LE “REGOLARITÀ” DEL CICLO POLITICO : IL REALISMO DI GIANFRANCO MIGLIO E LA GUERRA NELLA TRASFORMAZIONE GLOBALE
This article considers the main elements of Gianfranco Miglio’s reflection on war, on political violence and on the link between violence and the (domestic and international) political order. In particular, the article shows how Miglio has always been theoretically attracted by the problems of violence and the exercise of power, so much so as to adopt, more or less explicitly, a Thucydidean vision of politics. Furthermore, the text clarifies that Miglio’s perspective is aimed at developing a general theory of the political cycle, within which the international dimension is conceived as dependent on the internal dynamics of political syntheses and, more generally, as a consequence of technological change and the oscillation between the prevalence of the specifically political relationship (the so-called “political obligation”) and the prevalence of the “private” relationship (the “obligation-contract”, or “contract-exchange”)
Società libera, governo limitato, senso del limite: Russell Kirk e una prospettiva conservatrice e liberale
Russell Kirk (1919-1994) has been one of the most important American conservative thinkers of the Twentieth century. However, in Italy his thought is anything but studied. After a brief introduction into the problem of order in political terms, in the first part this essay aims at exploring his political thought with particular attention to his idea of order and in continuity with Burke’s and Tocqueville’s perspectives. After that, some of the major cultural influences on his thought will be considered. Thirdly, the essay will focus on a comparison between his and Hayek’s vision of order, underlying differences but also similarities. The conclusion will try to outline a conservative vision of order characterised, at the same time, by the respect of traditions, the sense of limits and the ordered liberty
Integrazione europea, federalismo e buon governo liberale nel pensiero di Einaudi
In this article I reconstruct Luigi Einaudi’s thinking on the need for European integration through a federation, advancing three theses. Einaudi’s dream of the ‘United States of Europe’: 1) cannot be understood except in the light of his liberal thought: his reflection on the foundations of a good politeia, understood as a liberal ‘good society’ and liberal ‘good government’; 2) is traversed by two polarities – economic/institutional, local/global – which he conceives as lines of tension: both generative and potentially destructive of the social order; 3) shows, through the search for a “mediating formula” between these lines of tension, the eternal ‘human’ problem of every integration process and every community: how to recognize ourselves as united in diversity.In this article I reconstruct Luigi Einaudi’s thinking on the need for European integration through a federation, advancing three theses. Un metodo tutt’altro che semplice. Democrazia e mediazione nella riflessione di Alcide De Gasperi
The aim of this paper is to explain the main points of the idea of (representative) democracy formulated by Alcide De Gasperi, few decades ago. At the heart of his reflection, there are the keys to understanding the constitutive elements of Italian parliamentary democracy, especially regarding the link between mediation and disintermediation. Through the focus on this relationship, this article shows that – with an unchanged institutional system – it is possible to have leaderships that favor political mediation and others that prefer disintermediation.The aim of this paper is to explain the main points of the idea of (representative) democracy formulated by Alcide De Gasperi, few decades ago. La démocratie en infosphère: Una politica nuova per l’era digitale
Luciano Floridi is regarded as one of the most important and internationally recognized authorities in the field of studies on the digital revolution and its consequences. Floridi developed a new area of research on “Philosophy of Information”, which, as explained in his work Il verde e il blu, covers the area of politics. The aim of this essay is to reconstruct the network of ideas contained in Floridi’s work, based on a new relationship-based philosophical paradigm. Based on this premise, the author aims to create a new political project in order to take advantage and control the transformations brought about by the digital revolution. This “social” project is based on the restoration of ethics, avoiding thinking along the lines of old ideologies and thus completing the previous “liberal” project, centered exclusively around individuals. The final part of this essay will address the compatibility of the two projects

For both the historical development of political theory and the current challenge posed by terrorism and “séparatisme islamiste”, France is a privileged place of observation of the intrinsic tension between the complementary but also antinomic principles of freedom and security. After briefly considering some crucial moments of this endless theoretical debate, the article focuses on some recent episodes of religious and ideological violence, which have deeply affected French public opinion
La presidenza di Theodore Roosevelt tra legittimazione popolare e palcoscenico: Una democrazia del pubblico?
This article focuses on the delicate relationship between rulers and ruled in the democratic system, trying to define its contours within Manin\u27s notion of democracy of the public. The aim is to verify whether this metamorphosis can have an ancestor in Theodore Roosevelt\u27s presidency, as an ante litteram experience of the people becoming public and politics a stage performance. The comparison is based on some elements of similarity between the situation described by Manin and the disruptive experience of Roosevelt, starting from the similarities in terms of political atmosphere and the similarity of the management of the dialogue with the people between Roosevelt and the media figures of the political arena in the situation outlined by Manin
Is there no alternative?
The paper focuses on the theme of emergency in order to highlight some of its elements, along a brief argumentative path. In particular, at the level of analysis, the present work intends to indicate some factors - non-juridical - which appear decisive for public law at this “historical moment”. In the context of this “historical moment”, an attempt will be made to highlight how emergency and derogation with respect to ordinary rules are not exceptional elements but structural elements of the evolution of the system, concluding by indicating the alternative between the “reasons for public law” and its simple marginalisation, to make way for a biopolitical dialectic between command and subjection as mere fact, deriving from the idea that no alternatives are available, there is no alternative

The paper focuses on the recent jurisprudence on the violation of the obligations of diligence, prudence, expertise and social security in the context of the planning activity required of electricity market operators for the purpose of exercising the dispatching service by Terna S.p.A. Through the critical analysis of the judgments, respectively, by the first instance judge and by the appeal judge in the context of the multiple disputes introduced by the recipients of the prescriptive measures adopted by ARERA, this work intends to reflect on the centrality of implications of his different approaches in terms of the effectiveness of subjective legal situations. The interest in this topic derives from the observation of the fact that the extent and intensity of the judicial review, also in the light of the investigative powers attributed to the administrative judge, represents an important test bed for testing - with reference to the specificities of the regulatory function and to the peculiar constitutional position of the independent Authorities - the structure of the relationship between reason and power and, therefore, its correspondence to the internal and supranational constitutional provisions
Rebuilding confidence. : From the politics of distrust to a democracy of trust
Although trust plays a fundamental role in complex societies as an effective form of complexity reduction, both political science and politics became increasingly aware of a growing distrust in democratic political systems as in EU democratic governance. The delegation of decision-making processes which are relocated from the national dimension to the supra-national sphere, has affected the balance between input and output legitimacy, that in turn produced a sort of trade-off between effectiveness and trust. It was felt as manifestation of democratic deficit of supranational-intergovernmental institutions. However, this legitimation crisis seems to be connected with the characters of the political arena, more than with the institutional framework. In particular, a representation deficit (instead of – or in addition to – democratic deficit), should be mentioned among the consequences of limited participation of European citizens in decision making processes. We maintain that trust should be distinguished from confidence and that a long-lasting loss of trust causes an erosion in confidence in the general functioning of the system. If people become disillusioned with the perceived performance of democratic governments, over successive administrations, then in time this might erode their belief in democracy itself
