    Komodifikasi Kewenangan Mahkamah Konstitusi Republik Indonesia melalui Ikhtiar Aktivisme Yudisial

    This paper examines the idea of adding the authority of the Constitutional Court of Republic Indonesia to examine draft laws against the constitution of the basic law with a mechanism called judicial preview. This paper aims to examine the involvement of the judiciary, in this case the Constitutional Court, in the law-making process. This paper is a measure of the involvement of the Constitutional Court in the expansion of authority by examining the constitution against the draft law. The type of research used is library research in the form of normative research using statutory, conceptual, and comparative approaches. The research results obtained found that the existence of the Constitutional Court as the sole interpreter of the constitution shows that the involvement of the Constitutional Court in the law-making process has the potential to improve the quality and constitutionality of the draft law. In terms of functions and main tasks, the Constitutional Court can participate in the law-making process. The Constitutional Court is actually present as a judiciary activism that bases its function as a counter-majoritarian.     Perlindungan Konstitusional terhadap Hak Atas Pendidikan Masyarakat Penghayat Kepercayaan di Jepara

    Indonesia as a multicultural country has a variety of racial, ethnic, cultural, and other diversity. Indigenous faiths is one of the diversity of religions or beliefs that need to be recognized. After the Constitutional Court Decision Number 97/PUU-XIV/2016, believers feel that their rights have been recognized by the state. However, in terms of education there is still discrimination such as the portion of learning for their beliefs as indigenous faiths. This research focuses on two things, namely the implementation of Law Number 20 of 2003 concerning the National Education System and school policies related to discrimination against Sapta Darma, Subud, and Kapribaden believers in Jepara Regency. The method used in this research is socio-legal by analyzing and examining the effectiveness of laws and regulations in community interaction. An understanding of several studies and theories provides two discussion results. First, the Office of Education of Jepara Regency still pays less attention to the rights of indigenous faith students in terms of the learning portion. Second, school policies are not sufficient in suppressing the potential for discrimination against students of indigenous faiths. Based on the results of the discussion, it can be concluded that with the existence of state protection for indigenous faiths, the government is obliged to protect their constitutional rights. The need for policies from the Office of Education of Jepara Regency in the field of education to fulfill constitutional rights that are able to suppress the potential for discrimination for students of indigenous faiths. ___ Referensi Buku dengan penulis: Purwanda, S.     This research aims to examine the considerations of judges in imposing sanctions on drug cases involving minors in group I (Decision Study Number 42/Pid.Sus.Anak/2022/PN.Mks) and the solutions for handling drug cases involving minors in the city of Makassar. This research employs a normative legal research method focusing on positive law, legal principles and doctrines, legal discovery in cases, legal systematics, comparative law, and legal history. The findings reveal that the judges' considerations in imposing sanctions based on Decision Number 42/Pid.Sus.Anak/2022/PN.Mks involve witness statements, available evidence, juridical facts, and indictments from the public prosecutor, with the primary consideration being the defendant's minor status. Efforts to address drug cases involving minors in Makassar include establishing a national narcotics agency, enacting specific narcotics legislation, and providing drug counseling and rehabilitation for children involved in or exposed to drug abuse

    The Urgency of Modifying Regulations for the Safety of General Election Organizers in 2024

    General elections in Indonesia have been held 12 times, namely in 1955, 1971, 1977, 1982, 1987, 1992, 1997, 1999, 2004, 2009, 2014 and 2019. And, the general election simultaneously and costing not a few lives occurred in 2019. Basically, the simultaneous general elections held in 2019 had many irregularities, especially the large number of members of ad hoc election organizers who fell ill and died. This happened in almost every region. Does the 2019 general election have anything to do with the increased workload of ad hoc election organizers due to the simultaneous implementation? Type of research uses normative legal research methods. It is called so, because normative research focuses on prescriptive research, using secondary data such as laws and regulations, legal theories, legal principles, and scientific works of legal scholars. The problems that occurred in the 2019 general election can be anticipated by making adequate regulatory modifications in order to create a rational, humane authority, and better election management than the previous period. There needs to be a guarantee of the quality of direct, general, free, secret, honest and fair elections. The implementation of simultaneous elections has provided a heavy workload, long implementation time and very tiring manual vote counting.     Penerapan Restorative Justice Dalam Proses Penyidikan Tindak Pidana Penganiayaan

    This study aims to analyze the factors that hinder the application of restorative justice in the investigation of violent crimes in the Barru Police. The method used is empirical research with a legislative approach and case studies. The results of the study show that the lack of agreement between the victim and the perpetrator is the main factor in the non-occurrence of restorative justice, where the victim prefers to continue the case to the court to get punishment for the perpetrator. In addition, victims often apply conditions that cannot be fulfilled by the perpetrator, such as rehabilitation costs. The application of restorative justice at the Barru Police is carried out through mediation between the perpetrator, the victim, and the victim's family, by involving neutral parties such as community leaders and religious leaders. This process follows the provisions in Peraturan Kapolri Nomor 8 Tahun 2021 tentang Penghentian Tindak Pidana Berdasarkan Keadilan Restoratif, and cases that are successfully resolved restoratively tend to be stable every year

    Law No. 11 of 2012 concering the Juvenile Criminal Justice Syistem (SPPA) has legally changed the paradigm and handling of children in conflict with the law. The strategic role of corrections has begun to move since tre-trial, adjudications, to Post adjudications, children since being placed in the correctional instution. Especially for children during their sentence, the role of LPKA is to provide services, care, guidance, education. Supervision of children must really pay attention to the rights of children and the basic principles of handling children. The basic principles inherent in children, namely the best interests of children, non-discrimination, respecting children’s opinions and the growth and development of children must be the basic guidelines in the treatment of children. his type of research uses normative legal research using a statutory and case approach. The results of this study are that the systems, mechanisms and procedures for child development refer to Law Number 12 of 1995 and Law Number 11 of 2012 and Government Regulation Number 31 of 1999 which consists of 3 (three) stages, namely Earl Stage Development, Development Advanced Stage and Final Stage Coaching. The ideal coaching is through the Child Friendly Integrated Development System Model, which is a child coaching system that is carried out individually or in groups according to the needs of the child by directly involving officers, families, communities and local governments by paying attention to legal, organizational and management aspects, human resources, budget, facilities and infrastructure, socio-cultural as well as the principle of the best interestsofthechild

    Kegiatan pendidikan politik hukum bagi mahasiswa menjelang Pemilihan Presiden 2024 bertujuan memberikan pemahaman mendalam tentang putusan Mahkamah Konstitusi terkait batas usia pencalonan Presiden dan Wakil Presiden. Melalui metode seminar dan sesi tanya jawab, kegiatan ini melibatkan pemateri dari berbagai latar belakang akademis dan politisi. Diskusi berfokus pada analisis putusan Mahkamah Konstitusi dengan tema "Ada Apa dengan MK: Analisis Putusan MK Tentang Batas Usia Capres dan Cawapres". Kegiatan diadakan di Aula IAIN Parepare dan dihadiri oleh mahasiswa dari berbagai kampus di Kota Parepare. Melalui interaksi yang dinamis antara pemateri dan mahasiswa, kegiatan ini berupaya meningkatkan pemahaman, memperluas wawasan, dan membangun keterlibatan aktif mahasiswa dalam memahami dan mempersiapkan diri menghadapi proses demokrasi masa depan. Kegiatan pendidikan politik hukum bagi mahasiswa dalam persiapan menyongsong Pemilihan Presiden 2024 menjadi tonggak penting dalam mempersiapkan mahasiswa sebagai agen perubahan dan pemilih yang terinformasi. Melalui kegiatan ini, mahasiswa tidak hanya diberikan pemahaman yang mendalam terkait putusan Mahkamah Konstitusi tentang batas usia pencalonan Presiden dan Wakil Presiden, tetapi juga dibekali dengan keterampilan kritis dan pemahaman yang lebih luas mengenai aspek hukum dan politik yang memengaruhi proses demokrasi. Melalui pemberian pengetahuan dan pemahaman yang lebih mendalam ini, mahasiswa dapat menjadi pemilih yang lebih bertanggung jawab dan pemimpin yang terlatih dalam mengemban tugas-tugasnya di masa mendatang

    Pengabdian kepada masyarakat ini bertujuan untuk meningkatkan wawasan dan pemahaman pemilik usaha Rumah Jahit Esa dalam memanfaatkan platform digital dan mengelola manajemen keuangan secara lebih terstruktur. Melalui kegiatan ini, diharapkan pemilik usaha dapat meningkatkan keterampilannya sesuai dengan tuntutan era digital saat ini. Kegiatan dilaksanakan di ruang workshop Rumah Jahit Esa. Hasil dari kegiatan ini menunjukkan peningkatan pemahaman pemilik usaha terkait memasarkan usahanya secara digital. Peningkatan keterampilan ini diharapkan dapat memberikan dampak positif terhadap manajemen keuangan Rumah Jahit Esa dan secara keseluruhan, membantu pemilik usaha dalam menghadapi tantangan ekonomi di era digital ini

    This study examines the potential dangers of Artificial Intelligence (AI) to human rights in Indonesia using a socio-legal approach that combines normative legal analysis and social perspectives. Existing regulations such as the ITE Law and related regulations are inadequate because they do not specifically address human rights protection, accountability, and transparency in the use of AI. Meanwhile, from the social side, AI carries the risk of bias, discrimination, privacy violations, and threats to freedom of expression. Comprehensive regulations and effective law enforcement are needed to ensure the responsible use of AI and respect for human rights in Indonesia

    This study examines the legal protection for songwriters who sing live in cafes based on Law No. 28 of 2014 concerning Copyright. Using empirical juridical methods, this study examined secondary and primary data. The results of the study show that the use of live music is regulated in the Copyright Law and Government Regulation No. 56 of 2021, which requires permission and royalty payments to copyright holders. Legal protection can be enforced through alternative dispute resolution, litigation, or criminal prosecution to prevent and minimize copyright infringement
