Diálogos divergentes: Interpretações diferentes de direitos humanos na União Europeia e China
No full textCom a criação das Nações Unidas os direitos humanos passaram a ter, na sua plenitude, proteção internacional. A evolução dos aspetos políticos e jurídicos no pós Segunda Guerra Mundial foi crucial para o entendimento e aplicação dos direitos humanos em qualquer Estado. Contudo, ao longo dos anos o debate
internacional sobre direitos humanos refletiu uma variedade de perspetivas e interpretações desses direitos que colocam em causa o aparente consenso da comunidade internacional nesta matéria.
A noção de universalidade dos direitos humanos postula que esses direitos são inerentes a todos os seres humanos, “sem distinção de qualquer espécie, seja de raça, cor, sexo, língua, religião, opinião política ou de outra natureza, origem nacional ou social, riqueza, nascimento, ou qualquer outra condição”, conforme
consagra a Declaração Universal dos Direitos Humanos. No entanto, a ideia de universalidade dos direitos humanos enfrenta desafios quando confrontada com o princípio da soberania do Estado, que preconiza a não intervenção nos assuntos internos de um país.
Essa tensão entre a universalidade dos direitos humanos e o respeito pela soberania dos estados tem implicações na evolução da promoção e proteção desses direitos a nível mundial. A relutância de certos Estados em adotar normas internacionais de direitos humanos, sob a invocação do princípio da soberania do estado, pode limitar a eficácia e a aplicação desses direitos.
Com o objetivo de compreender as diferenças entre a perspetiva europeia e perspetiva chinesa de direitos humanos este estudo analisa a história do Direito Internacional dos Direitos Humanos e o debate contemporâneo no âmbito das Nações Unidas. Centra-se na União Europeia e na China e na forma como estas potencias estabelecem as relações diplomáticas, sobretudo em matéria de direitos humanos.With the establishment of the United Nations, human rights gained comprehensive international protection. The evolution of political and legal aspects in the post-World War II era was crucial for the understanding and
application of human rights in any state. However, over the years, the international debate on human rights has reflected a variety of perspectives and interpretations that challenge the apparent consensus of the international community on this matter.
The notion of the universality of human rights postulates that these rights are inherent to all human beings, "without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth, or other status," as enshrined in the Universal Declaration of Human Rights. However, the idea of the universality of human rights faces challenges when confronted with the principle of state sovereignty, which advocates for non-intervention in the internal affairs of a country.
This tension between the universality of human rights and respect for state sovereignty has implications for the evolution of the promotion and protection of these rights worldwide. The reluctance of certain states to adopt international human rights standards, invoking the principle of state sovereignty, may limit the
effectiveness and application of these rights.
In an effort to understand the differences between the European and Chinese perspectives on human rights, this study analyzes the history of International Human Rights Law and the contemporary debate within the United Nations. It focuses on the European Union and China and how these powers establish diplomatic relations, particularly concerning human rights matters
The Wells Fargo Scandal: Crossing the Line with Cross-selling
No full textThis work, which takes the form of a case study, examines the relationship between goals, ethical culture, compensation and unethical behavior within organizations. It also looks at the responsibilities of various actors and the mechanisms for holding them accountable, and delves into some corporate governance practices, such as executive compensation, board composition and independence, and board oversight. This is all illustrated by the Wells Fargo Cross-Selling scandal, in which aggressive goals led employees to cheat to meet targets and defraud millions of customers. The work consists of two components: the case and the accompanying teaching note.Este trabalho, que assume a forma de um estudo de caso, examina a relação entre objectivos, cultura ética, remuneração e comportamento antiético nas organizações. Analisa também as responsabilidades dos vários actores e os mecanismos para os responsabilizar, e aprofunda algumas práticas de governação empresarial, como a remuneração dos executivos, a composição e independência do conselho de administração e a supervisão do conselho de administração. Tudo isto é ilustrado pelo escândalo da Wells Fargo, em que objectivos agressivos levaram os empregados a fazer batota para atingir as metas e defraudaram milhões de clientes. The future of (crypto) taxation
No full textThis thesis aims to analyse the taxation of income derived from crypto assets in the Portuguese Personal Income Tax (PIT). The objective of this study is to examine the structure and principles of the Portuguese tax system, paying special attention to PIT, including the taxation of labour and capital income.
Before addressing the taxation of crypto assets itself, it is imperative to grasp their definitions, operational mechanisms and various types.
Tax rules must be developed or interpreted considering the assets in question. Parallels should and will be drawn between these assets and traditional securities.
It is crucial to note that crypto assets cross international borders; thus, at the international level new regulations are required to facilitate cooperation and information sharing among between jurisdictions, such as CARF, DAC 8 and MiCA.
Finally, we must analyse the available solutions, specifically examining the areas that we deem capable of improvement, before presenting some ideas for alternative solutions.Esta tese tem como propósito analisar a tributação dos rendimentos de cripto ativos, no Imposto sobre o Rendimento das Pessoas Singulares (IRS) português. O objetivo é, portanto, explorar o sistema tributário português, a sua estrutura e princípios, dando especial atenção ao IRS incluindo a tributação dos rendimentos de trabalho e de capital. Para saber como tributar os cripto ativos é primeiro necessário compreender o que estes são, como funcionam e que tipos de cripto ativos existem.
As regras de tributação terão, pois, de ser criadas ou interpretadas tendo em conta o tipo de ativos em causa, podendo e devendo ser feitos paralelismos com as características e funcionalidades dos instrumentos financeiros tradicionais.
Uma vez que os cripto ativos ultrapassam as fronteiras dos países, é necessário apurar quais os desenvolvimentos ao nível internacional para aumentar a regulação, cooperação e a partilha de informação entre as diferentes jurisdições, incluindo iniciativas como o CARF, a DAC 8 e o MiCA.
Por fim cabe-nos analisar as soluções existentes, explorando especialmente as partes que consideramos poder ser alvo de melhorias, propondo, por fim, alguns pontos de partida para soluções alternativas
Investigando Ações Corporais como Engajamentos Interacionais de Adultos Autistas Não Verbais em Práticas de Dança-Contato
Get PDFA presente pesquisa tem como objetivo explorar tipos de ações corporais, como gestos, postura e
suas relações com o ambiente, que podem emergir como engajamentos interacionais em uma
mulher adulta com TEA não verbal, no contexto de práticas de improvisação em Dança.
Focalizaremos as práticas incorporadas (Goodwin, LeBaron, Streeck, 2011; Evola, 2019) que
acontecem sem o uso da fala, face a face e outros alinhamentos mainstream, como meio
interacional dentro de uma interação (Ochs e Solomon 2010). Estudos mostram que sujeitos TEA
não verbais interagem por meio de outras modalidades, como ações corporais, olhares, gestos e
objetos no espaço, o que pode sugerir uma pista de coordenação social ordenada, não possível por
meio da fala, por exemplo. As metodologias são: 1) Vídeo-Gravação de sessões de práticas de
improvisação em Dança; 2) Anotação de unidades de movimento (Evola e Skubisz, 2019) usando
como ferramenta o MotionNotes (2022) e o ELAN (2023); 3) Análise dos dados com base na
literatura sistematizada. Este estudo tem como objetivo oferecer uma análise de unidades de
movimentos classificados como self-focused que emergem, em contextos propícios ao seu
aparecimento, como context-focused movements e communication-focused movements (Evola,
2019; Freedman & Bucci, 1981; Krout, 2004; Pierce, 1955) e, por fim, uma sistematização desses
movimentos que acontecem no corpo de uma adulta com TEA não verbal em oficinas de Dança
com contato-improvisação.This research aims to explore types of bodily actions, such as gestures, posture and their
relationship to the environment, that can emerge as interactional engagements in an adult woman
with non-verbal ASD, in the context of improvisational practices in Dance. We will focus on
embodied practices (Goodwin, LeBaron, Streeck, 2011; Evola, 2019) that take place without the
use of speech, face to face and other mainstream alignments, as an interactional medium within an
interaction (Ochs and Solomon 2010). Studies show that non-verbal ASD subjects interact through
other modalities, such as body actions, gazes, gestures and objects in space, which may suggest a
hint of ordered social coordination, not possible through speech, for example. The methodologies
are: 1) Video-recording of dance improvisation practice sessions; 2) Annotation of movement units

Os Congressos do Partido Republicano Português, 1883-1911: republicanismos em debate
No full textOs congressos do Partido Republicano Português (PRP), foram um conjunto de reuniões
magnas que se foram sucedendo durante os vinte e oito anos da existência daquela
organização política, desde 1883 até à sua total fragmentação em 1911, e que nunca foram
objeto de uma investigação sistematizada.
Esta investigação pretende demonstrar que o impulso para a formação do Partido
Republicano Português, foi dado em Coimbra no início de 1860, na sequência de ações
planificadas e executadas por Joaquim Teófilo Fernandes Braga tendo como ponto mais
alto, em 1880, por sua iniciativa, as comemorações do tricentenário da morte de Luís de
Camões.
Com a pesquisa dos congressos realizados durante a existência do Partido Republicano,
procuraremos compreender a organização interna do partido, a evolução das sucessivas
leis orgânicas, cada vez mais centralizadoras, e a razão dessa evolução.
Igualmente tencionamos construir uma imagem, da vida do Partido Republicano,
elencando os principais nomes que acompanharam Teófilo Braga até 1911, dos processos
de luta adotados, das ações de propaganda e das inovadoras técnicas usadas pelos
deputados republicanos para desequilibrar o funcionamento do parlamento e por vezes
mesmo para o bloquear.The congresses of the Portuguese Republican Party (PRP) were a series of major meetings
that took place over the twenty-eight years of the political organisation's existence, from
1883 until its total fragmentation in 1911, and which have never been the subject of
systematic research.
This research aims to show that the impetus for the formation of the PRP was given in
Coimbra in the early 1860s, following actions planned and carried out by Joaquim Teófilo
Fernandes Braga, the highlight of which was the commemorations of the tercentenary of
the death of Luís de Camões in 1880, on his initiative.
By researching the congresses held during the Republican Party's existence, we will try
to understand the party's internal organisation, the evolution of the successive organic
laws, which were increasingly centralising, and the reason for this evolution.
We also intend to build up a picture of the life of the Republican Party, listing the main
names who accompanied Teófilo Braga until 1911, the processes of struggle adopted, the
propaganda actions and the innovative techniques used by Republican deputies to
unbalance the workings of parliament and sometimes even to block it

How to engage online consumers towards a fragrance they have not smelled before - recommendations for fragrance brands
No full textThe purpose of this study is to examine the effectiveness of online fragrance finder tools and
their impact on consumer purchasing behavior. The research classifies consumers into three
personas to understand the challenges and wishes for purchasing fragrances online. A
conceptual framework illustrates how scent finder tools influence consumer preferences and
purchase intentions. Results indicate that while online tools can enhance consumer confidence,
significant barriers remain due to the inability to physically experience scents. Findings
highlight the need for strategies that balance detailed olfactory information with lifestyle related insights to optimize the online fragrance shopping experience
