan, Lebanon, Libya, Malaysia, Morocco, Yaman, Pakistan, Somalia, Syria, Tunisia, Turkey, Afghanistan. The minimum age difference in some Muslim countries including Indonesia stems from the way each country determines the direction of their legislation, especially in marriage laws. Because in some countries it refers to the school of jurisprudence that it uses. Then, the purpose of the minimum age in marriage is to minimize the risks that will occur in marriage such as: Divorce caused by the immaturity of the child's mentality, difficulties in fulfilling family livelihoods, the potential for the birth of an unhealthy child caused by the biological immaturity of the child, and potential for maternal death due to pregnancy at an early age

    Analysis of the Mainstreaming Program for Religious Moderation for Students: Study of Ministerial Regulation of Education and Culture Number 45 of 2014

    Indonesia as an archipelagic country, has ethnic, linguistic, religious, cultural and social statuses. Religious moderation is an essential aspect in managing religious life in a plural and multicultural Indonesian society. In education discourse, religious moderation is an interesting issue, where currently, people in Indonesia have given serious attention to religious moderation. The purpose of this study is to find out what aspects of the Religious Moderation Mainstreaming program for students by examining Permendikbud No. 45 of 2014 concerning school uniforms for students at primary and secondary education levels. The research method is qualitative with a literature study approach. The conclusions in this study are 1) The mainstreaming program of religious moderation in schools. Where educational institutions can play a strategic role in religious moderation. 2) School uniforms as religious moderation, 3) School uniforms and religious rights, Identity in the form of this uniform initiates people's views of the religion adopted by students, and 4) School uniforms and attitudes of nationalism in religious moderation as a culture of tolerance which is described through respecting others, nationalism is related to the student's commitment to prioritizing the national interest

    Gusdurian network of Islamic social movements covers political discourse, resource mobilization, and movement framing. This movement started from critical-transformative of Islamic thinking to encourage social change in post-reform Indonesia. With the social dynamics after 1998 reform, the social movement of Gusdurian strive to find new breakthroughs to strengthen democratization, pluralism, and religious freedom in Indonesia. The Gusdurian social movement in encouraging religious social change takes advantage of political dynamics, optimizes resources, and frames them in various forms. The findings in this study show that the Gusdurian as a medium for Islamic social movements is a unique phenomenon containing young activists who continue and fight for what Gus Dur has fought for as a religious and national figure

    Halal Tourism as a Means of Empowering the People's Economy

    This study aims to explain the economic empowerment of the people based on halal tourism based on the Qur'an. The large number of global Muslim tourists visiting Indonesia, makes halal tourism potential to be one of the sectors driving Indonesia's halal industry. There are no less than 140 million Muslim tourists with online shopping of USD 35 billion every year. This is a challenge as well as an opportunity to make halal tourism a national tourism industry and a means of empowering the people's economy. This study used descriptive qualitative method. The results of the study indicate that the development of halal tourism can be used as a means to empower the people's economy. Opening up greater job opportunities thereby reducing unemployment. Improving the welfare of the people by opening up business and job opportunities. Can increase the income of the people so that it has an impact on increasing the ability of the community to be able to live more prosperously

    Review of Legal Protection of Indonesia in Australia Tapping Case

    Several facts show that Australia has done several times wiretapping efforts against Indonesia. It is generally known that action tapping is an act of collecting information in secret diplomatic relations of a country. This journal is meant for analyzing the principle of the prohibition of wiretapping in the National Law, legal protection, and legal remedies that can be taken by Indonesia in the case of wiretapping. The research method used in this study is juriditve normative. This research analyzes relevant international treaties, case approaches, legal concept analysis approaches, and comparative approaches. The results of the study legally tapping is prohibited by law and international human rights based on the Universal Declaration of Human Rights (UDHR) in 1948, the International Covenant on Civil and Political Rights (ICCPR) in 1966, the European Convention for the Protection of Human Rights and Fundamental Freedoms (1958) and the 1961 Vienna Convention. While in the national law, the prohibition of tapping is provided in Article 28G paragraph (1) of the 1945 Constitution, Article 32 of law No. 39 of 1999, Article 40 of Law No. 36 of 1999, Article 31 paragraph (1) of Law No. 11 of 2008, and Article 31 paragraph (2) of Law No. 11 the Year 2008. concluded, juridically tapping is an act prohibited under international law and human rights In international law, Indonesian national law prohibits wiretapping. Indonesia has signed the Code of Conduct on Framework for Security Cooperation to prevent wiretapping. Besides, Indonesia can also bring wiretapping cases to the International Court of Justice because the Defense Signals Directorate (DSD) is the Australian government's official intelligence agency. The behavior of relations between countries and tapping as done by Australia to Indonesia appears to have shifted the meaning no longer as a crime but rather a violation of the diplomatic code of ethics
