EU – community of values and financial resources
Participation in the European Union imposes an absolute obligation on EU Member
States to comply with the values set out in Article 2 of the TEU. One of them is the
common system of the legal order that builds trust between the Member States and the
regional international organization established by them. The EU is a state of law. Respect
for EU law is a necessary condition for each Member State to exercise all the rights resulting
from the application of the EU treaties throughout the period of a given state’s
membership of this international organization. The judgments issued by the CJEU in
cases C-157/21 initiated by the Republic of Poland and C-157/21 – Hungary made the
authorities of these countries aware that the values related to and resulting from the rule of
law cannot be respected only in the periods preceding accession to the EU. The procedures
set out in Article 7 of the TEU and the provisions of Regulation 2020/2092 guarantee
to all interested parties that the expenditure financed from the EU budget is in line with
the objectives financed by the EU. The horizontal conditionality mechanism established
relatively recently in the aforementioned regulation and presented in the justifications
issued in both cases on February 16, 2022, makes it clear not only the authorities of the
states acting as parties to these proceedings, but also other EU Member States (with the
exception of those that as “court friends” on the defendant’s side of the European Commission)
that the sound management of EU finances as well as the EU financial interests
of some EU Member States may be seriously threatened as a result of a breach of the rules

Poszanowanie prawa unijnego jest niezbędnym warunkiem korzystania przez każde państwo

wydawane przez TSUE w sprawach C-157/21 z inicjowanych przez Rzeczpospolitą

akcesję do UE. Procedury określone w art. 7 TUE oraz przepisy rozporządzenia

The education system in the development of total defence. Poland’s perspective
One of the key pillars of total defence is an increased social resilience to aggression, which
is inextricably linked to an adequate model of security education. Poland’s security in the
21st century is based on the state’s military capacity and on the military and political alliances
formed by decision-makers. However, this model of building security is not sufficient
in the face of constantly changing and evolving security threats and challenges.
Therefore, security should be based not only on a hard dimension, but also on a soft one,
whose main pillar is security education. The idea of an effective model of security education
is that, apart from giving young people theoretical knowledge, it is necessary to instil
in them practical skills related to responding in crisis situations, including situations
posing a threat to human health and life. Security education should constitute the first
stage in training society in total defence. The educational model currently functioning in
Poland definitely needs to be reformed
The shaping of moral attitudes as a pillar of contemporary security and social order
The long-term process of education, and above all, shaping the desired social attitudes
among young citizens of each country is the basis of the future social order. Individual
moral order translates directly into order in social structures and relations, which is important
in the context of ensuring both internal and external security. In an orderly society,
the so-called “strong moral backbone” is much more resistant to threats, and also
much more effective in counteracting them. Unfortunately, the issue of moral education
is not much emphasised in contemporary educational systems. Therefore, the main goal
of this article is to identify the components of the moral education process as key factors
shaping the contemporary order and social security. Thus, the issues of moral disorder
as a source of real threats, both in the individual and social dimension, as well as
the problem of moral education as the basis for shaping the desired social attitudes in the
contemporary world, were analysed. In order to achieve the assumed goal, the following
research methods (theoretical) were used: analysis, synthesis, abstraction, explanation,
generalization, and inference. The research was carried out using the technique of examining
documents and source materials
A tale of two hemispheres: Norwegian and Australian approaches to national resilience. A comparative analysis
Paper conducts a comparative analysis of two different national approaches to national
resilience in an attempt to identify useful considerations and recommendations for Poland:
two models chosen were the Norwegian Total Defence Concept (TDC) and Australia’s
National Disaster Response and Resilience approach. They were selected due to their
different areas of focus: the Norwegian model is centred on societal mobilisation and its
military enablement with the primary purpose of national defence against conventional
military and hybrid threats, while the Australian approach is still focused on enhancing
national resilience in order to respond to major natural calamities.
By examining both models and extrapolating their strengths while noting their vulnerabilities,
the basis for a well-rounded national resilience strategy can be identified.
While the TDC appears to best suit Poland’s current security challenges, the country
would benefit from enhancing its comprehensive local engagement, perhaps through its
Territorial Defence Forces. Caution should be exercised with regards to over-committing
the Polish military in its support to disaster response at a time when the nation’s eastern
flank is once again highly volatile
Mental simulations, imaginations and emotions – a short empirical legal study
Nowadays, due to the continuous development of psychological sciences, we observe an
increase of the interest in imagination, and undoubtedly the role of imagination in mental
simulations. When exploring the issues of the subject matter, it is necessary to note that
the ideas of imagination and ideas were for a long time neglected in research and analyzes.
To a certain extent, this is reflected in the literature on the subject of this research topic; however, in my opinion, in both Polish and foreign literature, there aren’t sufficient scientific
studies devoted to this issue and its potential impact on the life of every human
being. The principal aim of this work is to analyze the idea of imaginations presented in
Petrażycki’s theory – their nature, functions and types – and to discuss mental simulations
and examples of their use. In addition, another relevant issue is going to be analysed – the
connection and the relationship between imaginations in the past and mental simulations
in present time. The article will present how to leverage these ideas
Polowe organy administracji wojska polskiego w sprawach rekwizycji żywności w okresie powstania listopadowego 1830–1831 roku
The article concerns the organisation and activities of the army food administration,
which for most of the time during the November Uprising was carried out by the Army
General Commissariat Service. During the 10 months of the uprising, the food administration
underwent several organisational changes, and its execution was entrusted to various
bodies. The discussion undertaken is related to issues concerning the organisation of this
administration, with particular emphasis on the characteristics of the activity of its field
administrative apparatus, which was entrusted to War Commissioners at individual army
divisions and to Regional Commissioners as civilian requisitioning bodies in individual
administrative regions which were links of the army’s food administration. On the other
hand, in order to make the food requisitions enacted by the Sejm in June 1831 effective and
rapid, Extraordinary Commissioners were established and entrusted with their supervision.
In addition to the description of the powers conferred on all these officers, the author
analyses the legal procedure applied by them to the requisitioning of food and fodder for
the army against the background of events at the time.W artykule przedstawiono organizację i działalność administracji żywności wojska,
którą przez większość czasu w okresie powstania listopadowego wykonywała Służba Intendentury
Generalnej Wojska. Przez 10 miesięcy powstania administracja żywności
przeszła kilka zmian organizacyjnych, a jej wykonywanie powierzono różnym organom.
Rozważania dotyczą zagadnień organizacji tej administracji ze szczególnym uwzględnieniem
charakterystyki działalności jej polowego aparatu administracyjnego, który został
powierzony komisarzom wojennym przy poszczególnych dywizjach wojska oraz komisarzom
obwodowym jako cywilnym organom rekwizycyjnym w poszczególnych obwodach
administracyjnych będących ogniwami administracji żywności wojska. Natomiast w celu szybkiego uskutecznienia uchwalonych przez sejm w czerwcu 1831 r. rekwizycji żywności,
nadzór nad nimi powierzono specjalnie ustanowionym komisarzom nadzwyczajnym.
Poza charakterystyką kompetencji przyznanych tym wszystkim funkcjonariuszom autor
dokonuje analizy procedury prawnej stosowanej przez nich do czynności rekwizycji żywności
i furażu dla wojska na tle ówczesnych wydarzeń
Kinesiotaping of rectus abdominis muscle in the treatment of urinary incontinence in women
Wprowadzenie: Leczenie zachowawcze nietrzymania moczu nacelowane jest na łagodzenie objawów.
Jako metodę uzupełniającą z powodzeniem wykorzystuje się procedury fizjoterapeutyczne, w tym
kinesiotaping. Niemniej jednak brak jest doniesień na temat efektywności kinesiotapingu we wspomaganiu
leczenia nietrzymania moczu. Celem pracy była ocena skuteczności kinesiotapingu mięśnia
prostego brzucha w łagodzeniu objawów wysiłkowego nietrzymania moczu u kobiet.
Materiał i metody: W badaniu wzięło udział 20 kobiet (średni wiek 54,65 roku ± 2,97 roku) zgłaszających
objawy upuszczania moczu w sytuacjach angażujących tłocznię brzuszną. Do oceny badanych użyto
autorskiego kwestionariusza ankietowego oraz kwestionariusza ICIQ-LUTSqol, oceniającego jakość życia w kontekście nasilenia objawów ze strony dolnych dróg moczowych. Aplikację kinesiotapingu
stosowano na mięsień prosty brzucha. Ponadto badane wykonywały test stania jednonóż przed i po
zastosowaniu kinesiotapingu.
Wyniki: Średni wynik kwestionariusza ICIQ-LUTSqol w całej grupie badanej wynosił 44,17 pkt ±
32,63 pkt. Po zastosowaniu kinesiotapingu doszło do zmniejszenia ilości upuszczanego moczu
(2,2 pkt ± 0,69 pkt vs. 1,7 pkt ± 0,65 pkt, p < 0,05).
Wnioski: Kinesiotaping mięśnia prostego brzucha w niewielkim stopniu wpływa na objawy nietrzymania
moczu.Introduction: Conservative treatment of urinary incontinence is intended to alleviate symptoms.
Physiotherapeutic procedures may be effectively implemented in the treatment of urinary incontinence.
Kinesiotaping is used as a complementary form of physiotherapeutic treatment. The available
literature does not yet contain clear reports on the importance of the use of kinesiotaping to treat
urinary incontinence. Material and methods: The study involved twenty women (mean age: 54.65 ± 2.97 years) who
reported symptoms of urine leakage in situations involving abdominal pressure. The respondents were
assessed using a questionnaire produced by the authors and ICIQ-LUTSqol. Kinesiotaping was applied
to the rectus abdominis muscle and the subjects performed the single-legged standing test before and
after kinesiotaping was applied.
Results: The mean result of the ICIQ-LUTSqol questionnaire assessing how the quality of life across
the entire study group was affected by the severity of lower urinary tract symptoms was 44.17 points
± 32.63 points. After kinesiotaping, the amount of urine leakage decreased (2.2 points ± 0.69
points vs. 1.7 points ± 0.65 points, p < 0,05).
Conclusions: Kinesiotaping of the rectus abdominis muscle has little effect on the symptoms of urinary
incontinence
Małżeńskie ustroje majątkowe w Królestwie Kongresowym – na podstawie intercyz sporządzanych przez pierwszych łódzkich notariuszy
The Civil Code of the Kingdom of Poland (KCKP), enacted on June 1, 1825, stated that
property relations in marriage could develop within the statutory property regime, which
was the exclusive property regime or the contractual regime adopted by the spouses. KCKP
regulated the principles of operation of the three main property regimes that could be introduced
by agreement. The future spouses could simply bind their property relations to
one of these regimes, or make any modifications to them. In addition, they were allowed to
adopt a completely different, arbitrary system, as long as the rules of its functioning did not
violate the law or good morals, and were specified in detail in the contract.
The contractual systems regulated in the code were: property separation, dowry property
regime and joint property. In practice of first notaries in the years 1841–1875 in Łódź,
most commonly adopted property regimes were those that combined the features of two
regimes, i.e. property exclusivity and joint property, or a dowry regime and joint property.
However, the principles of the functioning of these systems adopted in premarital
agreements were not uniform. The bride and groom decided on various combinations in
terms of subjecting individual property components to property exclusivity, possibly to
a dowry government, or joint ownership. The regimes of exclusive property and joint property
as well as the dowry regime and joint property regimes were attractive for spouses, due
to their flexibility, the possibility of adjusting the arrangements to the financial situation of
future spouses.Uchwalony 1 (13) czerwca 1825 r. Kodeks Cywilny Królestwa Polskiego stanowił, że
stosunki majątkowe między małżonkami mogły kształtować się w ramach ustawowego
ustroju majątkowego, jaki stanowiła wyłączność majątkowa, lub ustroju umownego przyjętego
przez małżonków w intercyzie. Kodeks regulował zasady funkcjonowania trzech
głównych ustrojów majątkowych, które mogły zostać wprowadzone w drodze umowy. Jednocześnie przyznawał przyszłym małżonkom dużą swobodę w kwestii urządzania stosunków
majątkowych: mogli wprost poddać swoje stosunki majątkowe któremuś z tych
ustrojów, albo dokonywać ich dowolnej modyfikacji. Poza tym wolno im było przyjąć inny,
zupełnie dowolny ustrój – byle zasady jego funkcjonowania zostały szczegółowo określone
w umowie, nie naruszały prawa i nie były sprzeczne z dobrymi obyczajami.
Uregulowanymi w kodeksie układami umownymi były: rozdzielność majątkowa, rząd
posagowy oraz wspólność majątkowa. W praktyce działalności pierwszych łódzkich notariuszy,
czyli w latach 1841–1875, najczęściej przyjmowanymi ustrojami majątkowymi były
te, które łączyły w sobie cechy dwóch ustrojów, czyli wyłączności majątkowej i wspólności
majątkowej albo rządu posagowego i wspólności majątkowej.
Przyjmowane w intercyzach zasady funkcjonowania tych ustrojów nie były jednak
jednolite. Narzeczeni decydowali się na rozmaite kombinacje w zakresie poddawania poszczególnych
składników majątkowych wyłączności majątkowej, ewentualnie rządowi posagowemu
albo wspólnoś
Emotions in Legal Theory
Pomimo wielu punktów stycznych pomiędzy emocjami a prawem emocje w kontekście zagadnień prawnych rzadko stają się przedmiotem badań, a zwłaszcza badań w teorii prawa. Na początku XX wieku Leon Petrażycki podjął jedną z pierwszych prób ustalenia zależności pomiędzy prawem a emocjami. Psychologiczna teoria prawa Petrażyckiego została oparta na koncepcji emocji etycznych. W tym ujęciu przyciągające i odpychające emocje etyczne wraz wyobrażeniami określonych zachowań stanowią podstawę motywów postępowania. Ówcześnie nowatorską teorię prawa Petrażyckiego, w świetle rozwoju psychologii, obecnie uznamy za nieaktualną i przestarzałą, w szczególności w zakresie rozumienia jej kluczowego elementu – emocji. Celem niniejszego tekstu jest rozważenie, jak obecnie możemy interpretować emocje w ramach psychologicznej teorii prawa. W tym celu proponowane jest skoncentrowanie się na analizie podejścia wywodzącego się z tzw. motywacyjnej tradycji badań nad emocjami – teorii konstruowanej emocji (L.F. Barrett). Podstawowym założeniem tej teorii jest to, że emocje nie są wyzwalane, lecz są konstruowane przez mózg na podstawie doświadczeń wywołanych przede wszystkim interakcjami ze środowiskiem, w którym funkcjonujemy. Zastosowanie teorii konstruowanej emocji pozwala na zaktualizowanie – na podstawie współczesnej wiedzy naukowej – psychologicznej teorii prawa.Despite the many intersections between emotions and law, the study of
emotions in the context of legal issues is much neglected, especially in legal
theory. The first attempt to embrace all aspects of the correlations between
law and emotions was made at the beginning of the 20th century by Leon
Petrażycki. Petrażycki’s theory of law is based on concept of legal emotions.
In this approach, emotions are understood as motives of behaviour, containing
within itself an representation of a certain conduct and an appulsive
ethical emotion or a repulsive one. In the light of development of psychology
on which Petrażycki’s innovative theory of law is based, it has become
outdated, especially in the context of understanding its key element – emotions.
The goal of this study is to consider how emotions in the framework
of the specifi ed theory of law should be comprehended presently. The author suggests to focus on analysing of the concept originated from
the so-called motivational tradition of emotion studies – the theory of
constructed emotion (L.F. Barrett). The fundamental assumption of this
theory is that the emotions are not triggered, but are constructed by the
brain based on experiences primarily induced by the environment. The
application of the constructed theory of emotions in legal theory context
can lead to developing an updated – based on modern scientific knowledge

Fundamental Rights and Data Privacy in Brazil and in the European Union
Using the methodology of compared literature and compared law from Brazilian and
European data protection laws in force, we used the comparative analysis of the legal texts
of both laws: General data Protection Law and General Data Protection Regulation, the
first from Brazil and the second from Europe, aiming to successfully determine that
the legislation in Brazil on this matter is clearly influenced by the present European protecting
data regulation because of its modern approach on the protection of fundamental
rights, and that it would have never emerged under this European format without the
GDPR in the European Union
