Aporte del Humanismo a la tarea diagnóstica
Full text linkEste artículo se refiere a que los profesionales de la salud, al hacer un diagnóstico, creen que deben describir, en términos «objetivos», el padecimiento de alguien. Todo diagnóstico es un recorte posible sobre la realidad de un Tú, realidad cuya subjetividad cubre, y la subjetividad del profesional intentará descubrir. Desde el humanismo, el diagnóstico pasa por tres momentos: a) el genérico (si esta persona está sana o enferma). Involucra una definición de salud; b) si la persona tiene restringida alguna o todas las libertades que lo definen desde la salud, se interroga:
¿de qué está enferma?, ¿por qué sufre?, ¿por qué ahora y aquí?; y c) momento de la personificación, se llega si se partió de un encuentro intencional con el otro. Cuando esta relación sujeto-sujeto está mediada por las técnicas auxiliares de diagnóstico, con su supuesta «objetividad», deben ser neutralizadas por la comprensión del sentido, desde un Tú a un Tú.This article refers that the professionals of the health, having done a diagnosis, believe that they must describe, in «objective» terms the suffering of someone. Every diagnosis is a cut as possible about the reality of a Your; reality whose subjectivity covers, and the subjectivity of the professional will try to des-cover. From the humanism, the diagnosis happens for three moments:
the generic (if this person is healthy or sick). It involves a definition of health. b) If the person has restricted some or all of the freedoms that define it from health, is interrogated: what is sick?, why is suffering?, why now and here?; and c) moment of personification, if it came from an intentional encounter with the other. Prescripción de la acción de simulación respecto de terceros
Full text linkThe problem related to the statutory limitation of the simulation action, when it is attempted by third parties, is analyzed in this paper. Two aspects are to be considered: the time limit for the legal action, considering that the action may be brought alone or together with other actions, and the initial moment of such time limit. In the analysis section, the different doctrinal and judicial precedent positions are highlighted. Also, a brief reference to the solution provided by the Civil and Commercial Code of Argentina is mentioned.En el presente trabajo se analiza el problema que se plantea respecto de la prescripción de la acción de simulación, cuando ella es intentada por terceros ajenos al acto simulado. Dos son los aspectos considerados: el plazo de la prescripción, teniendo presente que la acción puede inter- ponerse sola o en conjunción con otras acciones, y el momento inicial de dicho plazo de pres- cripción. En el análisis se destacan las distintas posiciones doctrinarias y jurisprudenciales y se efectúa una breve referencia a la solución dada por el Código Civil y Comercial Unificado de la Nación Argentina
