    Article 32 paragraph (1) letter k Election Commission Regulation No. 15 Year 2013 describes implementers, participants, and officials are prohibited from mobilizing campaigns Indonesian citizens who do not meet syarats as Voters. However, Law No. 8 of 2012 on General Election of DPR, DPD and DPRD itself, does not expressly prohibit the mobilization of Indonesian citizens who do not yet qualify as a selector or exploitation of children in political activities, including campaign. So that the Commission regulation violates the hierarchy of legislation that is in of commencement shall contrary to the Law on Election of Members of Legislative as higher regulations. Therefore, it is also not in line with Law No. 35 of 2014 on the Amendment of Act No. 23 of 2002 on Child Protection. Mobilization of children in the activities of the election campaign is the deprivation of the rights of the child. Intentionally or unintentionally, the actual implementers, participants, and campaign officers have done wrong treatment (exploitation) by mobilizing children who do not qualify as voters in political activities in the activities of the election campaign for the DPR, DPD and DPRD held at central and regional levels occur in almost all parts of Indonesia

    There is a strong commitment that constitutional adjudication should be more predictable. As a principle, what has been rightly decided in the past should be the law for the future cases or controvercies. This article makes a substantial critics directed to the constitutional court of decision Number 14/PUU-XI/2013 on the constitutionality of presidential election rules. This articles argues that the decision shows that predictability is still a serious matter in constitutional adjudication in Indonesia. The author then recommends that to be more predictable the constitutional of court should make a judicial tradition for respecting its past right decisions

    Recruitment is not an arena of  “hazing”  and  the  addition  of  bureaucracy  but a forum to explore the nature of integrity, capability, and independence of the candidates for constitutional judges. The process of recruiting candidates for constitutional judges to choose the recruitment system based on the principle of transparency, participatory, objective, and accountability to the people of the early stages and mechanisms of recruitment until the determination of the constitutional judges candidates that can lead to public confidence and form of democracy because of the position of the control and balance between state with people. Thus, the recruitment process needs to be accompanied by a written rule that can evolve as needed to create the best candidates for constitutional judges based recruitment process by filing recruitment agency and SOP (Standard Operational of Procedure). The problem is not on the persons making the recruitment, agency nominate candidates for judge, and the lack of setting the terms of the constitutional judge best candidate, but the choice of constitutional judges are recruited to promote open to the public process. DPR as one of the agency of the state to file a constitutional justice through the recruitment team can choose the right man in the right position through the selection of recruitment mechanism in accordance with the constitutional

    In the term of office of the legislators 2004/2009 period, a lot of the Bills which passed into legislation were not in favour of the people. Because of that, those      Bills became prejudice to the society due to the lack of conformation to what the people aspired to in the constitution (UUD 1945) which is the source and basis for the establishment of the legislation. Therefore, many legislation were tested with judicialreview by the constitutional court on the application of the public. Based on this judical review and the usage of normative research by the author, it is found that substances of the legislation are contrary to the constitution (UUD 1945). Because the legislation specified in the list of Prolegnas made by the parlement (DPR) and the President has not fully used clear, precise and consistent criteria. Therefore, the legislation established by parlement 2004/2009 period do not meet the principles of the establishment of the legislation according to the act Number  12 Year  2011 on the establishment of the legislation

    Concurrent local elections to be held in December 2015, characterized by the dynamics of democracy and new political dynamics. Dynamics it is the birth of a single candidate in several areas that will carry out the election. It is on the one hand shows that the dynamics of democracy in the country increasingly show progress and our society is increasingly “literacy” and political savvy, but on the other hand it raises a new problem, namely whether the elections will be postponed or published decree. This happens because the legislators did not expect the birth   of a single candidate. This fact shows that the lawmakers have not been able to make laws that meet the philosophical and sociological aspects of that legislation was well received presence in the midst of society without conflict and live longer. Because it is common to occur in Indonesia legislation only whole corn.Issues to be addressed in this study is what legal remedies in the face of a single candidate and how the legal steps to prevent the birth of a single candidate in the elections. This study is a normative legal research, using qualitative juridical analysis. The result showed that the legal solutions that can be done to deal with a single candidate is  to 1). Exposes a single candidate with an empty tube, 2). Delay the election until   the election outright in 2017. 3). Published the decree. While the legal steps that  can be taken to prevent the birth of a single candidate is 1. Revise election laws, by adding specific chapter or article concerning a single candidate, 2. Increasing political education for the public and political party cadres and prepare the mature cadre in the party’s  internal

    One of the principles of rule of law which guarantees by the constitution is regarding the due process of law. Legal acknowledgment, legal guarantee, legal protection, fair legal assurance and equality before the law cannot be separated from the principle of “presumption of innocence”. Both had becoming the absolute condition and its existences are acknowledged, protected, and guaranteed within the rule of law system in Indonesia. However, in a matter of fact there are numbers of regulations which are in contradiction with the 1945 Constitution. One regulation, which   is the main discussion of this note, is the Article 32 (1) letter c Law No. 30/2002 on The Committee of the Eradications of Corruption (UU KPK).     PendahuluanPerubahan Ketiga UUD 1945 menghasilkan pergeseran ke arah susunan kekuasaan yang bersifat horizontal fungsional, dimana kedudukan lembaga-lembaga negara menjadi setara. Masing-masing lembaga negara sebagai penyelenggara kekuasaan negara melakukan pengawasan secara fungsional terhadap lembaga negara lainnya. Perubahan yang dilakukan bertujuan untuk menyempurnakan aturan dasar penyelenggaraan negara secara demokratis dan modern, antara lain melalui pemisahan dan/atau pembagian kekuasaan yang lebih tegas, sistem checks and balances yang lebih ketat dan transparan, serta pembentukan lembaga-lembaga negara yang baru untuk mengakomodasi perkembangan kebutuhan bangsa dan tantangan zaman.1 Kedaulatan rakyat yang sebelumnya dilaksanakan sepenuhnya oleh MPR sebagai perwujudan seluruh rakyat maka setelah Perubahan Ketiga UUD 1945, dilaksanakan menurut Undang-Undang Dasar.2 Hal itu berarti MPR tidak lagi menjadi lembaga negara tertinggi yang dalam kedudukannya sebagai penjelmaan seluruh rakyat, bertugas memberi mandat kepada  penyelenggara  negara  lainnya,  yang  wajib memberikan pertanggungjawaban pelaksanaan mandat yang diberikan. Dengan demikian, MPR hanya menjadi salah satu lembaga negara di antara lembaga negara lainnya yang memiliki kedudukan setara, namun dengan tugas, kewenangan, dan fungsi yang berbeda. Pernyataan bahwa Indonesia ialah negara yang berdasarkan hukum (rechtsstaat) dan tidak berdasarkan kekuasaan belaka (machtsstaat), sebagaimana termuat dalam Penjelasan UUD 1945 sebelum perubahan, telah dimuat menjadi materi norma dalam batang tubuh Undang-Undang Dasar 1945 hasil perubahan.3 Dengan demikian terjadi pergeseran dari sistem supremasi parlemen (MPR merupakan lembaga tertinggi negara) menjadi sistem supremasi konstitusi dimana konstitusi ditempatkan sebagai hukum yang tertinggi. Konstitusi menjadi sumber legitimasi dari peraturan perundang-undangan yang dibentuk dan berlaku. Pernyataan bahwa kedaulatan di tangan rakyat yang dilaksanakan berdasarkan Undang-Undang Dasar serta pernyataan bahwa Negara Indonesia adalah negara hukum, dapat dilihat sebagai pendirian yang tegas bahwa prinsip penyelenggaraan negara secara demokratis didasarkan pada konstitusi (constitutional democracy). Demikian pula negara hukum yang dianut adalah bersifat demokratis (democratische rechtstaat), yang diartikan bahwa proses pembentukan hukum berlangsung dengan partisipasi warga negara. ..

    Constitutional judges denote a piece of flesh i.e. heart in the body of the Constitutional Court. If it is good, the whole body is good, and if it is bad, or else if it is bad, the whole boy is bad. The good heart is filled by the judges who have impeccable integrity and personality; be fair-minded; and be statesman who have mastered constitution and constitutional law. They therefore have an obligation to make a responsive and prescriptive decision in order to enforce the law based on  the morality and the truth. The decision becomes the sun which will continue to shine and illuminate the life of the country

    The main maxim of progressive law is law for human, not human for law. Since stressing to human existence to enforce the law, the progressive law rejects the status quo based on legal positivism, the existence of written legal text containing many weaknesses, and pays more attentions to the role of human behavior. In the context of constitutional court roles as the sole and the highest interpreter of the constitution, the interpretation of progressive law wants the institutional court not strictly rely on the written text, not to use legal positivism as a paradigm in interpreting the law, but focusing on rechtsidee, values, and way of life written on Pancasila to implement the substantive justice, not the existence of legal texts in constitution of  1945
