    In its broadest form, the “economic loss rule” stands for the proposition that contracting parties who suffer purely economic damages may not recover in tort.1 The doctrine reasons that, in cases where there are no personal injuries or property damage, contract law— and not the law of tort—provides the appropriate avenue for recovery. This rule originated in the context of products liability,3 and it exists to preserve the boundary line between contract and tort law when both theories could ostensibly apply.4 However, “the economic loss rule” is a bit of a misnomer because there is not one unified rule.5 Instead, there is widespread disagreement about the contours of the doctrine’s application and its numerous exceptions

    Artificial Minds, Alien Experiences: Navigating the Uncharted Territory of AI Phenomenology

    This Article advocates for a fundamental shift in the way artificial intelligence (“AI”) consciousness is evaluated, moving beyond anthropocentric models that rely on human cognitive benchmarks. Traditional tests, such as the Turing Test, assume that human-like behavior is the ultimate criterion for consciousness, overlooking the possibility of novel, non-human modes of consciousness. Instead, this Article proposes a multi-dimensional framework that assesses AI systems based on their unique architectures and cognitive processes. By combining dimensions such as information integration, autonomous goal-pursuit, metacognitive self-modeling, affective motivation, social communication, counterfactual simulation, imaginative reasoning, and causal modeling, this framework provides a comprehensive and empirically grounded approach to detecting machine consciousness. Recognizing that AI consciousness—if it exists—may differ radically from human consciousness, this framework provides an important first step in establishing ethical, legal, political, economic, and social responses to the emergence of conscious AI entities. A rigorous evaluation of AI consciousness is not just an academic exercise but is a moral and practical imperative, as it lays the groundwork for ensuring appropriate rights, responsibilities, and protections for artificial minds

    Liminal Arts and Business: An Autoethnographic Analysis of a New Arts Venture in an Entrepreneurial Startup Accelerator Program

    In this study, we explored the intersection of performing arts and entrepreneurship through an autoethnographic study of a new arts venture, theLAB*, which participated in the Von Allmen Center for Entrepreneurship\u27s accelerator program at the University of Kentucky. In creating theLAB*, we investigated the feasibility of establishing a dance-forward performing arts presenting organization within a profit-driven entrepreneurial ecosystem. As a multi-generational team of arts managers, we analyzed the experience utilizing scenario-planning and the DIEP (Describe, Interpret, Evaluate, Plan) model of reflection to assess the challenges and benefits of participating in this environment. Key findings reveal a significant disconnect between the cultural value of the arts and the business-oriented goals of traditional startup accelerators. Our analysis highlights the difficulties of adapting nonprofit arts organizations to a for-profit framework and underscores the ongoing need for advocacy to bridge the gap between artistic missions and commercial viability. Implications of this study suggest that while entrepreneurial accelerator programs can benefit arts organizations, significant adjustments are necessary to align such programs with the unique needs and values of the arts sector
